Multi-state compliance

Management of social security compliance for employees working across multiple EU Member States, including identification of applicable legislation under Regulation 883/2004.

OVERVIEW

  • identifying the applicable social security legislation in multi-state scenarios
  • verifying the “substantial activity” requirement in the country of residence
  • managing the application and issuance of the A1 certificate
  • preventing risks of double contributions or non-compliance
  • aligning business operations with EU obligations

Which country the service is available for:

European UnionEuropean Economic Area

Companies operating in the EU

Italian and foreign companies employing individuals working across multiple EU countries (e.g. sales roles, travelling managers, cross-border remote workers) requiring proper determination of the applicable social security framework.

Multi-state analysis

When an employee regularly works in two or more Member States, it is essential to determine which social security legislation applies, avoiding overlaps or contribution errors. Arletti & Partners analyses the employee’s work patterns (time, location, functions), verifies whether a “substantial part” of the activity is performed in the country of residence, and identifies the correct framework under Article 13 of Regulation 883/2004.

The service also includes support in preparing documentation and managing the A1 certificate process.

Service delivery

A&P services are delivered remotely or on-site, depending on the client’s needs.

Our operating model includes:

  • remote management of all related accounting, tax, and administrative requirements
  • digital tools ensuring maximum efficiency without the need for travel
  • support provided by our professionals in English

Timing

Support is essential both in the planning phase, before starting activities in multiple countries, and in situations where cross-border working arrangements are already in place. Within 24 hours of receiving the request, we provide initial feedback and begin collecting information through a dedicated form. This is followed by an internal analysis carried out by our specialist teams and the sharing of our service proposal and fee quote.

Once the required documentation is collected, operational activities begin, with timelines defined based on the complexity of the case and focused on efficiency.

EU compliance risks

Improper management of employees working across multiple countries may result in double contributions, gaps in social security coverage, and challenges from national authorities. Arletti & Partners ensures the correct identification of the applicable legislation and alignment between actual activities and contribution obligations, reducing compliance risks.
