Sunday and Night Work authorization in Switzerland

Studio A&P supports companies posting employees abroad who need to work in Switzerland on Sundays or Holidays (LL, art. 18, 19, 20 and OLL, art. 21, 33) or during the night (LL, art. 16, 17 and OLL 1, art. 27, 28, 29, 30, 31, 32, 33, 46) to comply with requests from the customer abroad and/or the organizational workflow of the establishment where the activity will be carried out.

Document preparation

Through its specialized support, Team Posting will prepare all the documents needed to obtain the authorization from Switzerland cantonal authorities:

  • Posting notification,
  • Questionnaire for the authorization for Sunday/Night work,
  • Letter of acceptance of the Sunday/Night shift for the employee,
  • Written proof of the objective need for intervention during Sunday/Night,
  • Working and salary conditions for activities during Sunday/Night.

Requirement for Switzerland

The Swiss Labour Law is applicable for all the companies that want to provide services locally; therefore, all companies shall obtain an authorization before scheduling any activity during Sunday (or during a Holiday)/Night.

At least 7 days before the beginning of the assignment

Based on the LL, art. 49 and OLL 1, art. 42, the authorization request must be submitted at least 7 days before the beginning of the temporary activity in Switzerland.

In addition, it is not possible to provide any service on a Sunday/Night without the final decision of the authorities.

Global Mobility compliance

When posting an employee abroad, the company should always assess any requirements applicable to the specific assignment in advance.

Should a company decide to begin activities without obtaining the proper authorization, it may be at risk of potential damages to their reputation due to fines, as well as bans from providing service within Switzerland for up to 5 years.
