Studio A&P supports companies and self-employed workers posted abroad in providing a timely response to Labour Inspectorates during on-site inspections.

Through its specialised support for on-site inspection, Studio A&P provides the assistance needed when facing an inspection. The auditing process can extend to the following areas:

Where can the authorities show up?

The inspection process is mostly carried out on the establishment where the service provision is taking place. Nonetheless, the authorities can also access the amenities of the workers to check the quality of their stay, as well as reaching out to the company directly by phone, by e-mail or by post.

When can an inspection happen?

Based on the local legislation on posting of workers, the authorities have the right to carry out an inspection not only during the duration of the activities, but up to 5 years after the end of the assignment. Therefore, it is extremely important for the companies to keep a record of all the information and documents that might be requested during an inspection. Directive 2014/67/EU provides a list of all the posting-related documents that can be requested during an inspection.

Reasons for prioritising inspections

An on-site inspection in a foreign Country might seem something a company might overlook because it could be difficult for the authorities to enforce their decisions.

Contrary to this, the enforcement is done through a strong international collaboration between authorities (Directive 2014/67/EU, art. 15).

In addition, companies might receive potential damages to their reputation due to fines, as well as bans from providing service within a Country for up to 2 years.
