With official note no. 288 dated July 15, 2025, the Italian National Labour Inspectorate (INL) provided detailed guidance on how to obtain additional credits under the points-based license system, introduced by Ministerial Decree no. 132/2024.
Article 5, paragraph 7, of the decree allows companies and self-employed workers to increase the initial score (set at 30 points) up to a maximum of 100, through the possession of specific additional requirements. The main criteria are outlined below.
Business registration seniority (Chamber of Commerce)
Pursuant to Article 5, paragraph 2, of Ministerial Decree 132/2024, up to 10 additional credits may be granted based on a company’s registration date with the Chamber of Commerce. For Italian-registered entities, this information is retrieved automatically. In other cases, a self-declaration by the legal representative is required.
For foreign businesses or professionals working on construction sites not required to be registered with the Chamber (e.g., archaeologists), seniority must be self-declared based on the VAT registration date or enrollment in the separate INPS contribution scheme.
Points are not cumulative from one year to the next: only the score corresponding to the current year will be considered.
Health and Safety Management System Certifications and Compliance Declarations
Further points may be awarded for holding:
- A certification compliant with UNI EN ISO 45001, issued by certification bodies accredited by ACCREDIA or other bodies that are members of the IAF MLA (International Accreditation Forum – Multilateral Recognition Arrangement);
- A Health and Safety Management System in accordance with Article 30 of Legislative Decree no. 81/2008, certified by a bipartite body according to UNI 11751-1.
In all cases, full documentation including the validity period must be submitted. Updates may be uploaded starting one month before the expiration date of the previous certificate.
Consultancy and monitoring
Consultancy and monitoring services provided with a positive outcome by bipartite bodies listed in the national register under Article 51 of Legislative Decree 81/2008 and accompanied by an official certificate of support services to the company, are also eligible for the assignment of additional points.
SOA (Public Works Certification) Certifications
Additional points are also granted for the possession of:
- SOA Certification – Class I
- SOA Certification – Class II
SOA (Società Organismo di Attestazione) is the Italian Certification Body responsible for qualifying companies to perform public works.
Regardless of the category, the legal representative must submit the SOA certificate with the applicable three-year validity. Updates are allowed to start one month before the current certification expires.
Corrections, suspensions, and inspections
In the event of a temporary suspension of one or more requirements, the company must promptly notify the relevant Labour Inspectorate office to have the corresponding credits deducted. Errors in data entry may be corrected by the legal representative before the automatic score update occurs (between 12:00 a.m. and 3:00 a.m.). Otherwise, the correction must be requested via the local office or by certified email (PEC), stating the company’s tax code and reason for correction.
During inspections, if any declared requirements are found to be invalid, inspectors may propose the removal of the relevant credits using the “Points-based License Check” system, subject to validation by the office manager. The deduction must be formalized and communicated to the company’s legal representative.
Statements and Official Authorizations
Foreign individuals who lack a digital identity (e.g., SPID, CIE, CNS, eIDAS) must visit a local Labour Inspectorate office to be verified or to delegate a representative with digital credentials. For Italian nationals, access to the system is only permitted via a valid digital ID.
Professionals working on construction sites (e.g., archaeologists) who do not yet hold a license must also contact the local INL office for identification.
Lastly, for licenses issued before July 10, 2025, to subjects not registered with the Chamber of Commerce, consistency checks on submitted data are currently underway.
