Studio A&P manages an average of 400 business trips per month, including numerous transnational service provisions by temporary workers. To properly support temporary work agencies and user companies, Studio A&P has conducted an in-depth study of the European directives on transnational posting (96/71/EC and 2014/67) and their national transpositions to assist its clients with additional information on the requirements related to the notification of transnational service provision.
In addition to the mandatory communications to be sent to the competent foreign inspection authorities, temporary work agencies/user companies have additional specific obligations based on the particular country.
A foreign temporary work agency (accompanied by documentation proving it is authorized to supply personnel, as indicated by Article 3 of Legislative Decree No. 136 of July 17, 2016) that provides personnel to an Italian user company, which in turn posts the worker to an EU country, is required to notify the posting of the worker.
In addition, the user company must send a notice to the work agency to inform it of the posting and the related salary and working conditions in the foreign country. The document must also be translated into Italian and kept for a period of 2 years.
