Decree on Immigration Flows: The Latest Updates of the Measure Approved by the Italian Government

The Government has approved a Decree Law announcing new measures for the management of entries into Italy.

The Italian Council of Ministers has announced the approval of a new Decree Law supplementing the DPCM of September 27, 2023. Important updates have been introduced regarding the entry of unskilled workers into Italy, particularly in light of several irregularities that have emerged in the application of current measures.

The purpose of the new decree

The goal of this new decree is to simplify the procedures for requesting quotas. Among the announced measures are:

  1. Pre-filling of applications to exclude non-eligible ones in advance;
  2. Enhancement of communication between the databases of the involved parties (Ministries of Interior and Labor, INPS, AdE,…);
  3. Division of quotas over multiple “click days”;
  4. Obligation to confirm interest in hiring before issuing the visa;
  5. Mandatory election of a digital domicile by the employer, allowing the signing of the residence contract without visiting the Prefecture offices;
  6. Ban on access to quotas for the following 3 years for employers who do not finalize the employment contract after the worker’s entry or who employ workers without a contract;
  7. Limitation on the number of requests each employer can submit, based on factors such as turnover and sector of activity;
  8. Seasonal workers are allowed to sign a new employment contract within 60 days after the expiration of the previous contract, either with the same or a different employer. Furthermore, it is allowed to convert the seasonal permit into a fixed-term or permanent work permit, outside the quota limits;
  9. In 2025, up to 10,000 people will be able to request a quota to work in the elderly and disabled care sector, with the exclusion of tacit approval in the examination of related applications;
  10. Elimination of tacit approval for the evaluation of clearance applications for citizens from high-risk countries (Bangladesh, Pakistan, and Sri Lanka).
