Starting April 1, 2024, the period of validity for the professional identification card for employees posted to France for construction or public projects by a foreign employer, BTP Card, will be extended to five years.
However, this extension will not retain its validity during breaks between two secondment periods.
Changes in the BTP Card with the new decree
The decree has introduced the deactivation of the professional identification card for temporary employees hired by temporary employment agencies in France during intervals between two assignments as well.
The foreign employer is no longer obliged to renovate the BTP cards in all cases, particularly with respect to:
- workplace locations;
- in the event of modifications to the information initially communicated;
- further changes during the assignment, or
- the start of a new assignment.
Posting companies were, in fact, obligated to notify the union des caisses within a 24-hour timeframe following any alterations in information pertaining to the site or worksite address.
New obligations for the BTP Card from April 1, 2024
Effective April 1, 2024, their only requisite will be to notify the “CIBTP France” association within 24-hours of any alterations related to information about or concerning their posted employees.
In the case of temporary workers, the foreign employer is obligated to amend the declaration used to acquire the aforementioned card before the commencement of the assignment.
This modification should specify the existence of a new assignment, its commencement and conclusion dates, along with the company name and the SIREN or SIRET number of the user company.
