Compliance with Labour Law requirements

- A tailored timesheet for the host Country,
- Instruction on how to fill out the timesheet,
- Employees’ Education certificates,
- Employees’ professional activity,
- Employees’ employment information.
Transnational provision of service in the EU, EEA, and Switzerland
The companies involved in a transnational provision of service should prepare a simulation of the gross salary for the posting abroad when posting a worker in the EU, EEA and Switzerland.
After the end of each month of posting
The company should take care of checking the monthly compliance with the host labour law on the timesheet each month and prepare a simulation payslip before accounting issues the official payslips to make sure whether an additional posting allowance is needed to align the workers to the host Country’s salary levels.
Reasons for a monthly check
Based on Directive 96/71/EC, and Directive 2018/957/EU, companies must always make sure to comply with either national collective bargaining agreement or the applicable national minimum salary (when CBA does not exist).
In case of violation, companies can be sanctioned based on the Host Country legislation on labour law.
