Compliance with Working Time Directive 2003/88/EC​

The Working Time Directive 2003/88/EC sets the fundamental rules on how working hours are organized across the European Union, ensuring that employees benefit from safe and fair working conditions.

Our firm supports businesses in meeting the requirements of the Working Time Directive, ensuring fair and safe working hours, adequate breaks, and proper overtime management for employees posted abroad.

  • Compliance checks.
  • Advice on working time, breaks and rest periods, overtime and record-keeping obligation when posting workers abroad.

Assistance workflow

Directive on Transparent and Predictable Working Conditions 2019/1152/EU

The Directive 2019/1152/EU introduced minimum rights and rules on the information to provide to workers about their working conditions when working abroad. We help companies in implementing the Transparent and Predictable Working Conditions Directive, ensuring legal compliance.

Our services include:

  • Document analysis and preliminary assessment of the posting company and posted employees.
  • Compliance checks.
  • Drafting of the mandatory Informative Letter to be sent to the posted worker prior to departure, containing the information referred to in Article 7 of Dir. 1152/2019:
  • the country or countries where the worker will carry out activities and the expected duration;
  • the currency in which the employer will pay the remuneration;
  • the benefits in cash or in kind inherent in the assignments;
  • whether repatriation is provided for and, if so, the conditions governing the worker’s repatriation;
  • the remuneration the worker should earn under the applicable law of the host Member State, where applicable;
  • the specific allowances for the posting and the arrangements for reimbursing travel, board and lodging expenses;
  • the link to the single official national website developed by the host Member State in accordance with Article 5(2) of Dir. 2014/67/EU of the European Parliament and of the Council.

Posted Workers Directive 96/71/EC and Enforcement Directive 2014/67/EU

The Posted Workers Directive (96/71/EC), reinforced by the Enforcement Directive (2014/67/EU), defines the rules for employees temporarily working in another EU Member State/EEA/Switzerland, ensuring fair treatment for workers and compliance requirements for posting companies.

he Revised Posted Workers Directive (2018/957/EU) strengthens the rules of the original Posted Workers Directive (96/71/EC), ensuring that employees temporarily sent to work in another EU Member State receive equal pay and working conditions as local employees.
