Starting from 27/11/2025, companies posting third-Country to Denmark in the framework of a service provision will face additional requirements.
Posting of workers to Denmark
Companies posting employees or self-employed workers involved in a service provision in Denmark have to, among other procedures, submit a posting of workers notification on the RUT portal.
Following LAW No 1458 of 10/12/2024 (Act amending the Act on the Posting of Employees, etc. and the Aliens Act), Denmark implemented additional controls over third-Country nationals.
Additional requirements for the companies
The amendment to the Act implements the obligation to upload:
- A copy of the service agreement between the posting company and the undertaking,
- A copy of the employment contract between the posting company and the worker,
- A copy of the worker’s residence and work permit.
The authorities accept a copy of the documents in either Danish or English.
Impact on the posting to Denmark
These new rules add an heavy burden to all service providers in Denmark.
As per the Amended Act, they must make sure that any worker involved has a valid form of identification to perform their activity in Denmark.
Furthermore, this grants the inspectors the authority to request additional documents and disclose potential illegal immigration in Denmark.
