France: New interpretation of the “Talent – Qualified Employee” permit

The French legislation was recently updated to simplify the existing immigration law, namely revising the visas and residence permits available.

On January 26th, 2024, the French authorities have amended the French Immigration and Asylum Code, through the so-called CESEDA reform.  

As a result, some categories of residence permits have been unified under a single category.   

The “Talent – Qualified Employee” permit

In details, the CESEDA reform has unified three previously distinct immigration statuses, namely:  

  • The qualified employee 
  • The employee of an innovative company  
  • The employee on assignment  

These workers’ categories now receive the same residence permit card named “Talent – Qualified Employee”, without mention of the specific sub-category applicable.  

Consequences

Consequently, the designation on the residence permit no longer clearly reflects the worker’s specific legal status. Therefore, recruiters will have to consider other factors when assessing a candidate’s eligibility, such as the employment contract proposed, salary level, whether they possess a degree, and so on.  

In fact, in order to determine whether a foreign candidate is suitable for a specific role, employers must check his or her actual immigration status and the work rights associated to their permit type, to make sure he or she receives a proper job offer.
