The UK authorities clarify the residence permit for Frontier Workers.

The permit for frontier workers is a novelty introduced by the British Government in December 2020 and is aimed at workers, employees or self-employed, who carry out a “real and effective” activity in the country and are not “mainly resident in the United Kingdom”.

Requirements for Visa eligibility

The visa is therefore aimed at EU workers who were already working in the UK as of 31 December 2020, who have continued to work in the UK at least once every 12 months and who do not usually live in the UK, that is: who have spent less than 180 days in the UK in any 12-month period, that is, have returned to their country of residence at least: (i) once every six months; (ii) twice in any 12 month period.

However, the British Authorities, consulted in this regard, have made it clear that self-employed or dependent activity must generate income in the United Kingdom. The workers hired by Italian companies and sent for short trips to the country do not therefore seem to have fallen within the case.
