Compliance with H&S requirements in Spain
Through its specialised support, Studio A&P provides the assistance needed when working within a construction site. The Posting consultants will provide an extensive list of all the documents and information required:
- Posted worker information and H&S training documents,
- H&S Plan for the construction site,
- Information and documents about the H&S structure of the company,
- H&S training documents of a company director,
- H&S Officer appointment,
- Information about the company’s staff,
- Information about the construction site in Spain,
- Information about the subcontractors involved in the activities.
Construction sites in Spain
The companies involved in a public or private construction site in Spain and carrying out provision of services should make sure to comply with the Real Decreto 1627/1997, Real Decreto 1109/2007, Orden TIN/1071/2010, and Ley 32/2006.
Different timings
The legislations previously mentioned require the companies to obtain the REA registration, the opening of the Centro de Trabajo, and the Libro de Subcontratación within the following deadlines:
- The posting notification, together with the application for the REA registration must be completed before the beginning of the activities,
- The opening of the Centro de Trabajo can be completed only after the REA registration has been approved. For activities not related to the construction sector, the company should inform the authorities about the opening of the Centro de Trabajo no later than 30 days after the beginning of the activities. On the other hand, for construction related activities the deadline is the day of the beginning of the activities,
- The Libro de Subcontratación should always be stamped before the beginning of the activities of the company’s subcontractors.
Reasons for complying with the legislations on construction activities and subcontracting
Based on article 40 of the Real Decreto Legislativo 5/2000, the sanction’s amount can vary depending on the nature of the breach (more or less serious offence).
