From 2020 to 2021, we have seen a rapid increase in controls and inspections in Finland in the field of health and safety at work. This State is one of the leading countries in terms of the number of posting notifications, with 20,000 employees posted to its territory from 57 foreign Countries. However, this situation doesn’t always lead to positive consequences.

1. The number of posting to Finland
In 2021 there was a significant increase in the number of sanctions and controls by the Occupational Safety and Health Divisions of the Regional State Administrative Agency: the number of inspections in Finland reached 238, which is impressive considering that the number of inspections in 2020 did not exceed 113.
2. General non-compliance on Finnish territory
Most of the inspections in Finland focused on the industrial and construction sectors. In general, the most common non-compliance in this field has to do with salary: actually, the salary of employees posted to Finland depends on the applicable collective agreement. However, out of 238 inspections, only 85 were compliant from this perspective, and in 43 of these a prior written advice had to be issued to demand the correction of the posted worker’s salary.
3. Consequences of written advice and sanction in the last year
The main targets of the inspections are Finnish companies that rely on subcontractors or other partners for posting workers. The Finnish Act on Posting Workers provides for sanctions for non-compliance with the obligation to previously notify the posting or to designate a contact person domiciled in Finland.
In 2021, the total number of fines issued was €149.000 compared to €99.500 in 2020.
The constant increase in the number of controls and sanctions against posting undertakings highlights the importance of managing workers’ posting in accordance with European directives, which pay increasing attention to salary alignment.
