importante sottolineare che il testo rispetta pienamente l\u2019autonomia delle parti sociali e la competenza degli Stati membri nel fissare i livelli salariali. Nei Paesi in cui i salari sono definiti esclusivamente tramite contratti collettivi, questo sistema pu\u00f2 continuare a operare senza modifiche.\u202f <\/p>\n\n\n\n<p>La norma riguarda tutti i lavoratori che godono di un contratto o rapporto di lavoro ai sensi della legislazione nazionale. La Direttiva UE 2022\/2041 considera i cambiamenti nel mercato del lavoro e le forme flessibili. Protegge anche i lavoratori pi\u00f9 vulnerabili come interinali, part-time, lavoratori su piattaforma e tirocinanti, se rientrano nella definizione di lavoratore dell\u2019UE.<\/p>\n\n\n\n<h2 Direttiva UE 2022\/2041: promuovere la contrattazione collettiva\u202f<\/span>&nbsp;<\/span><\/strong><\/h3>\n\n\n\n<p>La Direttiva UE 2022\/2041 chiede agli Stati membri di rafforzare la contrattazione collettiva dei salari, coinvolgendo sindacati e datori di lavoro e rispettando le prassi nazionali.<\/p>\n\n\n\n<p>Richiede inoltre agli Stati di proteggere lavoratori e sindacati da discriminazioni e interferenze nella contrattazione collettiva.<\/p>\n\n\n\n<p>Se la copertura della contrattazione collettiva \u00e8 inferiore all\u201980%, lo Stato \u00e8 obbligato a:\u202f <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>introdurre un quadro che favorisca la contrattazione;\u202f<\/li>\n\n\n\n<li>Elaborare un piano di azione per aumentare la copertura, rispettando chiari per stabilirne il livello, tenendo conto di:\u202f <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>potere d\u2019acquisto dei salari minimi legali, tenuto conto del costo della vita,<\/li>\n\n\n\n<li>livelli salariali,\u202f <\/li>\n\n\n\n<li>l\u2019andamento della crescita dei salari,\u202f<\/li>\n\n\n\n<li> produttivit\u00e0.<\/li>\n<\/ul>\n\n\n\n<p>Possono inoltre utilizzare valori di riferimento indicativi, anche internazionali, come il 60% del salario mediano o il 50% del salario medio, per valutare l\u2019adeguatezza del salario minimo.<\/p>\n\n\n\n<p>Per garantire che questo rimanga attuale e sufficiente, gli Stati devono aggiornarlo regolarmente:\u202f <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>almeno ogni due anni,\u202f <\/li>\n\n\n\n<li>oppure data-contrast=\"auto\">Sebbene la <\/span>D<span data-contrast=\"auto\">irettiva <\/span>UE 2022\/2041<span data-contrast=\"auto\"> lasci agli Stati la libert\u00e0 di definire nel dettaglio il sistema sanzionatorio, essa <\/span>garantisce <span data-contrast=\"auto\">tutele effettive, vietando paghe sotto il minimo e pratiche abusive dei datori di lavoro.<\/span><\/p>\n\n\n\n<p><span data-contrast=\"auto\">Nei Paesi che non dispongono di un salario minimo legale, le sanzioni possono consistere nelle penalit\u00e0 o compensazioni previste dai contratti
