Plus pr\u00e9cis\u00e9ment, en cas de conflit de lois, la loi applicable au contrat de travail doit \u00eatre d\u00e9termin\u00e9e conform\u00e9ment \u00e0 l&#8217;<strong>article 8 du r\u00e8glement Rome I<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Pour un aper\u00e7u g\u00e9n\u00e9ral de la question, consultez notre guide sur les<a href=\"https:\/\/arlettipartners.com\/fr\/juridictions-applicables-au-teletravail-depuis-letranger\/\"> juridictions applicables au t\u00e9l\u00e9travail depuis l&#8217;\u00e9tranger<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"h-article-8-of-the-rome-i-regulation\">Article 8 du r\u00e8glement Rome I<\/h2>\n\n<p class=\"wp-block-paragraph\">Cet article vise \u00e0 prot\u00e9ger les salari\u00e9s gr\u00e2ce \u00e0 un m\u00e9canisme de r\u00e8gles de conflit de lois. Ces r\u00e8gles s&#8217;appliquent lorsque, dans le cadre de l&#8217;ex\u00e9cution d&#8217;un contrat individuel, le travail est effectu\u00e9 dans un ou plusieurs \u00c9tats autres que celui (ou ceux) de la loi choisie.<\/p>\n\n<p class=\"wp-block-paragraph\">Les paragraphes suivants \u00e9tablissent une hi\u00e9rarchie entre les diff\u00e9rents facteurs de rattachement, permettant ainsi de d\u00e9terminer la <strong>loi applicable aux contrats comportant des \u00e9l\u00e9ments d&#8217;internationalit\u00e9.<\/strong> Cette loi sera appliqu\u00e9e en l&#8217;<strong>absence de choix des parties<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">L&#8217;article permet \u00e9galement d&#8217;identifier les dispositions imp\u00e9ratives qui pr\u00e9vaudront sur cette loi, si un choix a \u00e9t\u00e9 fait quant \u00e0 la loi applicable.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-mandatory-rules\">R\u00e8gles obligatoires<\/h2>\n\n<p class=\"wp-block-paragraph\">La d\u00e9cision relative \u00e0 la loi applicable ne doit pas \u00eatre pr\u00e9judiciable aux salari\u00e9s. \u00c0 cette fin, l\u2019article 8 du r\u00e8glement Rome I garantit aux<strong> salari\u00e9s la protection que leur conf\u00e8rent les r\u00e8gles imp\u00e9ratives<\/strong>. Il vise notamment les \u00ab dispositions auxquelles il ne peut \u00eatre d\u00e9rog\u00e9 par convention \u00bb.<\/p>\n\n<p class=\"wp-block-paragraph\">La <strong>protection minimale de la loi qui aurait r\u00e9gi le contrat<\/strong>, en l&#8217;absence de choix de loi par les parties, est garantie.<\/p>\n\n<p class=\"wp-block-paragraph\">Cette loi intervient comme suit\u00a0:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>La loi du <strong>pays dans lequel<\/strong> (ou, \u00e0 d\u00e9faut, d&#8217;o\u00f9) les <strong>employ\u00e9s exercent habituellement leur travail<\/strong> ; ou<\/li>\n\n\n\n<li>La loi du <strong>pays o\u00f9 se situe le si\u00e8ge social de l\u2019employeur<\/strong>, s\u2019il est impossible de d\u00e9terminer la loi applicable selon le crit\u00e8re ci-dessus ; ou<\/li>\n\n\n\n<li>La loi d&#8217;un <strong>pays qui<\/strong>, compte tenu des circonstances,<strong> entretient des liens plus \u00e9troits<\/strong> avec un pays autre que celui indiqu\u00e9 par les r\u00e8gles pr\u00e9c\u00e9dentes.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Les autorit\u00e9s nationales d\u00e9terminent dans quels domaines et pour quels motifs une r\u00e8gle a un caract\u00e8re obligatoire. Cela signifie qu&#8217;elle ne peut faire l&#8217;objet d&#8217;une d\u00e9rogation par accord <em>inter partes<\/em>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-application-of-mandatory-rules\">Application des r\u00e8gles obligatoires<\/h3>\n\n<p class=\"wp-block-paragraph\">La juridiction de renvoi devra d\u00e9terminer le caract\u00e8re imp\u00e9ratif ou suppl\u00e9tif d&#8217;une r\u00e8gle selon des crit\u00e8res herm\u00e9neutiques communs. Toutefois, elle fondera son analyse sur le syst\u00e8me dont la r\u00e8gle est issue.<\/p>\n\n<p class=\"wp-block-paragraph\">La jurisprudence de la Cour de justice de l&#8217;Union europ\u00e9enne souligne le caract\u00e8re obligatoire des <strong>r\u00e8gles relatives au salaire minimum<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Si les <strong>dispositions imp\u00e9ratives<\/strong> de la loi qui seraient applicables en l&#8217;absence de choix offrent une <strong>meilleure protection aux salari\u00e9s que celles de la loi choisie<\/strong>, elles <strong>pr\u00e9vaudront<\/strong> sur cette derni\u00e8re.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La loi choisie continuera de s&#8217;appliquer au reste de la relation contractuelle.<\/p>\n<\/blockquote>\n\n<p class=\"wp-block-paragraph\">Le fonctionnement du m\u00e9canisme d\u00e9crit n\u00e9cessite donc une proc\u00e9dure en trois \u00e9tapes\u00a0:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Identifier la <strong>loi<\/strong> qui aurait \u00e9t\u00e9 <strong>applicable en l&#8217;absence de choix<\/strong>\u00a0;<\/li>\n\n\n\n<li>D\u00e9terminer les <strong>r\u00e8gles auxquelles<\/strong>, de par ces derni\u00e8res, <strong>il ne peut \u00eatre d\u00e9rog\u00e9<\/strong> par convention ; et<\/li>\n\n\n\n<li>Comparer le <strong>niveau de protection<\/strong> qu&#8217;ils offrent aux employ\u00e9s avec celui pr\u00e9vu par la loi choisie par les parties.<\/li>\n<\/ol>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-law-chosen-by-the-parties\">La loi choisie par les parties<\/h2>\n\n<p class=\"wp-block-paragraph\">Le premier paragraphe de l&#8217;article 8 du r\u00e8glement Rome I pr\u00e9voit l&#8217;<strong>application de la loi choisie par les parties.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Les parties peuvent choisir librement, m\u00eame un pays avec lequel la relation n&#8217;a aucun lien objectif. Elles peuvent \u00e9galement r\u00e9glementer le contrat conform\u00e9ment aux lois de diff\u00e9rents \u00c9tats. Dans ce cas, la seule limite concerne la coh\u00e9rence interne des r\u00e8gles ainsi cr\u00e9\u00e9es.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-rome-i-regulation-and-the-lex-loci-laboris\">Le r\u00e8glement Rome I et la <em>lex loci laboris<\/em><\/h2>\n\n<p class=\"wp-block-paragraph\">En vertu de l&#8217;article 8, paragraphe 2, la <strong><em>lex loci laboris<\/em> s&#8217;applique<\/strong>. Il s&#8217;agit de la <strong>loi du pays o\u00f9 les salari\u00e9s exercent habituellement leur activit\u00e9 professionnelle<\/strong> ou, \u00e0 d\u00e9faut, du pays d&#8217;o\u00f9 ils exercent habituellement leur m\u00e9tier.<\/p>\n\n<p class=\"wp-block-paragraph\">La jurisprudence de la Cour de justice de l&#8217;Union europ\u00e9enne fournit des indications pour d\u00e9terminer le pays d&#8217;exercice habituel du travail. L&#8217;arr\u00eat Koelzsch souligne \u00e9galement le <strong>caract\u00e8re primordial<\/strong> de la <em>lex loci laboris<\/em> et encourage son interpr\u00e9tation extensive.<\/p>\n\n<p class=\"wp-block-paragraph\">En bref, elle s&#8217;identifie en \u00e9valuant les caract\u00e9ristiques substantielles de la relation, de sorte que l&#8217;\u00e9l\u00e9ment temporel prenne la forme d&#8217;un indicateur du lien fonctionnel entre le lieu d&#8217;ex\u00e9cution de l&#8217;activit\u00e9 et les int\u00e9r\u00eats que le contrat vise \u00e0 satisfaire.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-criterion-of-the-place-of-work\">Le crit\u00e8re du lieu de travail<\/h2>\n\n<p class=\"wp-block-paragraph\">S&#8217;il est impossible d&#8217;identifier un lieu o\u00f9 le travail est habituellement effectu\u00e9, c&#8217;est la <strong>loi de l&#8217;\u00c9tat o\u00f9 se situe le lieu de travail du salari\u00e9<\/strong> qui s&#8217;applique au contrat.<\/p>\n\n<p class=\"wp-block-paragraph\">Un \u00ab lieu de travail \u00bb ne n\u00e9cessite pas forc\u00e9ment une personnalit\u00e9 juridique distincte. Il doit toutefois pr\u00e9senter une certaine stabilit\u00e9. En principe, il doit appartenir \u00e0 l&#8217;entreprise qui emploie le salari\u00e9 et faire partie int\u00e9grante de sa structure.<\/p>\n\n<p class=\"wp-block-paragraph\">Le lieu d&#8217;\u00e9tablissement d&#8217;une entreprise autre que celui qui, formellement, ressort du contrat en tant qu&#8217;employeur peut \u00eatre qualifi\u00e9 comme tel s&#8217;il existe des \u00e9l\u00e9ments objectifs conduisant \u00e0 une situation concr\u00e8te diff\u00e9rente de celle qui d\u00e9coule des termes du contrat.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-exception-clause-of-the-rome-i-regulation\">Clause d&#8217;exception du r\u00e8glement Rome I<\/h2>\n\n<p class=\"wp-block-paragraph\">L\u2019exception pr\u00e9vue au quatri\u00e8me paragraphe de l\u2019article 8 du r\u00e8glement Rome I peut \u00eatre invoqu\u00e9e <strong>lorsqu\u2019il est impossible de d\u00e9terminer le lieu o\u00f9 le travail est habituellement effectu\u00e9<\/strong>. Elle s\u2019applique \u00e9galement si les circonstances li\u00e9es au contrat r\u00e9v\u00e8lent un <strong>lien plus \u00e9troit avec une autre juridiction<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Le recours \u00e0 cette clause est n\u00e9cessaire dans le cas du t\u00e9l\u00e9travail et du travail \u00e0 distance international, qui, structurellement, ne poss\u00e8dent pas de centre de gravit\u00e9 \u00ab physique \u00bb dans la relation.<\/p>\n<\/blockquote>\n\n<p class=\"wp-block-paragraph\">La sentence Schlecker pr\u00e9cise plusieurs <strong>\u00e9l\u00e9ments permettant de d\u00e9terminer la signification d&#8217;un lien avec un autre \u00c9tat<\/strong>. Ces \u00e9l\u00e9ments sont fond\u00e9s sur\u00a0:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Pays o\u00f9 le travailleur paie l&#8217;<strong>imp\u00f4t sur le revenu<\/strong>\u00a0;<\/li>\n\n\n\n<li>Pays dans lequel le travailleur est affili\u00e9 au <strong>syst\u00e8me de s\u00e9curit\u00e9 sociale<\/strong> et aux diff\u00e9rents r\u00e9gimes d\u2019assurance-retraite, maladie et invalidit\u00e9\u00a0;<\/li>\n\n\n\n<li>Ensemble des circonstances du processus, telles que les param\u00e8tres pris en compte pour \u00e9tablir la r\u00e9mun\u00e9ration et les autres conditions de travail.<\/li>\n<\/ul>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Le
