{"id":237858,"date":"2024-04-26T10:27:09","date_gmt":"2024-04-26T08:27:09","guid":{"rendered":"https:\/\/arlettipartners.com\/nouvel-accord-cadre-de-l-ue-sur-le-teletravail-transfrontalier\/"},"modified":"2026-07-15T12:09:06","modified_gmt":"2026-07-15T10:09:06","slug":"nouvel-accord-cadre-de-l-ue-sur-le-teletravail-transfrontalier","status":"publish","type":"post","link":"https:\/\/arlettipartners.com\/fr\/nouvel-accord-cadre-de-l-ue-sur-le-teletravail-transfrontalier\/","title":{"rendered":"Nouvel accord-cadre de l&#8217;UE sur le t\u00e9l\u00e9travail transfrontalier"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Compte tenu de la flexibilit\u00e9 et de la num\u00e9risation du march\u00e9 du travail, ainsi que de l&#8217;augmentation du t\u00e9l\u00e9travail transfrontalier impos\u00e9e par la pand\u00e9mie de Covid-19, le travail \u00e0 distance et le t\u00e9l\u00e9travail sont devenus beaucoup plus fr\u00e9quents.<\/p>\n\n<p class=\"wp-block-paragraph\">Afin d\u2019att\u00e9nuer \u00e0 court terme les effets de tels modes de travail sur la l\u00e9gislation applicable en mati\u00e8re de s\u00e9curit\u00e9 sociale, la Commission europ\u00e9enne a publi\u00e9 un <strong>accord-cadre multilat\u00e9ral le 21 juin 2023<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">En attendant la r\u00e9vision de la r\u00e9glementation communautaire et l&#8217;adoption d&#8217;une l\u00e9gislation sp\u00e9cifique sur le t\u00e9l\u00e9travail transfrontalier dans l&#8217;UE, l&#8217;accord offre une solution qui garantit les int\u00e9r\u00eats des travailleurs, des employeurs et des institutions de s\u00e9curit\u00e9 sociale.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Pour un aper\u00e7u de la s\u00e9curit\u00e9 sociale internationale, en termes de juridiction et de trait\u00e9s internationaux, consultez notre guide sur la<a href=\"https:\/\/arlettipartners.com\/fr\/securite-sociale-en-droit-du-travail-juridictions-applicables-et-traites-internationaux\/\"> s\u00e9curit\u00e9 sociale en droit du travail<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"h-scope-of-application-of-the-framework-agreement-on-cross-border-telework\">Champ d&#8217;application de l&#8217;accord-cadre sur le t\u00e9l\u00e9travail transfrontalier<\/h2>\n\n<p class=\"wp-block-paragraph\">Les b\u00e9n\u00e9ficiaires de l&#8217;Accord sont les travailleurs qui rel\u00e8vent du champ d&#8217;application de l&#8217;<strong>article 16, paragraphe 1, du r\u00e8glement (CE) n\u00b0 883\/2004<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Les conditions indispensables pour ces travailleurs sont leur<strong> r\u00e9sidence dans un \u00c9tat signataire<\/strong> et le <strong>si\u00e8ge social<\/strong> ou l\u2019\u00e9tablissement de leur employeur <strong>dans un autre \u00c9tat signataire<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">L\u2019accord-cadre relatif au t\u00e9l\u00e9travail transfrontalier couvre \u00e9galement les travailleurs auxquels la l\u00e9gislation de leur \u00c9tat de r\u00e9sidence serait applicable du fait de leur activit\u00e9 habituelle de t\u00e9l\u00e9travail transfrontalier, conform\u00e9ment \u00e0 l\u2019<strong>article 13, paragraphe 1, point a)<\/strong>, du r\u00e8glement (CE) n\u00b0 883\/2004.<br\/><br\/>Ces travailleurs doivent \u00eatre employ\u00e9s par une ou plusieurs entreprises ou <strong>employeurs<\/strong> (ci-apr\u00e8s d\u00e9nomm\u00e9s \u00ab l\u2019employeur \u00bb) ayant <strong>leur si\u00e8ge social<\/strong> ou leur \u00e9tablissement principal <strong>dans un seul autre \u00c9tat signataire<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">L\u2019article 1 de l\u2019accord-cadre d\u00e9finit le \u00ab <strong>t\u00e9l\u00e9travail transfrontalier<\/strong> \u00bb comme toute activit\u00e9 exerc\u00e9e dans un ou plusieurs \u00c9tats membres, autre que celui o\u00f9 se trouvent les locaux ou le si\u00e8ge social de l\u2019employeur.<\/p>\n<\/blockquote>\n\n<p class=\"wp-block-paragraph\">Cette activit\u00e9 doit s\u2019<strong>appuyer sur les technologies de l\u2019information<\/strong>, permettant aux travailleurs de rester connect\u00e9s \u00e0 l\u2019environnement de travail de l\u2019employeur ou aux clients, afin d\u2019effectuer les t\u00e2ches qui leur sont confi\u00e9es par l\u2019employeur, dans le cas des salari\u00e9s, ou par les clients, dans le cas des travailleurs ind\u00e9pendants.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-signatory-states-to-the-framework-agreement-on-cross-border-telework\">\u00c9tats signataires de l&#8217;Accord-cadre sur le t\u00e9l\u00e9travail transfrontalier<\/h2>\n\n<p class=\"wp-block-paragraph\">L\u2019Accord ne s\u2019applique qu\u2019aux \u00c9tats signataires. Pour les \u00c9tats qui l\u2019adopteront apr\u00e8s le 1er juillet 2023, l\u2019Accord entrera en vigueur le premier jour du mois suivant sa signature.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00c0 ce jour, les \u00c9tats signataires sont les suivants\u00a0:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Autriche;<\/li>\n\n\n\n<li>Belgique;<\/li>\n\n\n\n<li>Croatie;<\/li>\n\n\n\n<li>R\u00e9publique tch\u00e8que;<\/li>\n\n\n\n<li>Finlande;<\/li>\n\n\n\n<li>France; <\/li>\n\n\n\n<li>Allemande;<\/li>\n\n\n\n<li>Italie;<\/li>\n\n\n\n<li>Liechtenstein;<\/li>\n\n\n\n<li>Luxembourg;<\/li>\n\n\n\n<li>Malte;<\/li>\n\n\n\n<li>Norv\u00e8ge;<\/li>\n\n\n\n<li>Pologne;<\/li>\n\n\n\n<li>Portugal;<\/li>\n\n\n\n<li>Espagne;<\/li>\n\n\n\n<li>Su\u00e8de;<\/li>\n\n\n\n<li>Suisse;<\/li>\n\n\n\n<li>Pays-Bas;<\/li>\n\n\n\n<li>Slov\u00e9nie;<\/li>\n\n\n\n<li>Slovaquie.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">L\u2019<strong>Italie<\/strong> a sign\u00e9 l\u2019accord le 28 d\u00e9cembre 2023 et celui-ci est <strong>entr\u00e9 en vigueur le 1er janvier 2024.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">L&#8217;<strong>INPS<\/strong>, \u00e0 travers son Message n. Le d\u00e9cret n\u00b0 1072 du 13 mars 2024 <strong>a fourni les premi\u00e8res lignes directrices pratiques pour son application<\/strong>, en mati\u00e8re de t\u00e9l\u00e9travail transfrontalier habituel.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-conditions-for-the-applicability-of-the-framework-agreement\">Conditions d\u2019applicabilit\u00e9 de l\u2019accord-cadre<\/h2>\n\n<p class=\"wp-block-paragraph\">Conform\u00e9ment \u00e0 l\u2019article 2, paragraphe 3, l\u2019Accord s\u2019applique <strong>exclusivement<\/strong> aux cas de <strong>t\u00e9l\u00e9travail transfrontalier habituel<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Les employeurs peuvent soumettre une demande pour <strong>soumettre les travailleurs \u00e0 la l\u00e9gislation sur la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat dans lequel ils ont leur si\u00e8ge social ou leur \u00e9tablissement<\/strong>, si certaines conditions sont remplies\u00a0:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>L\u2019<strong>\u00c9tat de r\u00e9sidence du travailleur doit \u00eatre diff\u00e9rent<\/strong> de l\u2019\u00c9tat o\u00f9 se trouve le si\u00e8ge social ou l\u2019\u00e9tablissement de l\u2019employeur\u00a0;<\/li>\n\n\n\n<li>Le <strong>t\u00e9l\u00e9travail transfrontalier dans l\u2019\u00c9tat de r\u00e9sidence<\/strong> doit repr\u00e9senter <strong>moins de 50 %<\/strong> du temps de travail total\u00a0;<\/li>\n\n\n\n<li>La demande doit \u00eatre soumise avec le <strong>consentement de l&#8217;employeur et de l&#8217;employ\u00e9<\/strong>.<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Pour tous les cas non couverts par l\u2019Accord, les parties concern\u00e9es sont en droit de conclure un <strong>accord individuel<\/strong>, conform\u00e9ment \u00e0 l\u2019article 16, paragraphe 1, du r\u00e8glement (CE) n\u00b0 883\/2004. Aux fins de l\u2019application de l\u2019Accord, il est n\u00e9cessaire que les deux \u00c9tats concern\u00e9s (l\u2019\u00c9tat de r\u00e9sidence du travailleur et l\u2019\u00c9tat o\u00f9 se situe l\u2019\u00e9tablissement de l\u2019employeur) soient parties \u00e0 l\u2019Accord.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-legislation-applicable-to-cross-border-telework-in-the-eu\">L\u00e9gislation applicable au t\u00e9l\u00e9travail transfrontalier dans l&#8217;UE<\/h3>\n\n<p class=\"wp-block-paragraph\">L\u2019article 3 de l\u2019accord sign\u00e9 par l\u2019Italie suit le mod\u00e8le standard. Ainsi, conform\u00e9ment \u00e0 l\u2019article 16, l\u2019accord pr\u00e9voit une e<strong>xception par rapport aux articles 12 et 13 du r\u00e8glement susmentionn\u00e9<\/strong>. Lorsqu\u2019un travailleur ou un employeur soumet une demande en application de l\u2019article 16, les dispositions particuli\u00e8res de l\u2019accord-cadre s\u2019appliquent.<\/p>\n\n<p class=\"wp-block-paragraph\">Autrement dit, l\u2019article 3 introduit la possibilit\u00e9 de<strong> d\u00e9roger \u00e0 la r\u00e8gle g\u00e9n\u00e9rale r\u00e9gissant la l\u00e9gislation applicable<\/strong> au t\u00e9l\u00e9travail transfrontalier, lorsque l\u2019activit\u00e9 est exerc\u00e9e dans deux \u00c9tats membres ou plus. Cela permet de <strong>maintenir la l\u00e9gislation de l\u2019\u00c9tat o\u00f9 se situe le si\u00e8ge social ou le domicile de l\u2019employeur<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">L\u2019<strong>article 13<\/strong>, paragraphe 1, lettre a) <strong>du r\u00e8glement (CE) n\u00b0 883\/2004<\/strong> pr\u00e9voit en effet qu\u2019une personne qui exerce habituellement une activit\u00e9 salari\u00e9e dans deux ou plusieurs \u00c9tats membres est soumise \u00e0 la <strong>l\u00e9gislation de l\u2019\u00c9tat de r\u00e9sidence<\/strong>, si cette activit\u00e9 repr\u00e9sente 25 % ou plus de son activit\u00e9 dans cet \u00c9tat.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-time-limits-of-the-derogation-requests\">D\u00e9lais de traitement des demandes de d\u00e9rogation<\/h2>\n\n<p class=\"wp-block-paragraph\">Conform\u00e9ment \u00e0 l\u2019article 4 de l\u2019Accord, les <strong>demandes de d\u00e9rogation<\/strong> vis\u00e9es \u00e0 l\u2019article 3 de l\u2019Accord doivent \u00eatre <strong>introduites dans l\u2019\u00c9tat membre dont la l\u00e9gislation s\u2019applique au travailleur<\/strong>, conform\u00e9ment aux dispositions de l\u2019article 18 du r\u00e8glement n\u00b0 883\/2004. Cela signifie que les demandeurs doivent adresser leur demande \u00e0 l\u2019institution comp\u00e9tente de l\u2019\u00c9tat membre o\u00f9 se situe le si\u00e8ge social ou l\u2019\u00e9tablissement principal de l\u2019employeur.<\/p>\n\n<p class=\"wp-block-paragraph\">La l\u00e9gislation applicable, d\u00e9termin\u00e9e conform\u00e9ment \u00e0 la demande de d\u00e9rogation, peut rester en vigueur pendant une <strong>p\u00e9riode maximale de trois ans<\/strong>, avec possibilit\u00e9 de <strong>prolongation<\/strong> sur pr\u00e9sentation d&#8217;une nouvelle demande.<\/p>\n\n<p class=\"wp-block-paragraph\">Les demandes ne peuvent concerner que des p\u00e9riodes de t\u00e9l\u00e9travail transfrontalier qui se situent temporairement apr\u00e8s la date d&#8217;entr\u00e9e en vigueur de l&#8217;Accord pour les deux \u00c9tats signataires concern\u00e9s.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-submission-of-the-requests-pursuant-to-art-16-of-regulation-ec-n-883-2004\">Soumission des demandes, conform\u00e9ment \u00e0 l&#8217;article 16 du r\u00e8glement (CE) n\u00b0 883\/2004<\/h2>\n\n<p class=\"wp-block-paragraph\">Comme indiqu\u00e9 pr\u00e9c\u00e9demment, les demandes de d\u00e9rogation doivent \u00eatre soumises dans l\u2019\u00c9tat membre o\u00f9 se trouve le si\u00e8ge social ou le domicile de l\u2019employeur.<\/p>\n\n<p class=\"wp-block-paragraph\">En cas de modification des circonstances ayant conduit \u00e0 l\u2019acceptation de la demande, l\u2019employeur ou le travailleur doit en informer imm\u00e9diatement l\u2019\u00c9tat membre dont la l\u00e9gislation est applicable (l\u2019\u00c9tat de l\u2019employeur). Ce dernier devra alors r\u00e9examiner le dossier et, le cas \u00e9ch\u00e9ant, retirer ou r\u00e9voquer le <strong>certificat de l\u00e9gislation applicable<\/strong> (<a href=\"https:\/\/arlettipartners.com\/fr\/formulaire-a1-travailleurs-detaches\/\">document portable A1<\/a>).<\/p>\n\n<p class=\"wp-block-paragraph\">Enfin, la huiti\u00e8me section du message n\u00b0\u00a01072 de l\u2019INPS apporte des pr\u00e9cisions sur les <strong>modalit\u00e9s de demande <\/strong>d\u2019attestation de l\u00e9gislation applicable (document portable A1), conform\u00e9ment \u00e0 l\u2019article\u00a03 de la Convention. La demande doit \u00eatre accompagn\u00e9e d\u2019<strong>une copie de la convention de t\u00e9l\u00e9travail<\/strong> conclue entre l\u2019employeur et le salari\u00e9.<\/p>\n\n<blockquote
