En droit du travail, elle vise \u00e0 garantir la protection et le bien-\u00eatre des travailleurs, dans diff\u00e9rents contextes et situations.<\/p><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Toutefois, <strong>lorsque les travaux sont effectu\u00e9s \u00e0 l&#8217;\u00e9tranger<\/strong>, des questions complexes se posent quant aux juridictions comp\u00e9tentes et \u00e0 l&#8217;application des trait\u00e9s internationaux.<\/p>&#13;\n&#13;\n<h2 id=\"h-sicurezza-sociale-cos-e\" class=\"wp-block-heading\">Comment fonctionne la s\u00e9curit\u00e9 sociale ?<\/h2>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">La s\u00e9curit\u00e9 sociale est un syst\u00e8me qui assure une protection financi\u00e8re et une assistance sociale aux travailleurs et \u00e0 leurs familles, dans des circonstances telles que la <strong>maladie, les blessures, le ch\u00f4mage, la maternit\u00e9 et la retraite<\/strong>.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Dans de nombreux pays, la s\u00e9curit\u00e9 sociale est g\u00e9r\u00e9e par le biais de c<strong>otisations obligatoires<\/strong> des employeurs et des salari\u00e9s. Ces cotisations servent ensuite \u00e0 financer les prestations fournies par le syst\u00e8me.<\/p>&#13;\n&#13;\n<h2 id=\"h-sicurezza-sociale-internazionale\" class=\"wp-block-heading\">S\u00e9curit\u00e9 sociale internationale<\/h2>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">En droit du travail, la s\u00e9curit\u00e9 sociale internationale d\u00e9signe la protection sociale des citoyens d&#8217;un pays qui r\u00e9sident habituellement dans un autre. Cette protection est assur\u00e9e par des <strong>r\u00e9glementations internationales<\/strong>.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Au sein de l&#8217;<strong>Union europ\u00e9enne<\/strong>, la protection sociale est assur\u00e9e par l&#8217;application de la <strong>r\u00e9glementation europ\u00e9enne<\/strong> en mati\u00e8re de s\u00e9curit\u00e9 sociale. Cette r\u00e9glementation est imm\u00e9diatement et directement applicable dans les 27 \u00c9tats membres de l&#8217;UE.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Pour d\u00e9terminer la l\u00e9gislation applicable en mati\u00e8re de s\u00e9curit\u00e9 sociale dans le cas du <strong>t\u00e9l\u00e9travail \u00e0 l&#8217;\u00e9tranger<\/strong>, une distinction est faite entre la r\u00e9glementation en vigueur dans les \u00c9tats membres de l&#8217;UE et celle en vigueur dans les \u00c9tats hors UE.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Dans le contexte europ\u00e9en, \u00e0 compter du 1er mai 2010, les r\u00e8glements actuellement en vigueur sont le <strong>r\u00e8glement (CE) n\u00b0 883\/2004<\/strong> et son <strong>r\u00e8glement d\u2019ex\u00e9cution (CE) n\u00b0 987\/2009.<\/strong><\/p>&#13;\n\r\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">&#13;\n<p class=\"wp-block-paragraph\">En ce qui concerne le t\u00e9l\u00e9travail \u00e0 l&#8217;\u00e9tranger, la Commission europ\u00e9enne a publi\u00e9 le 21 juin 2023 un <a href=\"https:\/\/arlettipartners.com\/fr\/nouvel-accord-cadre-de-l-ue-sur-le-teletravail-transfrontalier\/\">accord-cadre multilat\u00e9ral<\/a> sur la l\u00e9gislation applicable en mati\u00e8re de s\u00e9curit\u00e9 sociale.<\/p>&#13;\n<\/blockquote>\r\n&#13;\n<p class=\"wp-block-paragraph\"><strong>En dehors de l&#8217;Union europ\u00e9enne<\/strong>, en l&#8217;absence d&#8217;accords multilat\u00e9raux ou bilat\u00e9raux r\u00e9gissant la s\u00e9curit\u00e9 sociale, la juridiction applicable est d\u00e9termin\u00e9e par l&#8217;analyse des l\u00e9gislations du pays d&#8217;origine et du pays d&#8217;accueil.<\/p>&#13;\n&#13;\n<h2 id=\"h-lavoro-all-estero-e-giurisdizioni-applicabili\" class=\"wp-block-heading\">S\u00e9curit\u00e9 sociale en droit du travail\u00a0: juridictions applicables au travail \u00e0 l\u2019\u00e9tranger<\/h2>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Dans le cas de travaux effectu\u00e9s \u00e0 l&#8217;\u00e9tranger, certaines questions se posent quant \u00e0 la juridiction applicable en mati\u00e8re de s\u00e9curit\u00e9 sociale.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">De mani\u00e8re g\u00e9n\u00e9rale, il convient de consid\u00e9rer deux principales juridictions\u00a0:<\/p>&#13;\n\r\n<ul class=\"wp-block-list\">&#13;\n<li><strong>L\u00e9gislation de l\u2019\u00c9tat de r\u00e9sidence<\/strong>. Dans de nombreux cas, les travailleurs peuvent rester soumis \u00e0 la l\u00e9gislation de l\u2019\u00c9tat o\u00f9 ils r\u00e9sident, m\u00eame si leur travail est effectu\u00e9 \u00e0 l\u2019\u00e9tranger. Cela d\u00e9pend de divers facteurs, notamment de la dur\u00e9e pr\u00e9vue des t\u00e2ches effectu\u00e9es \u00e0 l\u2019\u00e9tranger et des accords bilat\u00e9raux ou multilat\u00e9raux conclus entre les \u00c9tats concern\u00e9s.<\/li>&#13;\n\r\n\r\n&#13;\n<li><strong>L\u00e9gislation de l&#8217;\u00c9tat o\u00f9 le travail est effectu\u00e9<\/strong>. Dans certains cas, notamment si les prestations \u00e0 l&#8217;\u00e9tranger sont de longue dur\u00e9e ou permanentes, les travailleurs peuvent \u00eatre soumis \u00e0 la l\u00e9gislation de l&#8217;\u00c9tat o\u00f9 ils exercent effectivement leurs fonctions.<\/li>&#13;\n<\/ul>\r\n&#13;\n<h2 id=\"h-applicazione-dei-trattati-internazionali-nbsp\" class=\"wp-block-heading\">Application des trait\u00e9s internationaux<\/h2>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Afin de r\u00e9soudre les probl\u00e8mes li\u00e9s \u00e0 la s\u00e9curit\u00e9 sociale en cas de travail transfrontalier, de nombreux pays ont conclu des <strong>trait\u00e9s bilat\u00e9raux ou multilat\u00e9raux<\/strong>. Ces trait\u00e9s \u00e9tablissent des r\u00e8gles et des proc\u00e9dures <strong>permettant de d\u00e9terminer la comp\u00e9tence en mati\u00e8re de s\u00e9curit\u00e9 sociale<\/strong> et de <strong>coordonner les syst\u00e8mes de s\u00e9curit\u00e9 sociale<\/strong> des \u00c9tats contractants.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Par exemple, un trait\u00e9 international peut stipuler qu&#8217;un travailleur d\u00e9tach\u00e9 temporairement \u00e0 l&#8217;\u00e9tranger reste soumis \u00e0 la l\u00e9gislation de son pays d&#8217;origine. Ce trait\u00e9 peut toutefois pr\u00e9voir des d\u00e9rogations ou des exceptions pour des cas particuliers, comme le travail ind\u00e9pendant ou le travail temporaire.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">L&#8217;<strong>Italie<\/strong> a sign\u00e9 plusieurs <strong>conventions bilat\u00e9rales en mati\u00e8re de s\u00e9curit\u00e9 sociale<\/strong> avec des \u00c9tats non membres de l&#8217;UE. Cependant, \u00e0 ce jour, seuls quelques pays ont sign\u00e9 des accords de ce type avec l&#8217;Italie.<\/p>&#13;\n&#13;\n<h2 id=\"h-conclusione-nbsp\" class=\"wp-block-heading\">Conclusion<\/h2>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Le r\u00f4le de la s\u00e9curit\u00e9 sociale en droit du travail est crucial, notamment dans le cadre des contrats de travail internationaux. Toutefois, son application peut s&#8217;av\u00e9rer complexe en raison des diff\u00e9rences de l\u00e9gislations nationales et d&#8217;accords internationaux. Il est essentiel que les employeurs et les salari\u00e9s comprennent les r\u00e8gles et proc\u00e9dures applicables \u00e0 leur situation particuli\u00e8re.
