Elle \u00e9tablit les r\u00e8gles permettant \u00e0 un \u00c9tat membre de reconna\u00eetre les qualifications professionnelles acquises dans un autre \u00c9tat membre de l\u2019Union europ\u00e9enne.<\/p>\n\n<p>L\u2019objectif principal de la directive est de faciliter l\u2019acc\u00e8s des travailleurs \u00e0 l\u2019exercice d\u2019une <strong>profession r\u00e9glement\u00e9e<\/strong> dans un \u00c9tat membre autre que celui dans lequel ils ont obtenu leurs qualifications. Elle vise \u00e0 leur permettre d\u2019exercer leur activit\u00e9 dans les m\u00eames conditions que celles applicables aux ressortissants de l\u2019\u00c9tat membre d\u2019accueil.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-overview-of-directive-2005-36-ec\"><strong>Aper\u00e7u de la directive 2005\/36\/CE<\/strong><\/h2>\n\n<p>Cette directive s\u2019inscrit dans le cadre plus large de l\u2019Union europ\u00e9enne relatif \u00e0 la <strong>libre circulation des personnes et des services<\/strong>. Elle a pour objectif de simplifier les r\u00e8gles de reconnaissance des qualifications professionnelles et d\u2019harmoniser les proc\u00e9dures entre les \u00c9tats membres, afin de faciliter la mobilit\u00e9 professionnelle et de lever les obstacles inutiles.<\/p>\n\n<p>Ses principaux objectifs sont les suivants:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Faciliter l\u2019acc\u00e8s des travailleurs aux professions r\u00e9glement\u00e9es dans les autres \u00c9tats membres de l\u2019UE;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Assurer la reconnaissance mutuelle des qualifications professionnelles;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>R\u00e9duire les obstacles administratifs \u00e0 la mobilit\u00e9 professionnelle;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Renforcer la coop\u00e9ration et la communication entre les autorit\u00e9s comp\u00e9tentes nationales responsables de la r\u00e9gulation professionnelle.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-scope-of-application\"><strong>Champ d\u2019application<\/strong><\/h2>\n\n<p>Conform\u00e9ment \u00e0 l\u2019Article 2, la directive s\u2019applique aux ressortissants d\u2019un \u00c9tat membre souhaitant exercer, en tant que <strong>salari\u00e9s ou travailleurs ind\u00e9pendants<\/strong>, une profession r\u00e9glement\u00e9e dans un autre \u00c9tat membre que celui o\u00f9 ils ont acquis leurs qualifications.<\/p>\n\n<p>Selon l\u2019article 3, on entend par <em><strong>\u00abprofession r\u00e9glement\u00e9e\u00bb<\/strong><\/em>\u00a0une activit\u00e9 pour laquelle l\u2019acc\u00e8s \u00e0 l\u2019emploi ou le droit d\u2019exercer est directement ou indirectement contr\u00f4l\u00e9 par la l\u00e9gislation nationale. En pratique, cela signifie que la personne doit poss\u00e9der certaines qualifications professionnelles pour exercer l\u00e9galement.<\/p>\n\n<p>La directive distingue deux modalit\u00e9s d\u2019exercice dans un autre \u00c9tat membre:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong data-start=\"2342\" data-end=\"2396\">Prestation de services temporaire et occasionnelle<\/strong>: conform\u00e9ment \u00e0 l\u2019article 5, applicable lorsqu\u2019un professionnel travaille dans un autre \u00c9tat membre pour une p\u00e9riode courte ou occasionnelle. Dans ce cas, la reconnaissance formelle des qualifications n\u2019est g\u00e9n\u00e9ralement pas exig\u00e9e. Toutefois, si la profession affecte directement la sant\u00e9 publique ou la s\u00e9curit\u00e9, l\u2019\u00c9tat membre d\u2019accueil peut effectuer un contr\u00f4le pr\u00e9alable des qualifications.<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong data-start=\"2864\" data-end=\"2900\">Exercice stable de la profession<\/strong>: applicable lorsqu\u2019un professionnel envisage de s\u2019installer durablement dans un autre \u00c9tat membre et d\u2019y travailler de fa\u00e7on continue. Dans ce cas, il est soumis aux proc\u00e9dures de reconnaissance pr\u00e9vues aux articles 10 et suivants.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-recognition-of-professional-qualifications\"><strong>Reconnaissance des qualifications professionnelles<\/strong><\/h2>\n\n<p>Afin de garantir la libre prestation de services au sein de l\u2019Union europ\u00e9enne, la directive pr\u00e9voit deux syst\u00e8mes principaux de reconnaissance des qualifications professionnelles:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>La reconnaissance automatique;<\/strong><\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>La reconnaissance g\u00e9n\u00e9rale.<\/strong><\/li>\n<\/ul>\n\n<p>Ces syst\u00e8mes permettent aux professionnels de se d\u00e9placer librement tout en maintenant des standards \u00e9lev\u00e9s de comp\u00e9tence et de s\u00e9curit\u00e9.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-automatic-recognition-system\"><strong>Syst\u00e8me de reconnaissance automatique<\/strong><\/h2>\n\n<p>Un \u00e9l\u00e9ment central de la directive est le syst\u00e8me de reconnaissance automatique, applicable \u00e0 certaines professions pour lesquelles l\u2019UE a d\u00e9j\u00e0 fix\u00e9 des <strong>exigences minimales de formation harmonis\u00e9es<\/strong>.<\/p>\n\n<p>Ces exigences sont d\u00e9finies dans la directive pour chaque profession et comprennent notamment:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>La dur\u00e9e minimale des \u00e9tudes;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Le niveau et le type de formation requis, incluant des \u00e9l\u00e9ments th\u00e9oriques et pratiques;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Les p\u00e9riodes obligatoires de stage ou d\u2019exp\u00e9rience professionnelle.<\/li>\n<\/ul>\n\n<p>Selon l\u2019article 21, les \u00c9tats membres doivent reconna\u00eetre automatiquement les qualifications r\u00e9pondant \u00e0 ces crit\u00e8res, notamment pour des professions ayant un impact direct sur <strong>la sant\u00e9 et la s\u00e9curit\u00e9 des citoyens<\/strong>.<\/p>\n\n<p>Exemples de ces professions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>M\u00e9decins;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Infirmiers responsables de soins g\u00e9n\u00e9raux;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Chirurgiens-dentistes;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>V\u00e9t\u00e9rinaires;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Pharmaciens;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Sages-femmes;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Architectes.<\/li>\n<\/ul>\n\n<p>Gr\u00e2ce \u00e0 ce m\u00e9canisme, ces professionnels peuvent exercer dans d\u2019autres \u00c9tats membres automatiquement, sans proc\u00e9dures suppl\u00e9mentaires.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-general-recognition-system\"><strong>Syst\u00e8me g\u00e9n\u00e9ral de reconnaissance<\/strong><\/h2>\n\n<p>Pour les professions non couvertes par le syst\u00e8me automatique, la directive pr\u00e9voit un syst\u00e8me g\u00e9n\u00e9ral de reconnaissance des qualifications professionnelles<\/p>\n\n<p>L\u2019article 11 d\u00e9finit les <em><strong>\u00abqualifications professionnelles\u00bb<\/strong><\/em> comme celles certifi\u00e9es par des dipl\u00f4mes, certificats de comp\u00e9tence et\/ou une exp\u00e9rience professionnelle pertinente. Les autorit\u00e9s comp\u00e9tentes consid\u00e8rent:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Formation th\u00e9orique, telle que des cours, dipl\u00f4mes ou titres;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Formation pratique ou p\u00e9riodes de stage;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Exp\u00e9rience professionnelle document\u00e9e.<\/li>\n<\/ul>\n\n<p>Dans ce syst\u00e8me, \u00e0 la fois <strong>les acquis acad\u00e9miques et l\u2019exp\u00e9rience pratique document\u00e9e<\/strong> sont pris en compte.<\/p>\n\n<p>L\u2019autorit\u00e9 comp\u00e9tente de l\u2019\u00c9tat membre d\u2019accueil \u00e9value la formation et l\u2019exp\u00e9rience du demandeur et les compare aux exigences d\u00e9finies pour cette profession dans la l\u00e9gislation nationale.<\/p>\n\n<p>Si des diff\u00e9rences significatives existent entre la formation re\u00e7ue et les exigences de l\u2019\u00c9tat membre d\u2019accueil, l\u2019autorit\u00e9 comp\u00e9tente peut imposer des <strong>mesures compensatoires<\/strong>.<\/p>\n\n<p>Conform\u00e9ment \u00e0 l\u2019article 14, ces mesures peuvent inclure:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Une p\u00e9riode d\u2019adaptation, pouvant aller jusqu\u2019\u00e0 trois ans, afin de combler les lacunes de formation;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Une \u00e9preuve d\u2019aptitude visant \u00e0 v\u00e9rifier les comp\u00e9tences professionnelles du demandeur.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-cooperation-between-national-authorities\"><strong>Coop\u00e9ration entre les autorit\u00e9s nationales<\/strong><\/h2>\n\n<p>L\u2019article 56 de la directive pr\u00e9voit une coop\u00e9ration \u00e9troite entre les autorit\u00e9s comp\u00e9tentes des \u00c9tats membres. Ils doivent <strong>partager en continu des informations<\/strong> concernant les qualifications professionnelles et le comportement professionnel.<\/p>\n\n<p>Cette coop\u00e9ration permet aux autorit\u00e9s de:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>V\u00e9rifier l\u2019authenticit\u00e9 des qualifications de formation;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Pr\u00e9venir les abus dans les proc\u00e9dures de reconnaissance;<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Garantir la transparence et la fiabilit\u00e9 des d\u00e9cisions de reconnaissance.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-exemptions-and-limitations\"><strong>Exceptions et limitations<\/strong><\/h2>\n\n<p>La directive pr\u00e9voit certaines exceptions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Elle ne s\u2019applique pas aux <strong>notaires nomm\u00e9s par acte officiel de l\u2019\u00c9tat<\/strong> (article 2, paragraphe 3);<\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Elle ne remplace pas les<strong> accords sp\u00e9cifiques entre \u00c9tats membres<\/strong> \u00e9tablissant des r\u00e8gles particuli\u00e8res pour certaines professions.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-implementation-of-the-directive-in-member-states\"><strong>Mise en \u0153uvre de la directive dans les \u00c9tats membres<\/strong><\/h2>\n\n<p>La directive 2005\/36\/CE a \u00e9t\u00e9 transpos\u00e9e dans le droit national de chaque \u00c9tat membre.<\/p>\n\n<p>En Italie, elle a \u00e9t\u00e9 mise en \u0153uvre par le <strong>d\u00e9cret l\u00e9gislatif n\u00b0 206 du 9 novembre 2007<\/strong>. Cette loi d\u00e9finit les proc\u00e9dures de reconnaissance des qualifications professionnelles obtenues dans d\u2019autres \u00c9tats membres de l\u2019UE. Elle identifie \u00e9galement les autorit\u00e9s comp\u00e9tentes charg\u00e9es de l\u2019\u00e9valuation, qui peuvent varier selon la profession.
