Dans ce guide, nous analyserons les responsabilit\u00e9s et les obligations d\u00e9coulant de cette directive.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-oggetto-e-applicabilita-della-direttiva-89-391-cee\">Objet et champ d&#8217;application de la Directive 89\/391\/CEE<\/h2>\n\n<p>Dans le cadre l\u00e9gislatif de l&#8217;UE, la Directive 89\/391\/CEE vise \u00e0 \u00e9tablir les principes pour am\u00e9liorer les mesures en faveur de la sant\u00e9 et de la s\u00e9curit\u00e9 au travail.<\/p>\n\n<p>Plus pr\u00e9cis\u00e9ment, la directive se concentre sur :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pr\u00e9vention des risques professionnels ;<\/li>\n\n\n\n<li>protection de la sant\u00e9 et de la s\u00e9curit\u00e9 ;<\/li>\n\n\n\n<li>\u00e9limination des facteurs de risque et d&#8217;accident ;<\/li>\n\n\n\n<li>informations relatives \u00e0 la sant\u00e9 et \u00e0 la s\u00e9curit\u00e9 sur le lieu de travail ;<\/li>\n\n\n\n<li>consultation et participation \u00e9quilibr\u00e9es ;<\/li>\n\n\n\n<li>formation des travailleurs et de leurs repr\u00e9sentants.<\/li>\n<\/ul>\n\n<p>La Directive s&#8217;applique \u00e0 tous les secteurs, tant publics que priv\u00e9s. Toutefois, certains secteurs sont exclus en raison de la nature de leurs activit\u00e9s, qui ne sont pas compatibles avec la l\u00e9gislation (par exemple, la police et l&#8217;arm\u00e9e).<\/p>\n\n<p>Les mesures pr\u00e9vues par la directive doivent toutefois respecter la l\u00e9gislation en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 des diff\u00e9rents \u00c9tats membres. Par cons\u00e9quent, si les dispositions nationales de transposition sont plus favorables, l&#8217;\u00c9tat membre peut appliquer sa l\u00e9gislation locale.<\/p>\n\n<p>Cette disposition fait r\u00e9f\u00e9rence \u00e0 une condition \u00e9galement pr\u00e9vue dans la <a href=\"https:\/\/arlettipartners.com\/fr\/directive-96-71-ce-conditions-de-travail-equitables-au-dela-des-frontieres-nationales\/\">Directive 96\/71\/CE<\/a> concernant les conditions plus favorables pour les travailleurs d\u00e9tach\u00e9s.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-responsabilita-del-datore-di-lavoro\">Responsabilit\u00e9s de l&#8217;employeur<\/h2>\n\n<p>L&#8217;employeur doit garantir la sant\u00e9 et la s\u00e9curit\u00e9 des travailleurs sur le lieu de travail. Cette obligation peut \u00eatre remplie gr\u00e2ce \u00e0 une structure interne ou \u00e0 une expertise externe. L&#8217;externalisation \u00e0 des tiers ne dispense pas l&#8217;employeur de ses obligations \u00e0 cet \u00e9gard.<\/p>\n\n<p>Afin de satisfaire ses obligations, l&#8217;employeur doit respecter les principes suivants :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>pr\u00e9venir les risques professionnels ;<\/li>\n\n\n\n<li>\u00e9valuer les risques qui ne peuvent pas \u00eatre \u00e9vit\u00e9s ;<\/li>\n\n\n\n<li>traiter les risques \u00e0 leur source ;<\/li>\n\n\n\n<li>adapter la t\u00e2che au travailleur afin de r\u00e9duire la monotonie et la r\u00e9p\u00e9titivit\u00e9 ;<\/li>\n\n\n\n<li>tenir compte des \u00e9volutions technologiques ;<\/li>\n\n\n\n<li>planifier des mesures de pr\u00e9vention ;<\/li>\n\n\n\n<li>donner la priorit\u00e9 \u00e0 la pr\u00e9vention collective ;<\/li>\n\n\n\n<li>donner les instructions appropri\u00e9es aux travailleurs.<\/li>\n<\/ul>\n\n<p>De plus, l&#8217;employeur doit mettre en \u0153uvre les mesures suivantes en fonction des activit\u00e9s de l&#8217;entreprise :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u00e9valuer les risques pour la sant\u00e9 et la s\u00e9curit\u00e9 des travailleurs, y compris ceux li\u00e9s \u00e0 l&#8217;\u00e9quipement, aux substances utilis\u00e9es et au lieu de travail ;<\/li>\n\n\n\n<li>\u00e9valuer le niveau de connaissances de la personne en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 avant d&#8217;attribuer une t\u00e2che ;<\/li>\n\n\n\n<li>planifier l&#8217;introduction de nouvelles techniques sur le lieu de travail en consultation avec les travailleurs et leurs repr\u00e9sentants ;<\/li>\n\n\n\n<li>mettre en \u0153uvre des mesures appropri\u00e9es pour emp\u00eacher les travailleurs non autoris\u00e9s d&#8217;acc\u00e9der aux zones \u00e0 haut risque ;<\/li>\n\n\n\n<li>mettre en place des mesures de premiers secours et de pr\u00e9vention des incendies ;<\/li>\n\n\n\n<li>tenir une liste des accidents qui rendent les travailleurs incapables de travailler pendant plus de trois jours ;<\/li>\n\n\n\n<li>r\u00e9diger des rapports sur les accidents.<\/li>\n<\/ul>\n\n<p>Dans le cas o\u00f9 des travailleurs d&#8217;entreprises tierces sont pr\u00e9sents sur les lieux, les employeurs doivent se consulter et se coordonner entre eux sur les mesures de sant\u00e9 et de s\u00e9curit\u00e9 mises en \u0153uvre.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-protezione-e-prevenzione\">Protection et pr\u00e9vention<\/h2>\n\n<p>En mati\u00e8re de protection et de pr\u00e9vention des risques professionnels, l&#8217;employeur doit d\u00e9signer un ou plusieurs travailleurs et\/ou services externes.<\/p>\n\n<p>Les personnes nomm\u00e9es doivent poss\u00e9der certaines caract\u00e9ristiques objectives :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>les comp\u00e9tences et les ressources n\u00e9cessaires pour r\u00e9aliser leur travail ;<\/li>\n\n\n\n<li>un nombre de personnes nomm\u00e9es proportionnel \u00e0 la dimension de l&#8217;entreprise.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-informazione-consultazione-e-partecipazione-dei-lavoratori\">Information, consultation et participation des travailleurs<\/h3>\n\n<p>L&#8217;employeur doit prendre toutes les mesures n\u00e9cessaires pour informer les travailleurs sur les risques professionnels, la protection et la pr\u00e9vention. En plus, les travailleurs doivent \u00eatre tenus au courant des mesures pertinentes mises en place.<\/p>\n\n<p>Parall\u00e8lement, les travailleurs et leurs repr\u00e9sentants doivent avoir la possibilit\u00e9 de participer aux questions relatives \u00e0 la sant\u00e9 et \u00e0 la s\u00e9curit\u00e9 au travail.<\/p>\n\n<p>Pour cette raison, les \u00e9l\u00e9ments suivants sont fondamentaux :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>consulter les travailleurs ;<\/li>\n\n\n\n<li>donner aux repr\u00e9sentants et\/ou aux travailleurs le droit de faire des propositions ;<\/li>\n\n\n\n<li>donner la possibilit\u00e9 de participer de mani\u00e8re \u00e9quilibr\u00e9e (conform\u00e9ment \u00e0 la l\u00e9gislation nationale).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-formazione-dei-lavoratori\">Formation des travailleurs<\/h2>\n\n<p>L&#8217;employeur doit s&#8217;assurer qu&#8217;une formation ad\u00e9quate en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 est dispens\u00e9e, sp\u00e9cifiquement pour le poste concern\u00e9. En particulier, une formation doit \u00eatre dispens\u00e9e :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>lors de l&#8217;embauche ;<\/li>\n\n\n\n<li>lors d&#8217;un changement ou d&#8217;une transition de fonctions ;<\/li>\n\n\n\n<li>lors de l&#8217;introduction ou du changement d&#8217;\u00e9quipement ;<\/li>\n\n\n\n<li>lors de l&#8217;introduction de nouvelles technologies. <\/li>\n<\/ul>\n\n<p>La formation des travailleurs doit \u00eatre continuellement adapt\u00e9e afin de t\u00e9moigner l&#8217;\u00e9volution ou l&#8217;\u00e9mergence de nouveaux risques. Elle doit \u00e9galement \u00eatre r\u00e9p\u00e9t\u00e9e au besoin.<\/p>\n\n<p>De plus, la formation doit toujours avoir lieu pendant les heures de travail.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-obblighi-dei-lavoratori\">Obligations des travailleurs<\/h2>\n\n<p>En vertu de la Directive 89\/391\/CEE, outre les responsabilit\u00e9s et obligations des employeurs, les travailleurs eux-m\u00eames ont des obligations en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 au travail.<\/p>\n\n<p>En fonction de leur formation, les travailleurs doivent \u00eatre attentifs \u00e0 leur propre sant\u00e9 et \u00e0 celle des personnes pouvant \u00eatre affect\u00e9es par leur travail.<\/p>\n\n<p>\u00c0 cet \u00e9gard, il est essentiel que les travailleurs :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>utilisent correctement les machines et les \u00e9quipements ;<\/li>\n\n\n\n<li>utilisent correctement les EPI (\u00e9quipements de protection individuelle) ;<\/li>\n\n\n\n<li>ne modifient pas et ne d\u00e9placent pas les dispositifs de s\u00e9curit\u00e9 des machines et des \u00e9quipements ;<\/li>\n\n\n\n<li>signalent \u00e0 l&#8217;employeur ou aux repr\u00e9sentants de la s\u00e9curit\u00e9 toute situation pouvant constituer un danger grave ou imm\u00e9diat ;<\/li>\n\n\n\n<li>contribuent \u00e0 rendre possible l&#8217;ex\u00e9cution des t\u00e2ches dans le respect de la r\u00e9glementation nationale en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 ;<\/li>\n\n\n\n<li>contribuent \u00e0 rendre possible l&#8217;ex\u00e9cution des activit\u00e9s professionnelles dans un environnement et des conditions sans risques pour la sant\u00e9 et la s\u00e9curit\u00e9.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-controllo-sanitario\">Contr\u00f4le sanitaire<\/h2>\n\n<p>Au-del\u00e0 des mesures relatives aux risques sur le lieu de travail, la Directive 89\/391\/CEE stipule que chaque \u00c9tat membre doit mettre en place une l\u00e9gislation et\/ou des pratiques nationales garantissant une surveillance ad\u00e9quate de la sant\u00e9 des travailleurs.<\/p>\n\n<p>Ce contr\u00f4le peut \u00eatre int\u00e9gr\u00e9 au syst\u00e8me national de sant\u00e9 ou effectu\u00e9 dans des \u00e9tablissements autoris\u00e9s.
