L\u2019un des principaux outils permettant d\u2019assurer la conformit\u00e9 et de favoriser la coop\u00e9ration avec les autorit\u00e9s du travail est l\u2019<strong data-start=\"457\" data-end=\"473\">accord local<\/strong> (<em data-start=\"475\" data-end=\"492\">Local Agreement<\/em>), un accord d\u2019entreprise local souvent pr\u00e9vu par les conventions collectives.<\/p>\n<hr data-start=\"572\" data-end=\"575\" \/>\n<h3 data-start=\"577\" data-end=\"610\">1. Accords locaux en Finlande<\/h3>\n<p data-start=\"612\" data-end=\"953\">Un <strong data-start=\"615\" data-end=\"631\">accord local<\/strong> est un arrangement \u00e9crit entre l\u2019employeur et les repr\u00e9sentants des salari\u00e9s, permettant une certaine flexibilit\u00e9 sur certains aspects de la convention collective (par exemple : horaires de travail et \u00e9quipes, cong\u00e9s, r\u00e9mun\u00e9ration), dans les limites fix\u00e9es par la loi ou par la convention collective nationale applicable.<\/p>\n<p data-start=\"955\" data-end=\"1364\">\u00c0 compter du <strong data-start=\"968\" data-end=\"988\">1er janvier 2025<\/strong>, tous les employeurs de l\u2019UE\/EEE d\u00e9tachant du personnel en Finlande peuvent n\u00e9gocier un accord local \u2014 m\u00eame s\u2019ils ne sont pas membres d\u2019associations patronales \u2014 sur les mati\u00e8res autoris\u00e9es par la convention collective nationale concern\u00e9e. Cette r\u00e9forme vise \u00e0 accro\u00eetre la flexibilit\u00e9 de la n\u00e9gociation locale afin d\u2019am\u00e9liorer l\u2019efficacit\u00e9 op\u00e9rationnelle et la productivit\u00e9.<\/p>\n<p data-start=\"1366\" data-end=\"1629\">La l\u00e9gislation r\u00e9form\u00e9e garantit \u00e9galement que les droits \u00e0 la n\u00e9gociation locale soient accessibles \u00e0 toutes les entreprises, ind\u00e9pendamment de leur adh\u00e9sion \u00e0 une organisation patronale ou de la pr\u00e9sence d\u2019une repr\u00e9sentation des salari\u00e9s sur le lieu de travail.<\/p>\n<p data-start=\"1631\" data-end=\"1746\">Une fois conclu, l\u2019accord local doit \u00eatre transmis \u00e0 l\u2019<strong data-start=\"1686\" data-end=\"1745\">Autorit\u00e9 de la s\u00e9curit\u00e9 et de la sant\u00e9 au travail (OSH)<\/strong>.<\/p>\n<h4 data-start=\"1748\" data-end=\"1823\">1.1 Obligations des entreprises d\u00e9tachant des travailleurs en Finlande<\/h4>\n<p data-start=\"1825\" data-end=\"2007\">Pendant la p\u00e9riode de travail en Finlande, les employeurs doivent respecter les obligations suivantes pr\u00e9vues par la l\u00e9gislation finlandaise du travail et de la s\u00e9curit\u00e9 au travail :<\/p>\n<p data-start=\"2009\" data-end=\"2083\"><strong data-start=\"2009\" data-end=\"2081\">\u00c9tablir et conserver par \u00e9crit pendant toute la dur\u00e9e du d\u00e9tachement<\/strong> :<\/p>\n<ul data-start=\"2084\" data-end=\"2454\">\n<li data-start=\"2084\" data-end=\"2197\">\n<p data-start=\"2086\" data-end=\"2197\">les informations relatives \u00e0 l\u2019entreprise de d\u00e9tachement et aux personnes responsables dans le pays d\u2019origine ;<\/p>\n<\/li>\n<li data-start=\"2198\" data-end=\"2256\">\n<p data-start=\"2200\" data-end=\"2256\">les donn\u00e9es d\u2019identification des travailleurs d\u00e9tach\u00e9s ;<\/p>\n<\/li>\n<li data-start=\"2257\" data-end=\"2324\">\n<p data-start=\"2259\" data-end=\"2324\">les conditions de travail applicables aux travailleurs d\u00e9tach\u00e9s ;<\/p>\n<\/li>\n<li data-start=\"2325\" data-end=\"2454\">\n<p data-start=\"2327\" data-end=\"2454\">les relev\u00e9s du temps de travail, les bulletins de salaire et la preuve du paiement des salaires par un \u00e9tablissement financier.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2456\" data-end=\"2470\"><strong data-start=\"2456\" data-end=\"2468\">Garantir<\/strong> :<\/p>\n<ul data-start=\"2471\" data-end=\"2808\">\n<li data-start=\"2471\" data-end=\"2535\">\n<p data-start=\"2473\" data-end=\"2535\">l\u2019organisation des services obligatoires de sant\u00e9 au travail ;<\/p>\n<\/li>\n<li data-start=\"2536\" data-end=\"2606\">\n<p data-start=\"2538\" data-end=\"2606\">une assurance accidents valide pour tous les travailleurs d\u00e9tach\u00e9s ;<\/p>\n<\/li>\n<li data-start=\"2607\" data-end=\"2666\">\n<p data-start=\"2609\" data-end=\"2666\">le respect des mesures g\u00e9n\u00e9rales de s\u00e9curit\u00e9 au travail ;<\/p>\n<\/li>\n<li data-start=\"2667\" data-end=\"2808\">\n<p data-start=\"2669\" data-end=\"2808\">la demande du num\u00e9ro fiscal et de la carte Valtti pour les salari\u00e9s travaillant dans le secteur de la construction et les chantiers navals.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"2810\" data-end=\"2864\"><strong data-start=\"2810\" data-end=\"2862\">Avec le consentement du salari\u00e9 d\u00e9tach\u00e9, fournir<\/strong> :<\/p>\n<ul data-start=\"2865\" data-end=\"3263\">\n<li data-start=\"2865\" data-end=\"2946\">\n<p data-start=\"2867\" data-end=\"2946\">des informations sur les conditions de travail aux repr\u00e9sentants des salari\u00e9s ;<\/p>\n<\/li>\n<li data-start=\"2947\" data-end=\"3105\">\n<p data-start=\"2949\" data-end=\"3105\">une copie de l\u2019accord local \u00e0 l\u2019autorit\u00e9 OSH (s\u2019il repose sur une convention collective d\u2019application g\u00e9n\u00e9rale) dans un d\u00e9lai d\u2019un mois apr\u00e8s sa signature ;<\/p>\n<\/li>\n<li data-start=\"3106\" data-end=\"3263\">\n<p data-start=\"3108\" data-end=\"3263\">un rapport au donneur d\u2019ordre, pendant l\u2019ex\u00e9cution des travaux, sur le statut de s\u00e9curit\u00e9 sociale des sous-traitants et travailleurs int\u00e9rimaires d\u00e9tach\u00e9s.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3265\" data-end=\"3455\">Enfin, l\u2019entreprise de d\u00e9tachement doit demander un <strong data-start=\"3317\" data-end=\"3343\">certificat portable A1<\/strong>, attestant que les travailleurs d\u00e9tach\u00e9s restent soumis \u00e0 la l\u00e9gislation de s\u00e9curit\u00e9 sociale du pays d\u2019origine.<\/p>\n<h4 data-start=\"3457\" data-end=\"3540\">1.2 Informations \u00e0 transmettre \u00e0 l\u2019autorit\u00e9 de s\u00e9curit\u00e9 et de sant\u00e9 au travail<\/h4>\n<p data-start=\"3542\" data-end=\"3754\">L\u2019accord local doit \u00eatre soumis par \u00e9crit \u00e0 l\u2019autorit\u00e9 OSH dans un d\u00e9lai d\u2019un mois suivant sa conclusion. Le service comp\u00e9tent est d\u00e9termin\u00e9 en fonction de l\u2019emplacement du chantier o\u00f9 les salari\u00e9s sont d\u00e9tach\u00e9s.<\/p>\n<p data-start=\"3756\" data-end=\"4061\">L\u2019accord peut \u00eatre transmis via la plateforme \u00e9lectronique mise \u00e0 disposition par l\u2019OSH. Si la transmission \u00e9lectronique n\u2019est pas possible, les documents peuvent \u00eatre envoy\u00e9s sous format papier \u00e0 l\u2019autorit\u00e9 r\u00e9gionale OSH ou \u00e0 la division S\u00e9curit\u00e9 et sant\u00e9 au travail de l\u2019Agence administrative r\u00e9gionale.<\/p>\n<p data-start=\"4063\" data-end=\"4119\">Les informations \u00e0 fournir \u00e0 l\u2019autorit\u00e9 sont notamment :<\/p>\n<ul data-start=\"4120\" data-end=\"4669\">\n<li data-start=\"4120\" data-end=\"4156\">\n<p data-start=\"4122\" data-end=\"4156\">les informations sur l\u2019employeur ;<\/p>\n<\/li>\n<li data-start=\"4157\" data-end=\"4205\">\n<p data-start=\"4159\" data-end=\"4205\">les donn\u00e9es de la partie soumettant l\u2019accord ;<\/p>\n<\/li>\n<li data-start=\"4206\" data-end=\"4248\">\n<p data-start=\"4208\" data-end=\"4248\">la personne de contact (si diff\u00e9rente) ;<\/p>\n<\/li>\n<li data-start=\"4249\" data-end=\"4282\">\n<p data-start=\"4251\" data-end=\"4282\">les d\u00e9tails de l\u2019accord local ;<\/p>\n<\/li>\n<li data-start=\"4283\" data-end=\"4320\">\n<p data-start=\"4285\" data-end=\"4320\">la date de conclusion de l\u2019accord ;<\/p>\n<\/li>\n<li data-start=\"4321\" data-end=\"4365\">\n<p data-start=\"4323\" data-end=\"4365\">les dates de d\u00e9but et de fin de l\u2019accord ;<\/p>\n<\/li>\n<li data-start=\"4366\" data-end=\"4494\">\n<p data-start=\"4368\" data-end=\"4494\">la r\u00e9f\u00e9rence \u00e0 la convention collective concern\u00e9e, y compris, le cas \u00e9ch\u00e9ant, la disposition sur laquelle l\u2019accord est fond\u00e9 ;<\/p>\n<\/li>\n<li data-start=\"4495\" data-end=\"4669\">\n<p data-start=\"4497\" data-end=\"4669\">le repr\u00e9sentant du personnel ou la partie avec laquelle l\u2019accord a \u00e9t\u00e9 conclu (repr\u00e9sentant syndical, repr\u00e9sentant \u00e9lu ou autre partie pr\u00e9vue par la convention collective).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"4671\" data-end=\"4830\">Le non-respect de ces obligations peut entra\u00eener des <strong data-start=\"4724\" data-end=\"4778\">amendes administratives allant de 1 000 \u00e0 10 000 \u20ac<\/strong>, pouvant atteindre <strong data-start=\"4798\" data-end=\"4810\">15 000 \u20ac<\/strong> en cas de r\u00e9cidive.<\/p>\n<hr data-start=\"4832\" data-end=\"4835\" \/>\n<h3 data-start=\"4837\" data-end=\"4867\">2. Accords locaux en Su\u00e8de<\/h3>\n<p data-start=\"4869\" data-end=\"5138\">En Su\u00e8de, les conventions collectives (<em data-start=\"4908\" data-end=\"4924\">Kollektivavtal<\/em>) occupent une place centrale. Le \u00ab mod\u00e8le su\u00e9dois \u00bb repose sur la n\u00e9gociation entre syndicats et employeurs, avec une forte participation des salari\u00e9s, garantissant \u00e0 la fois flexibilit\u00e9 et adaptation sectorielle.<\/p>\n<p data-start=\"5140\" data-end=\"5308\">Les entreprises \u00e9trang\u00e8res d\u00e9tachant des travailleurs en Su\u00e8de peuvent \u00e9galement conclure des <strong data-start=\"5234\" data-end=\"5266\">accords locaux contraignants<\/strong> avec des repr\u00e9sentants syndicaux su\u00e9dois.<\/p>\n<p data-start=\"5310\" data-end=\"5668\">Par exemple, dans le secteur de la m\u00e9tallurgie et de la technologie, les employeurs \u00e9trangers peuvent conclure des accords locaux avec <strong data-start=\"5445\" data-end=\"5458\">IF Metall<\/strong>, principal syndicat du secteur. Ces accords permettent de n\u00e9gocier des conditions au niveau de l\u2019entreprise, \u00e0 condition qu\u2019elles ne soient pas moins favorables que celles pr\u00e9vues par la convention collective.<\/p>\n<p data-start=\"5670\" data-end=\"5731\">L\u2019accord est valable uniquement pour la dur\u00e9e du d\u00e9tachement.<\/p>\n<h4 data-start=\"5733\" data-end=\"5804\">2.1 Obligations des employeurs d\u00e9tachant des travailleurs en Su\u00e8de<\/h4>\n<p data-start=\"5806\" data-end=\"5884\">Les entreprises \u00e9trang\u00e8res d\u00e9tachant des salari\u00e9s en Su\u00e8de doivent notamment :<\/p>\n<ul data-start=\"5885\" data-end=\"6570\">\n<li data-start=\"5885\" data-end=\"6006\">\n<p data-start=\"5887\" data-end=\"6006\">notifier le d\u00e9tachement et d\u00e9signer une personne de contact capable de fournir des informations aux autorit\u00e9s locales ;<\/p>\n<\/li>\n<li data-start=\"6007\" data-end=\"6225\">\n<p data-start=\"6009\" data-end=\"6055\">respecter la l\u00e9gislation su\u00e9doise relative \u00e0 :<\/p>\n<ul data-start=\"6058\" data-end=\"6225\">\n<li data-start=\"6058\" data-end=\"6095\">\n<p data-start=\"6060\" data-end=\"6095\">la sant\u00e9 et la s\u00e9curit\u00e9 au travail,<\/p>\n<\/li>\n<li data-start=\"6098\" data-end=\"6149\">\n<p data-start=\"6100\" data-end=\"6149\">l\u2019\u00e9galit\u00e9 de traitement et la non-discrimination,<\/p>\n<\/li>\n<li data-start=\"6152\" data-end=\"6225\">\n<p data-start=\"6154\" data-end=\"6225\">le temps de travail, les cong\u00e9s, le cong\u00e9 parental et la r\u00e9mun\u00e9ration ;<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"6226\" data-end=\"6481\">\n<p data-start=\"6228\" data-end=\"6288\">\u00e9tablir et conserver pendant toute la dur\u00e9e du d\u00e9tachement :<\/p>\n<ul data-start=\"6291\" data-end=\"6481\">\n<li data-start=\"6291\" data-end=\"6336\">\n<p data-start=\"6293\" data-end=\"6336\">l\u2019identification des travailleurs d\u00e9tach\u00e9s,<\/p>\n<\/li>\n<li data-start=\"6339\" data-end=\"6379\">\n<p data-start=\"6341\" data-end=\"6379\">les conditions de travail applicables,<\/p>\n<\/li>\n<li data-start=\"6382\" data-end=\"6481\">\n<p data-start=\"6384\" data-end=\"6481\">les relev\u00e9s du temps de travail, les bulletins de salaire et la preuve du paiement des salaires ;<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li data-start=\"6482\" data-end=\"6570\">\n<p data-start=\"6484\" data-end=\"6570\">pour les chantiers de construction, demander une <strong data-start=\"6533\" data-end=\"6547\">carte ID06<\/strong> pour les travailleurs.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"6572\" data-end=\"6654\">2.2 Informations \u00e0 inclure dans l\u2019accord local pour les d\u00e9tachements en Su\u00e8de<\/h4>\n<p data-start=\"6656\" data-end=\"6974\">Les employeurs d\u00e9tachant des salari\u00e9s en Su\u00e8de dans le cadre d\u2019une prestation de services internationale peuvent signer des conventions collectives avec une organisation repr\u00e9sentative des travailleurs su\u00e9doise ou adh\u00e9rer \u00e0 une organisation patronale su\u00e9doise et \u00eatre ainsi li\u00e9s par une convention collective su\u00e9doise.<\/p>\n<p data-start=\"6976\" data-end=\"7178\">Les organisations repr\u00e9sentatives des travailleurs disposent du droit de recourir \u00e0 des actions collectives afin d\u2019inciter les employeurs d\u00e9tachant des travailleurs \u00e0 signer des conventions collectives.<\/p>\n<p data-start=\"7180\" data-end=\"7317\">De nombreux syndicats proposent des mod\u00e8les sp\u00e9cifiques pour les travailleurs d\u00e9tach\u00e9s.
