Ceux-ci servent de pr\u00e9misse aux modifications apport\u00e9es \u00e0 la directive.<\/p>\n\n<p>Tout d&#8217;abord, l&#8217;importance des principes fondateurs du march\u00e9 int\u00e9rieur, tels que la libre circulation des travailleurs et la libre prestation de services, consacr\u00e9s par l&#8217;article 56 du <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/HTML\/?uri=CELEX:12016E\/TXT\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">Trait\u00e9 sur le Fonctionnement de l&#8217;Union Europ\u00e9enne<\/span><\/a>, est rappel\u00e9e. Ces principes, d\u00e9j\u00e0 pr\u00e9sents dans la <a href=\"https:\/\/arlettipartners.com\/directive-96-71-ce-conditions-de-travail-equitables-au-dela-des-frontieres-nationales\/?lang=fr\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">Directive 96\/71\/CE<\/span><\/a>, sont essentiels pour promouvoir le respect des droits des travailleurs, la justice et la protection sociale.<\/p>\n\n<p>\u00c0 cet \u00e9gard, une attention particuli\u00e8re est accord\u00e9e aux <strong>travailleurs d\u00e9tach\u00e9s<\/strong>. Ces derniers sont ceux qui sont <strong>envoy\u00e9s de leur lieu de travail habituel vers un autre \u00c9tat membre d&#8217;accueil dans le cadre d&#8217;un d\u00e9tachement transnational<\/strong>. Ils sont employ\u00e9s pour une p\u00e9riode limit\u00e9e, g\u00e9n\u00e9ralement <strong>inf\u00e9rieure \u00e0 12 mois<\/strong>. Pendant toute la dur\u00e9e du d\u00e9tachement, les travailleurs <strong>restent employ\u00e9s par leur employeur<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>En savoir plus sur le <a href=\"https:\/\/arlettipartners.com\/detachement-de-travailleurs-dans-lue\/?lang=fr\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">d\u00e9tachement de travailleurs dans l&#8217;UE<\/span><\/a>.<\/p>\n<\/blockquote>\n\n<p>Toutefois, la Directive 96\/71\/CE ne suffit pas \u00e0 elle seule \u00e0 promouvoir des conditions de concurrence \u00e9quitables entre les diff\u00e9rentes cat\u00e9gories de travailleurs dans l&#8217;Union Europ\u00e9enne. D\u00e8s mai 2014, la <a href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">Directive 2014\/67\/UE<\/span><\/a> a \u00e9t\u00e9 utilis\u00e9e pour promouvoir la <strong>mise en \u0153uvre de la Directive 96\/71\/CE<\/strong> et le partage uniforme d&#8217;informations.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-gli-obiettivi-della-direttiva-ue-2018-957\">Les objectifs de la Directive 2018\/957 de l&#8217;UE<\/h2>\n\n<p>En juin 2018,<strong> la Directive europ\u00e9enne 2018\/957 modifie les dispositions de la Directive 96\/71\/CE<\/strong>. Notamment :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Elle met l&#8217;accent sur la n\u00e9cessit\u00e9 de <strong>conditions minimales de sant\u00e9 et de s\u00e9curit\u00e9<\/strong>, ainsi que de <strong>salaires<\/strong>, pour les travailleurs d\u00e9tach\u00e9s. L&#8217;objectif ultime est d&#8217;<strong>\u00e9liminer toute discrimination<\/strong> entre les travailleurs ;<\/li>\n\n\n\n<li>Elle rappelle l&#8217;importance d&#8217;offrir des <strong>protections suppl\u00e9mentaires dans le cas de d\u00e9tachements de plus de 12 mois<\/strong>. Dans ce cas, les conditions de travail applicables sont les conditions <strong>les plus favorables<\/strong> pour les travailleurs d\u00e9tach\u00e9s.<\/li>\n<\/ul>\n\n<p>De m\u00eame, l&#8217;application des r\u00e8glements suivants du Parlement Europ\u00e9en et du Conseil ne doit pas \u00eatre affect\u00e9e : <\/p>\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\">R\u00e8glement (CE) n\u00b0 883\/2004<\/span><\/a> sur la coordination des syst\u00e8mes de s\u00e9curit\u00e9 sociale.<\/li>\n\n\n\n<li>R\u00e8glement (CE) n\u00b0 987\/2009 portant modalit\u00e9s d&#8217;application du r\u00e8glement (CE) n\u00b0 883\/2004.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-corpo-della-normativa-modifiche-alla-direttiva-96-71-ce\">Corpus l\u00e9gislatif : modifications de la Directive 96\/71\/CE<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-art-1-ambito-di-applicazione\">Article 1 : Champ d&#8217;application<\/h3>\n\n<p>Tout d&#8217;abord, la Directive 2018\/957 pr\u00e9cise le champ et les modalit\u00e9s d&#8217;application de la Directive de 1996. En effet, la <strong>protection des travailleurs d\u00e9tach\u00e9s<\/strong> est garantie et des co<strong>nditions de sant\u00e9 et de s\u00e9curit\u00e9 obligatoires<\/strong> sont fix\u00e9es. Il est \u00e9galement rappel\u00e9 que la Directive 96\/71 n&#8217;affecte pas l&#8217;exercice des principaux droits des travailleurs. Cela s&#8217;applique tant au niveau de la l\u00e9gislation communautaire qu&#8217;au niveau de la l\u00e9gislation nationale des \u00c9tats membres.<\/p>\n\n<p>Deuxi\u00e8mement, des orientations sont donn\u00e9es sur le d\u00e9tachement des travailleurs temporaires. \u00c0 titre d&#8217;exemple, l&#8217;entreprise utilisatrice doit <strong>informer l&#8217;entreprise de travail int\u00e9rimaire du d\u00e9tachement d&#8217;un travailleur avant le d\u00e9but du chantier \u00e0 l&#8217;\u00e9tranger<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-art-3-parita-di-trattamento-e-disposizioni-per-distacchi-di-lunga-durata\">Art. 3 : \u00c9galit\u00e9 de traitement et dispositions relatives aux d\u00e9tachements de longue dur\u00e9e<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-parita-di-trattamento\">\u00c9galit\u00e9 de traitement<\/h4>\n\n<p>Modifiant l&#8217;art. 3 de la Directive 96\/71, la Directive 2018\/957 d\u00e9finit les <strong>aspects sur lesquels les \u00c9tats membres doivent assurer l&#8217;\u00e9galit\u00e9 de traitement<\/strong> des travailleurs d\u00e9tach\u00e9s sur leur territoire. Parmi les sujets list\u00e9s, on trouve :<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<ul class=\"wp-block-list\">\n<li>les p\u00e9riodes maximales de travail et les p\u00e9riodes minimales de repos; <\/li>\n\n\n\n<li>la dur\u00e9e minimale du cong\u00e9 annuel pay\u00e9;<\/li>\n\n\n\n<li>la r\u00e9mun\u00e9ration, y compris les heures suppl\u00e9mentaires; cette lettre ne s&#8217;applique pas aux r\u00e9gimes compl\u00e9mentaires de retraite professionnelle;<\/li>\n\n\n\n<li>les conditions de mise \u00e0 disposition des travailleurs, notamment par les agences de travail int\u00e9rimaire;<\/li>\n\n\n\n<li>la s\u00e9curit\u00e9, la sant\u00e9 et l&#8217;hygi\u00e8ne au travail;<\/li>\n\n\n\n<li>des mesures de protection concernant les conditions de travail et d&#8217;emploi des femmes enceintes ou venant d&#8217;accoucher, des enfants et des jeunes;  <\/li>\n\n\n\n<li>l&#8217;\u00e9galit\u00e9 de traitement entre les hommes et les femmes, ainsi que d&#8217;autres dispositions relatives \u00e0 la non-discrimination;  <\/li>\n\n\n\n<li>les conditions d&#8217;h\u00e9bergement des travailleurs lorsque celui-ci est fourni par l&#8217;employeur \u00e0 des travailleurs \u00e9loign\u00e9s de leur lieu de travail habituel;<\/li>\n\n\n\n<li>l&#8217;allocation ou le remboursement des frais de voyage, de pension et d&#8217;h\u00e9bergement des travailleurs absents de leur domicile pour des raisons professionnelles.<\/li>\n<\/ul>\n<\/blockquote>\n\n<p>En plus de la Directive 96\/71, il est stipul\u00e9 que les \u00c9tats membres doivent <strong>publier des informations sur les conditions de travail de mani\u00e8re transparente et en temps opportun<\/strong>. Ces informations doivent \u00eatre publi\u00e9es sur le seul site internet national officiel, conform\u00e9ment \u00e0 l&#8217;<strong>article 5 de la Directive 2014\/67\/UE<\/strong>. Le non-respect de cette obligation de transparence est d\u00e9terminant pour l&#8217;application de sanctions en cas de violation des lois transposant la Directive 96\/71\/CE.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-estensione-dei-contratti-collettivi\">Extension des conventions collectives<\/h4>\n\n<p>La directive 2018\/957 d\u00e9cr\u00e8te \u00e9galement, en tant que modification de la Directive de 1996, une <strong>extension du concept de &#8220;convention collective&#8221; \u00e0 toutes les cat\u00e9gories de travailleurs<\/strong>. Auparavant, cela ne s&#8217;appliquait qu&#8217;aux activit\u00e9s du secteur de la construction. Tous les sujets mentionn\u00e9s dans la liste ci-dessus, en effet, doivent \u00eatre \u00e9tablis non seulement par des r\u00e8glements, des l\u00e9gislations et des dispositions administratives, mais aussi par des conventions collectives, qui doivent d\u00e9sormais \u00eatre respect\u00e9es et applicables \u00e0 toute cat\u00e9gorie professionnelle.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-disposizioni-per-distacchi-di-lunga-durata\">Provisions pour d\u00e9tachements de longue dur\u00e9e<\/h4>\n\n<p>L&#8217;article 3 de la Directive 96\/71 a \u00e9galement \u00e9t\u00e9 modifi\u00e9 pour clarifier les sp\u00e9cifications \u00e0 suivre en cas de d\u00e9tachement de plus de 12 mois. Dans ce cas, les personnes d\u00e9tach\u00e9es doivent se voir garantir les <strong>conditions d&#8217;emploi applicables dans l&#8217;\u00c9tat membre<\/strong> d&#8217;emploi.<\/p>\n\n<p>Il est \u00e9galement possible pour une entreprise de d\u00e9tachement de remplacer un travailleur d\u00e9tach\u00e9 par un autre pour effectuer les m\u00eames t\u00e2ches sur le m\u00eame site. Dans ce cas, la dur\u00e9e totale du d\u00e9tachement est la somme de la dur\u00e9e du d\u00e9tachement du travailleur remplac\u00e9 et de la dur\u00e9e du d\u00e9tachement du travailleur qui le remplace.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-artt-4-e-5-cooperazione-per-l-implementazione-della-normativa\">Articles 4 et 5 : Coop\u00e9ration dans la mise en \u0153uvre de la l\u00e9gislation<\/h3>\n\n<p>Pour une meilleure protection des conditions de travail susmentionn\u00e9es, l&#8217;article 4 de la Directive 96\/71 est modifi\u00e9 en faveur d&#8217;une <strong>coop\u00e9ration plus \u00e9troite entre les autorit\u00e9s, les administrations et les organismes de contr\u00f4le<\/strong>. Cette coop\u00e9ration doit prendre la forme d&#8217;une r\u00e9ponse rapide aux demandes et aux questions concernant les d\u00e9tachements non authentiques ou la mise \u00e0 disposition de travailleurs temporaires. La n\u00e9cessit\u00e9 d&#8217;une coop\u00e9ration plus efficace est \u00e9galement soulign\u00e9e dans l&#8217;amendement de l&#8217;article 5. Concr\u00e8tement, <strong>tant le pays d&#8217;accueil que le pays o\u00f9 le travailleur d\u00e9tach\u00e9 est recrut\u00e9 doivent contr\u00f4ler l&#8217;application de la directive 96\/71<\/strong> et de ses lois nationales de transposition. En cas de violation, des sanctions proportionn\u00e9es \u00e0 la nature de l&#8217;infraction sont pr\u00e9vues.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-conclusioni\">Conclusions<\/h2>\n\n<p>En r\u00e9sum\u00e9, la Directive 2018\/957 promeut une fois de plus, dans le cadre de la l\u00e9gislation europ\u00e9enne, moins d&#8217;incertitude et plus de transparence dans la communication des conditions d&#8217;emploi et l&#8217;acc\u00e8s \u00e0 l&#8217;information.
