Ces lois constituent la transposition nationale de la <a href=\"https:\/\/arlettipartners.com\/directive-96-71-ce-conditions-de-travail-equitables-au-dela-des-frontieres-nationales\/?lang=fr\">Directive 96\/71\/CE concernant le d\u00e9tachement des travailleurs<\/a>.<\/p>\n\n\n\n<p>Le but de ces lois est de renforcer les droits des travailleurs d\u00e9tach\u00e9s et de lutter contre le dumping social, c\u2019est-\u00e0-dire contrer la tendance des entreprises \u00e0 exploiter les diff\u00e9rences dans les conditions de travail et de salaire pour obtenir des avantages concurrentiels.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><em>Pour plus d&#8217;informations sur la l\u00e9gislation, lisez notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">directives de l&#8217;UE concernant le d\u00e9tachement des travailleurs<\/a>.<\/em><\/p>\n<\/blockquote>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-obligations-de-l-employeur-detachant-et-du-destinataire-du-service-en-suede\">Obligations de l&#8217;employeur d\u00e9tachant et du destinataire du service en Su\u00e8de<\/h3>\n\n\n\n<p>L&#8217;employeur qui d\u00e9tache des travailleurs en Su\u00e8de et le destinataire du service doivent remplir une s\u00e9rie d&#8217;<strong>obligations<\/strong>.<\/p>\n\n\n\n<p>Ces exigences peuvent \u00eatre r\u00e9sum\u00e9es comme suit :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Pour l&#8217;employeur, obligation de <strong>notifier le d\u00e9tachement<\/strong> \u00e0 l&#8217;Autorit\u00e9 su\u00e9doise via le <a href=\"https:\/\/www.av.se\/en\/report-a-posting\">portail<\/a> en ligne d\u00e9di\u00e9.<\/li>\n\n\n\n<li>Pour l&#8217;employeur, obligation de <strong>d\u00e9signer un contact<\/strong> domicili\u00e9 en Su\u00e8de pendant toute la dur\u00e9e du d\u00e9tachement. Ce contact doit fournir aux autorit\u00e9s les documents prouvant la conformit\u00e9 du chantier.<\/li>\n\n\n\n<li>Pour le destinataire du service, obligation de <strong>conserver une copie de la documentation<\/strong> attestant la notification correcte du d\u00e9tachement, qui doit \u00eatre signal\u00e9e \u00e0 l&#8217;Autorit\u00e9 su\u00e9doise.<\/li>\n<\/ul>\n\n\n\n<p>L&#8217;employeur ou le destinataire du service non conforme peut \u00eatre soumis \u00e0 une amende de 20.000 SEK.<\/p>\n\n\n\n<p>En plus des obligations \u00e9num\u00e9r\u00e9es ici, chaque pays de l&#8217;UE ou de l&#8217;EEE peut imposer des obligations suppl\u00e9mentaires. Dans le cas de la Su\u00e8de, <strong>depuis le 1er janvier 2016<\/strong>, la loi impose l&#8217;utilisation d&#8217;un registre \u00e9lectronique pour le personnel impliqu\u00e9 dans un chantier.<\/p>\n\n\n\n<p>Le syst\u00e8me adopt\u00e9 pour respecter cette obligation l\u00e9gale est le <strong>Syst\u00e8me ID06<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-le-systeme-id06\">Le Syst\u00e8me ID06<\/h2>\n\n\n\n<p>Ce syst\u00e8me a pour objectif d&#8217;accro\u00eetre la s\u00e9curit\u00e9 au travail, conform\u00e9ment aux obligations l\u00e9gales nationales. Il s&#8217;agit d&#8217;une solution num\u00e9rique qui comprend la d\u00e9livrance d&#8217;une <strong>carte ID06<\/strong>. La carte offre aux entreprises une gamme d&#8217;outils pour valider l&#8217;identit\u00e9 du personnel et garantir le lien entre l&#8217;employeur et le travailleur.<\/p>\n\n\n\n<p>Les <strong>principales fonctionnalit\u00e9s<\/strong> du Syst\u00e8me ID06 sont les suivantes :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Enregistrement du personnel<\/strong> impliqu\u00e9 dans le chantier (travailleurs, entrepreneurs, sous-traitants) dans un registre \u00e9lectronique.<\/li>\n\n\n\n<li><strong>Num\u00e9risation et archivage de certains documents<\/strong> des travailleurs, tels que certificats et dipl\u00f4mes.<\/li>\n\n\n\n<li><strong>Autorisation d&#8217;entr\u00e9e<\/strong> des employ\u00e9s sur le chantier. Elle est \u00e0 usage exclusif du titulaire et permet d&#8217;enregistrer la pr\u00e9sence de ce dernier sur le lieu de travail. Elle est donc dot\u00e9e d&#8217;un haut niveau de s\u00e9curit\u00e9 et de protection de l&#8217;identit\u00e9. L&#8217;identit\u00e9 doit \u00eatre valid\u00e9e via la cr\u00e9ation d&#8217;un compte sur le portail ID06.<\/p>\n\n\n\n<p>Les <strong>\u00e9tapes pour obtenir et valider la carte ID06<\/strong> pour les entreprises \u00e9trang\u00e8res qui d\u00e9tachent des travailleurs en Su\u00e8de sont les suivantes :<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-ouverture-d-une-position-fiscale-en-suede\">Ouverture d&#8217;une position fiscale en Su\u00e8de<\/h3>\n\n\n\n<p>Pour les entreprises \u00e9trang\u00e8res qui souhaitent demander les cartes ID06, il est d&#8217;abord n\u00e9cessaire d&#8217;ouvrir une position fiscale (F-Tax) en Su\u00e8de.<\/p>\n\n\n\n<p>Cela permet de respecter les obligations de d\u00e9claration fiscale. La position fiscale doit \u00eatre ajout\u00e9e dans le compte ID06 de l&#8217;entreprise dans un d\u00e9lai d&#8217;un mois apr\u00e8s sa cr\u00e9ation. Sinon, les cartes ID06 des employ\u00e9s perdront leur validit\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-enregistrement-de-l-entreprise-requerante\">Enregistrement de l&#8217;entreprise requ\u00e9rante<\/h3>\n\n\n\n<p>L&#8217;enregistrement sur le site ID06 peut \u00eatre effectu\u00e9 par des entreprises su\u00e9doises ou \u00e9trang\u00e8res, \u00e0 condition qu&#8217;elles remplissent les obligations l\u00e9gales n\u00e9cessaires pour travailler en Su\u00e8de.<\/p>\n\n\n\n<p>L&#8217;authentification du repr\u00e9sentant d&#8217;une entreprise su\u00e9doise se fait via un <strong>document d&#8217;identit\u00e9 \u00e9lectronique<\/strong> (eID su\u00e9dois).<\/p>\n\n\n\n<p>En revanche, le repr\u00e9sentant d&#8217;une entreprise \u00e9trang\u00e8re doit remplir le <strong>formulaire en ligne<\/strong> avec les principales donn\u00e9es de l&#8217;entreprise (ex. num\u00e9ro de TVA et repr\u00e9sentant l\u00e9gal). Il sera ensuite contact\u00e9 par un op\u00e9rateur de l&#8217;entreprise ID06 pour proc\u00e9der \u00e0 l&#8217;activation du compte. Pour la v\u00e9rification de l&#8217;identit\u00e9 du repr\u00e9sentant l\u00e9gal de l&#8217;entreprise \u00e9trang\u00e8re, il sera n\u00e9cessaire de se rendre physiquement dans un point de num\u00e9risation en Su\u00e8de ou dans un autre pays de l&#8217;UE pour la num\u00e9risation du document d&#8217;identit\u00e9.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-demande-de-la-carte-id06\">Demande de la carte ID06<\/h3>\n\n\n\n<p>L&#8217;\u00e9tape suivante est la <strong>commande de la carte<\/strong> elle-m\u00eame. Plus pr\u00e9cis\u00e9ment, il faut charger sur le portail ID06 les donn\u00e9es personnelles du titulaire de la carte. D&#8217;autres documents peuvent \u00eatre n\u00e9cessaires selon la nationalit\u00e9.<\/p>\n\n\n\n<p>Il est possible de choisir entre <strong>diff\u00e9rentes options<\/strong> pour l&#8217;approbation de la commande et la livraison de la carte. Le co\u00fbt de livraison varie <strong>selon l&#8217;urgence<\/strong> demand\u00e9e.<\/p>\n\n\n\n<p>La <strong>validit\u00e9<\/strong> de la carte peut varier en fonction de la nationalit\u00e9 du titulaire (UE, EEE, Royaume-Uni, non-UE ou demandeur d&#8217;asile). Pour les travailleurs d\u00e9tach\u00e9s citoyens de l&#8217;UE munis d&#8217;un <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">formulaire A1<\/a> valide, la carte ID06 sera valable <strong>25 jours<\/strong>. Il est ensuite possible de demander deux autres \u00e9missions pour la m\u00eame p\u00e9riode de validit\u00e9, avec un <strong>maximum de 75 jours par ann\u00e9e civile<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-reception-et-activation-de-la-carte-id06\">R\u00e9ception et activation de la carte ID06<\/h3>\n\n\n\n<p>Enfin, le portail ID06 envoie un <strong>e-mail de confirmation<\/strong> au travailleur titulaire de la carte. Ce dernier doit cr\u00e9er un compte personnel et confirmer la commande de la carte. La confirmation peut se faire via un eID su\u00e9dois ou par la num\u00e9risation du document d&#8217;identit\u00e9 du pays de citoyennet\u00e9 du travailleur.<\/p>\n\n\n\n<p>\u00c0 l&#8217;arriv\u00e9e de la carte \u00e0 l&#8217;adresse de livraison indiqu\u00e9e, le titulaire recevra un autre e-mail avec un <strong>lien vers le portail ID06<\/strong> pour activer la carte.
