L\u2019employeur du travailleur d\u00e9tach\u00e9 est tenu de respecter plusieurs conditions pour garantir et prot\u00e9ger les droits du travailleur. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-obblighi-preliminari-per-il-distacco-in-lettonia-nbsp\">Obligations pr\u00e9liminaires pour le d\u00e9tachement en Lettonie<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-notifica-di-distacco-nbsp\">Notification de d\u00e9tachement <\/h3>\n\n<p>Conform\u00e9ment \u00e0 l\u2019article 14.1 de la loi sur le travail, un employeur qui d\u00e9tache un ou plusieurs employ\u00e9s en Lettonie est oblig\u00e9 de respecter les obligations relatives \u00e0 l\u2019<a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">envoi de la notification<\/a> \u00e0 l\u2019inspection nationale du travail, \u00e0 la d\u00e9signation d\u2019une personne de contact, et au respect des conditions de travail et de salaire lettonnes. Les autres textes qui r\u00e9gissent cette mati\u00e8re sont les directives europ\u00e9ennes 96\/71, 2014\/67, 2018\/957, 2019\/1152 et leurs transpositions nationales respectives.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour en savoir plus, lisez notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">directives de d\u00e9tachement des travailleurs dans l\u2019UE<\/a>.<\/p>\n<\/blockquote>\n\n<p>Les travailleurs devront \u00eatre <strong>notifi\u00e9s s\u2019ils sont impliqu\u00e9s dans<\/strong> :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Une prestation de service aupr\u00e8s d\u2019un client final letton ;<\/li>\n\n\n\n<li>Un d\u00e9tachement intra-groupe pour une entreprise h\u00f4te lettonne, filiale de celle d\u00e9tachante ; <\/li>\n\n\n\n<li>Un d\u00e9tachement g\u00e9r\u00e9 par une agence d\u2019int\u00e9rim ; <\/li>\n\n\n\n<li>Un d\u00e9tachement d\u00e9coulant d\u2019un contrat de sous-traitance. <\/li>\n<\/ul>\n\n<p>La notification se transmet par voie \u00e9lectronique et doit \u00eatre <strong>envoy\u00e9e avant le d\u00e9but des travaux en Lettonie<\/strong>. Celle-ci doit inclure toutes les informations concernant :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>L\u2019entreprise d\u00e9tachante ; <\/li>\n\n\n\n<li>Les travailleurs d\u00e9tach\u00e9s ; <\/li>\n\n\n\n<li>Le client final ; <\/li>\n\n\n\n<li>L\u2019adresse du chantier, etc. <\/li>\n<\/ul>\n\n<p>\u00c0 ce jour, <strong>il n\u2019existe pas d\u2019exemptions pour la notification<\/strong>, qui est obligatoire pour toute mission, quelle que soit sa dur\u00e9e.<\/p>\n\n<p>De m\u00eame que pour le d\u00e9but d\u2019une mission, toute modification devra \u00eatre notifi\u00e9e via les canaux pr\u00e9vus, au plus tard trois jours apr\u00e8s la modification elle-m\u00eame. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-persona-di-contatto-nbsp\">Personne de contact<\/h3>\n\n<p>Conform\u00e9ment \u00e0 la <a href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\">Directive 2014\/67\/UE<\/a>, les employeurs qui d\u00e9tachent des travailleurs en Lettonie sont tenus de d\u00e9signer une <strong>personne de contact<\/strong>, qui servira de r\u00e9f\u00e9rent aussi bien pour les autorit\u00e9s que pour les travailleurs d\u00e9tach\u00e9s, optimisant ainsi les canaux de communication et offrant le soutien n\u00e9cessaire.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-condizioni-di-lavoro-e-salariali-in-lettonia-nbsp\">Conditions de travail et salariales en Lettonie<\/h2>\n\n<p>L\u2019employeur qui d\u00e9tache en Lettonie doit \u00e9galement s\u2019engager \u00e0 respecter les conditions de travail et de salaire lettonnes, <strong>si celles-ci sont plus favorables<\/strong> que celles de l\u2019\u00c9tat dans lequel le travailleur exerce habituellement, conform\u00e9ment \u00e0 la Directive 2018\/957\/UE.<\/p>\n\n<p>Il est donc obligatoire de respecter les p\u00e9riodes maximales de travail et les p\u00e9riodes minimales de repos, ainsi que les cong\u00e9s annuels et les principes de sant\u00e9 et s\u00e9curit\u00e9 au travail, qui imposent une formation sp\u00e9cifique visant \u00e0 garantir aux travailleurs un environnement de travail s\u00fbr, gr\u00e2ce \u00e0 la fourniture des \u00e9quipements de protection n\u00e9cessaires et \u00e0 l\u2019acquisition de la formation ad\u00e9quate. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les normes minimales en termes de conditions de travail sont fix\u00e9es par la <a href=\"https:\/\/arlettipartners.com\/directive-2003-88-ce-temps-de-travail-sur-le-marche-europeen\/?lang=fr\">Directive 2003\/88\/UE<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"h-obbligo-di-conservazione-dei-documenti-nbsp\">Obligation de conservation des documents<\/h2>\n\n<p>L\u2019employeur d\u2019un salari\u00e9 d\u00e9tach\u00e9 en Lettonie, pendant la p\u00e9riode de d\u00e9tachement, est oblig\u00e9 de <strong>conserver et de mettre \u00e0 disposition<\/strong> une copie des documents relatifs \u00e0 celui-ci. Ces documents incluent :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Les contrats de travail ; <\/li>\n\n\n\n<li>Les fiches de paie ; <\/li>\n\n\n\n<li>Les feuilles de pr\u00e9sence ; <\/li>\n\n\n\n<li>Les documents prouvant le paiement des salaires. <\/li>\n<\/ul>\n\n<p>Ces documents devront \u00eatre fournis aux institutions lettonnes de surveillance et de contr\u00f4le. Si demand\u00e9 par les autorit\u00e9s, une traduction dans la langue officielle du pays (letton) devra \u00e9galement \u00eatre fournie. <\/p>\n\n<p>L\u2019obligation de conserver les documents s\u2019applique \u00e9galement <strong>apr\u00e8s la fin de la p\u00e9riode de d\u00e9tachement<\/strong>, pendant une p\u00e9riode de deux ans.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-lavoratori-cittadini-extracomunitari-in-lettonia-nbsp\">Travailleurs citoyens non europ\u00e9ens en Lettonie<\/h2>\n\n<p>Dans le cadre de l\u2019immigration de personnel non europ\u00e9en, les textes de la loi sur l\u2019immigration du 31 octobre 2002 et le R\u00e8glement du Cabinet des ministres n\u00b0 55 du 28 janvier 2014 relatifs \u00e0 l\u2019emploi de citoyens de pays tiers en Lettonie s\u2019appliquent. <\/p>\n\n<p>Les citoyens non europ\u00e9ens peuvent entrer et travailler en Lettonie <strong>sans avoir besoin d\u2019un permis de s\u00e9jour letton, pendant 90 jours sur une p\u00e9riode de 180<\/strong> jours, conform\u00e9ment \u00e0 l\u2019accord de Schengen. Cette exemption s\u2019applique aux travailleurs poss\u00e9dant un permis de s\u00e9jour d\u00e9livr\u00e9 par un \u00c9tat membre\/EEE, et employ\u00e9s dans l\u2019un de ces \u00c9tats, qui se rendent en Lettonie pour une prestation de services de courte dur\u00e9e, et qui ont \u00e9t\u00e9 employ\u00e9s depuis au moins 3 mois par l\u2019entreprise \u00e9trang\u00e8re employeuse.<\/p>\n\n<p>Si le s\u00e9jour\/travail en Lettonie <strong>d\u00e9passe les 90 jours<\/strong>, il sera n\u00e9cessaire de demander un permis de s\u00e9jour sp\u00e9cifique.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-sicurezza-sociale-e-modello-a1-per-i-lavoratori-distaccati-in-lettonia\">S\u00e9curit\u00e9 sociale et Mod\u00e8le A1 pour les travailleurs d\u00e9tach\u00e9s en Lettonie<\/h2>\n\n<p>Conform\u00e9ment au <strong>R\u00e8glement europ\u00e9en 883\/2004<\/strong>, les travailleurs d\u00e9tach\u00e9s en Lettonie peuvent continuer \u00e0 \u00eatre couverts par la s\u00e9curit\u00e9 sociale de l\u2019\u00c9tat membre o\u00f9 est situ\u00e9 l\u2019employeur et o\u00f9 ils travaillent habituellement.<\/p>\n\n<p>L\u2019entreprise d\u00e9tachante doit demander le <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a>. Celui-ci sera d\u00e9livr\u00e9 par l\u2019institution de s\u00e9curit\u00e9 sociale comp\u00e9tente une fois toutes les informations n\u00e9cessaires re\u00e7ues. Le certificat A1 peut avoir une <strong>dur\u00e9e maximale de 24 mois<\/strong>. De plus, le travailleur doit le conserver pendant toute la dur\u00e9e de son d\u00e9tachement en Lettonie.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-sanzioni-in-caso-di-non-conformita-nbsp\">Sanctions en cas de non-conformit\u00e9<\/h2>\n\n<p>Conform\u00e9ment au Chapitre 36 de la loi sur le travail, un employeur qui ne respecte pas les dispositions relatives au d\u00e9tachement transnational des travailleurs est passible de sanctions par l\u2019organe d\u2019inspection letton comp\u00e9tent. En cas de sanctions \u00e0 l\u2019encontre d\u2019une entreprise sans si\u00e8ge en Lettonie, l\u2019avis d\u2019amende est re\u00e7u par l\u2019organe inspecteur \u00e9tranger \u00e9quivalent. <\/p>\n\n<p>Une fois sanctionn\u00e9e, l\u2019entreprise d\u00e9tachante doit \u00e9galement respecter les d\u00e9lais de paiement de l\u2019amende, qui doit \u00eatre r\u00e9gl\u00e9e dans un
