Gr\u00e2ce au Code unique n\u00b0 1144 du 14 septembre 2018, le d\u00e9tachement transnational des travailleurs pour la prestation de services est r\u00e9glement\u00e9 comme suit.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour un aper\u00e7u complet des directives de l&#8217;UE en la mati\u00e8re, consultez notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">directives de l&#8217;UE concernant le d\u00e9tachement<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"obligations\">Obligations pr\u00e9liminaires pour le d\u00e9tachement des travailleurs au Danemark<\/h2>\n\n<p class=\"has-text-align-left\">Pour notifier le d\u00e9tachement de travailleurs au Danemark de mani\u00e8re correcte, il est n\u00e9cessaire d&#8217;envoyer une <a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">d\u00e9claration de d\u00e9tachement<\/a> via le site du <em><a href=\"https:\/\/virk.dk\/myndigheder\/stat\/ERST\/selvbetjening\/Registrering_af_udenlandske_tjenesteydere_RUT__Registration_of_Foreign_Services_RUT\/\" target=\"_blank\" rel=\"noopener\">Registret for Udenlandske Tjenesteydere<\/a><\/em> (RUT, Registre des fournisseurs de services \u00e9trangers), en fournissant toutes les informations n\u00e9cessaires concernant l&#8217;entreprise d\u00e9tachante et le type d&#8217;activit\u00e9 qui aura lieu sur le territoire danois.<\/p>\n\n<p class=\"has-text-align-left\">Le Registre des fournisseurs de services \u00e9trangers (RUT) permet de notifier un d\u00e9tachement \u00e0 condition qu&#8217;il s&#8217;agisse de : <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Un d\u00e9tachement pour la prestation de services pour une entreprise h\u00f4te danoise ; <\/li>\n\n\n\n<li>Un d\u00e9tachement intra-groupe pour une entreprise h\u00f4te danoise filiale de l&#8217;entreprise d\u00e9tachante ; <\/li>\n\n\n\n<li>Un d\u00e9tachement g\u00e9r\u00e9 par une agence int\u00e9rimaire ; <\/li>\n\n\n\n<li>Un d\u00e9tachement issu d&#8217;un contrat de sous-traitance. <\/li>\n<\/ul>\n\n<p class=\"has-text-align-left\">Il est tr\u00e8s important que l&#8217;entreprise d\u00e9tachante \u00e9trang\u00e8re soit effectivement \u00e9tablie dans l&#8217;\u00c9tat mentionn\u00e9 dans ses documents. Tous les travailleurs d\u00e9tach\u00e9s pour des activit\u00e9s telles que la construction, l&#8217;agriculture, la sylviculture, l&#8217;horticulture, le jardinage et le nettoyage doivent \u00eatre notifi\u00e9s via le RUT. <\/p>\n\n<p class=\"has-text-align-left\">En revanche, sont exempt\u00e9s de l&#8217;obligation de notification les d\u00e9tachements d&#8217;une dur\u00e9e inf\u00e9rieure \u00e0 8 jours, ceux concernant la livraison et l&#8217;installation de machines techniques ainsi que les travailleurs qualifi\u00e9s et sp\u00e9cialis\u00e9s. <\/p>\n\n<p class=\"has-text-align-left\">Comme mentionn\u00e9 pr\u00e9c\u00e9demment, tous les travailleurs des secteurs cit\u00e9s doivent \u00eatre notifi\u00e9s, y compris les travailleurs autonomes. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"conditions\">Conditions de travail et de r\u00e9mun\u00e9ration au Danemark<\/h2>\n\n<p class=\"has-text-align-left\">Un travailleur d\u00e9tach\u00e9 au Danemark a les m\u00eames droits qu&#8217;un travailleur danois. Les contrats collectifs de travail et les contrats individuels entre l&#8217;entreprise et le travailleur d\u00e9finissent le salaire et les horaires de travail. <\/p>\n\n<p class=\"has-text-align-left\">En g\u00e9n\u00e9ral, l&#8217;entreprise \u00e9trang\u00e8re conclut un accord avec un syndicat danois pour r\u00e9diger le contrat du salari\u00e9. <\/p>\n\n<p class=\"has-text-align-left\">Au Danemark, la semaine de travail standard est de 37 heures. Cependant, il est permis de travailler jusqu&#8217;\u00e0 un maximum de 48 heures par semaine. La dur\u00e9e et la r\u00e9mun\u00e9ration des cong\u00e9s sont \u00e9tablies par la <a href=\"https:\/\/www.retsinformation.dk\/eli\/lta\/2013\/202\" target=\"_blank\" rel=\"noopener\">Loi danoise sur les Cong\u00e9s<\/a>.<\/p>\n\n<h3 class=\"wp-block-heading\">Y a-t-il un salaire minimum au Danemark ?<\/h3>\n\n<p class=\"has-text-align-left\">Il n&#8217;y a pas de salaire minimum au Danemark et les salaires sont fix\u00e9s par les conventions collectives. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"documents\">Traitement et conservation des documents relatifs au d\u00e9tachement des travailleurs<\/h2>\n\n<p class=\"has-text-align-left\">L&#8217;entreprise d\u00e9tachante doit envoyer la d\u00e9claration de d\u00e9tachement \u2013 via le site du RUT \u2013 au plus tard avant le d\u00e9but de la prestation de services au Danemark. La d\u00e9claration peut \u00eatre remplie en anglais, en allemand, en polonais ou en danois. <\/p>\n\n<p class=\"has-text-align-left\">Elle contient diverses informations telles que la d\u00e9nomination sociale de l&#8217;entreprise d\u00e9tachante, les dates de d\u00e9but et de fin du d\u00e9tachement, l&#8217;adresse du chantier, les coordonn\u00e9es d&#8217;une personne de contact, l&#8217;entreprise h\u00f4te, etc. <\/p>\n\n<p class=\"has-text-align-left\">Le re\u00e7u re\u00e7u apr\u00e8s l&#8217;envoi de la d\u00e9claration est valable en tant que document. Pendant la p\u00e9riode de d\u00e9tachement, les travailleurs doivent toujours conserver une copie de ce re\u00e7u et la montrer \u00e0 l&#8217;employeur danois. De plus, tous les documents relatifs au d\u00e9tachement doivent \u00eatre conserv\u00e9s sur le lieu de travail. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">En cas d&#8217;inspection, le travailleur doit \u00e9galement fournir une copie en anglais ou en danois des documents demand\u00e9s. <\/p>\n<\/blockquote>\n\n<p class=\"has-text-align-left\">Le r\u00f4le de la personne de contact sur le territoire danois est crucial. Un des travailleurs d\u00e9tach\u00e9s peut \u00e9galement servir de repr\u00e9sentant domicili\u00e9. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"noneu\">Travailleurs extra-europ\u00e9ens au Danemark<\/h2>\n\n<p>La directive 2011\/98\/UE relative \u00e0 une proc\u00e9dure unique de demande pour la d\u00e9livrance d&#8217;un permis unique permettant aux citoyens de pays tiers de s\u00e9journer et de travailler sur le territoire d&#8217;un \u00c9tat membre n&#8217;a pas \u00e9t\u00e9 transpos\u00e9e au Danemark, o\u00f9 les conditions de travail et de s\u00e9jour sont \u00e9tablies par la <a href=\"https:\/\/natlex.ilo.org\/dyn\/natlex2\/r\/natlex\/fe\/home\" target=\"_blank\" rel=\"noopener\">Loi danoise sur les \u00c9trangers<\/a>. Selon cette loi, les citoyens extra-europ\u00e9ens poss\u00e9dant un visa valide pour tous les \u00c9tats de l&#8217;Espace Schengen peuvent entrer, s\u00e9journer et travailler au Danemark.<\/p>\n\n<p class=\"has-text-align-left\">Cependant, leur s\u00e9jour ne peut pas d\u00e9passer 90 jours sur une p\u00e9riode de 180 jours. Pendant cette p\u00e9riode de 90 jours, le nombre de jours qu&#8217;un travailleur \u00e9tranger a pass\u00e9s dans un autre \u00c9tat de l&#8217;Espace Schengen est soustrait du calcul. <\/p>\n\n<p class=\"has-text-align-left\">Toutefois, avant d&#8217;entrer au Danemark pour offrir une prestation de services, les travailleurs d\u00e9tach\u00e9s doivent \u00eatre en possession d&#8217;un permis de s\u00e9jour et de travail valide. Un travailleur r\u00e9sidant dans un \u00c9tat de l&#8217;Union europ\u00e9enne, dans un \u00c9tat de l&#8217;Espace \u00e9conomique europ\u00e9en ou en Suisse peut commencer \u00e0 travailler au Danemark sans poss\u00e9der le permis, \u00e0 condition de le demander par la suite. <\/p>\n\n<p class=\"has-text-align-left\">Si le d\u00e9tachement dure plus de 3 mois, il sera n\u00e9cessaire de demander un num\u00e9ro CPR. Il s&#8217;agit du num\u00e9ro d&#8217;inscription \u00e0 la population que poss\u00e8dent tous les citoyens danois. Il est n\u00e9cessaire pour ouvrir un compte bancaire, avoir acc\u00e8s au service de sant\u00e9, payer les imp\u00f4ts, recevoir le salaire, etc. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Si le d\u00e9tachement dure plus de 6 mois, il sera soumis \u00e0 la fiscalit\u00e9 danoise. <\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"socialsecurity\">S\u00e9curit\u00e9 sociale au Danemark<\/h2>\n\n<p class=\"has-text-align-left\">Conform\u00e9ment au R\u00e8glement 883\/2004, les travailleurs d\u00e9tach\u00e9s au Danemark peuvent continuer \u00e0 \u00eatre couverts par la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 se trouve leur employeur. <\/p>\n\n<p class=\"has-text-align-left\">L&#8217;entreprise d\u00e9tachante peut demander \u00e0 l&#8217;institut social comp\u00e9tent la d\u00e9livrance du <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Mod\u00e8le A1<\/a>.<\/p>\n\n<p class=\"has-text-align-left\">Il peut avoir une dur\u00e9e maximale de 24 mois. De plus, le travailleur doit toujours avoir le Mod\u00e8le A1 sur lui pendant son d\u00e9tachement au Danemark. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"penalties\">Sanctions en cas de non-conformit\u00e9 aux obligations danoises relatives au d\u00e9tachement des travailleurs <\/h2>\n\n<p class=\"has-text-align-left\">En cas de non-respect de l&#8217;envoi de la d\u00e9claration de d\u00e9tachement, l&#8217;entreprise \u00e9trang\u00e8re peut \u00eatre sanctionn\u00e9e par une amende de l&#8217;Autorit\u00e9 danoise pour l&#8217;environnement de travail (WEA). <\/p>\n\n<p>Le montant de l&#8217;amende varie de 10.000 DKK (environ 1.344 \u20ac) \u00e0 20.000 DKK (environ 2.688 \u20ac) en fonction de la r\u00e9cidive.
