Elles ont \u00e9galement pour but de combattre le dumping social, ce qui signifie que les entreprises ne peuvent pas exploiter les diff\u00e9rences dans les conditions de travail et les salaires pour obtenir des avantages comp\u00e9titifs.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les r\u00e8gles su\u00e9doises sur le d\u00e9tachement sont bas\u00e9es sur la l\u00e9gislation commune de l&#8217;UE et de l&#8217;Espace \u00c9conomique Europ\u00e9en. Pour plus d&#8217;informations sur les directives de l&#8217;UE en la mati\u00e8re, consultez notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">directives de l&#8217;UE concernant le d\u00e9tachement des travailleurs<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"obblighiimprese\">Obligations pr\u00e9liminaires pour les employeurs d\u00e9tachant des travailleurs en Su\u00e8de<\/h2>\n\n<p class=\"has-text-align-left\">Les employeurs \u00e9trangers qui d\u00e9tachent des travailleurs en Su\u00e8de doivent signaler le d\u00e9tachement \u00e0 l&#8217;Autorit\u00e9 su\u00e9doise pour l&#8217;environnement de travail via le <a href=\"https:\/\/www.av.se\/en\/report-a-posting\" target=\"_blank\" rel=\"noopener\">service en ligne appropri\u00e9<\/a>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Les entreprises doivent envoyer la notification au plus tard le jour du d\u00e9but de l&#8217;activit\u00e9 en Su\u00e8de. <\/p>\n<\/blockquote>\n\n<h3 class=\"wp-block-heading\" id=\"h-notifica-distacco-lavoratori-in-svezia-e-cambiamenti-rilevanti\">Notification du d\u00e9tachement des travailleurs en Su\u00e8de et changements importants<\/h3>\n\n<p class=\"has-text-align-left\">La <a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">notification de d\u00e9tachement<\/a> doit inclure les informations pertinentes concernant le d\u00e9tachement, telles que les d\u00e9tails sur :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;entreprise d\u00e9tachante ; <\/li>\n\n\n\n<li>L&#8217;entit\u00e9 r\u00e9ceptrice ; <\/li>\n\n\n\n<li>Les travailleurs d\u00e9tach\u00e9s ; <\/li>\n\n\n\n<li>La personne de contact. <\/li>\n<\/ul>\n\n<p class=\"has-text-align-left\">De plus, l&#8217;entreprise doit signaler tout changement survenu pendant le d\u00e9tachement en modifiant la notification de d\u00e9tachement. <\/p>\n\n<h3 class=\"wp-block-heading\">Nommer un interlocuteur local en Su\u00e8de<\/h3>\n\n<p class=\"has-text-align-left\">Le repr\u00e9sentant d\u00e9sign\u00e9 doit \u00eatre pr\u00e9sent en Su\u00e8de <strong>pendant toute la dur\u00e9e du d\u00e9tachement<\/strong>. De plus, la personne de contact est autoris\u00e9e \u00e0 recevoir des documents au nom de l&#8217;entreprise.<\/p>\n\n<p class=\"has-text-align-left\">Sur demande, la personne de contact doit \u00e9galement pr\u00e9senter des documents attestant de la conformit\u00e9 aux exigences de la loi sur le d\u00e9tachement des travailleurs. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"obblighidestinatario\">Obligations suppl\u00e9mentaires pour le destinataire du service su\u00e9dois<\/h2>\n\n<p class=\"has-text-align-left\">L&#8217;employeur est responsable de l&#8217;envoi de la notification de d\u00e9tachement \u00e0 l&#8217;Autorit\u00e9 su\u00e9doise pour l&#8217;environnement de travail. L&#8217;entreprise d\u00e9tachante doit \u00e9galement appliquer les conditions de travail et de r\u00e9mun\u00e9ration les plus favorables. <\/p>\n\n<p class=\"has-text-align-left\">D&#8217;autre part, l&#8217;entreprise r\u00e9ceptrice doit conserver une copie de la documentation prouvant la correcte notification du d\u00e9tachement. Si l&#8217;entreprise d\u00e9tachante ne fournit pas ce document au destinataire su\u00e9dois, ce dernier doit le signaler par e-mail \u00e0 l&#8217;Autorit\u00e9 su\u00e9doise dans un d\u00e9lai de trois jours apr\u00e8s le d\u00e9but de l&#8217;activit\u00e9. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Le destinataire du service qui ne le notifie pas \u00e0 la SWEA peut \u00eatre tenu de payer une amende de 20 000 SEK. <\/p>\n<\/blockquote>\n\n<p class=\"has-text-align-left\">Dans tous les cas, la notification de l&#8217;entreprise r\u00e9ceptrice ne remplace pas la notification de d\u00e9tachement de l&#8217;employeur, qui doit soumettre la notification de d\u00e9tachement comme indiqu\u00e9 pr\u00e9c\u00e9demment. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"condizioni\">Conditions de travail et r\u00e9mun\u00e9ration en Su\u00e8de<\/h2>\n\n<p class=\"has-text-align-left\">Les horaires de travail et les p\u00e9riodes de repos sont r\u00e9gis par la Loi sur le Temps de Travail, qui s&#8217;applique \u00e9galement aux travailleurs d\u00e9tach\u00e9s. Cette loi d\u00e9finit les conditions de travail quotidien, les pauses et les heures suppl\u00e9mentaires. Cependant, les conventions collectives peuvent d\u00e9roger \u00e0 la loi, bien que certains exigences minimales concernant le repos hebdomadaire, le repos quotidien et le total des heures de travail hebdomadaires soient obligatoires.<\/p>\n\n<p class=\"has-text-align-left\">En ce qui concerne les conditions salariales, <strong>la Su\u00e8de n&#8217;a pas de salaire minimum l\u00e9gal<\/strong>, donc aucun niveau salarial sp\u00e9cial ne s&#8217;applique automatiquement aux employ\u00e9s d\u00e9tach\u00e9s en Su\u00e8de. En effet, chaque convention collective sectorielle fixe les niveaux de r\u00e9mun\u00e9ration \u00e0 appliquer \u00e9galement aux travailleurs d\u00e9tach\u00e9s.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"adempimenti\">Obligations suppl\u00e9mentaires pour les d\u00e9tachements de longue dur\u00e9e en Su\u00e8de<\/h2>\n\n<p class=\"has-text-align-left\">En cas de d\u00e9tachement en Su\u00e8de de plus de 12 mois, le travailleur d\u00e9tach\u00e9 a droit \u00e0 des conditions de travail et des termes d&#8217;emploi suppl\u00e9mentaires \u00e9quivalents \u00e0 ceux des employ\u00e9s su\u00e9dois dans une situation similaire. Dans le calcul de la p\u00e9riode de 12 mois, tous les d\u00e9tachements impliquant diff\u00e9rents travailleurs (y compris en cas de remplacement) effectuant la m\u00eame activit\u00e9 au m\u00eame lieu de travail doivent \u00eatre pris en compte. <\/p>\n\n<p class=\"has-text-align-left\">Le terme peut \u00eatre prolong\u00e9 de 12 \u00e0 18 mois. L&#8217;employeur \u00e9tranger doit alors fournir une notification motiv\u00e9e \u00e0 l&#8217;Autorit\u00e9 su\u00e9doise comp\u00e9tente avant l&#8217;expiration des 12 mois. <\/p>\n\n<p class=\"has-text-align-left\">Pour signaler le prolongement \u00e0 18 mois, l&#8217;employeur peut contacter la SWEA par e-mail. L&#8217;employeur doit expliquer et justifier les raisons de la prolongation. Apr\u00e8s la p\u00e9riode de 12\/18 mois, les travailleurs d\u00e9tach\u00e9s sont soumis \u00e0 toutes les conditions suppl\u00e9mentaires en termes d&#8217;emploi. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"sicurezzasociale\">Coordination de la s\u00e9curit\u00e9 sociale en Su\u00e8de<\/h2>\n\n<p class=\"has-text-align-left\">Les travailleurs d\u00e9tach\u00e9s d&#8217;un pays de l&#8217;UE\/EEE ont le droit de maintenir les contributions sociales vers\u00e9es dans leur pays d&#8217;origine. \u00c0 cet \u00e9gard, l&#8217;employeur doit demander le <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a> \u00e0 l&#8217;organisme de s\u00e9curit\u00e9 sociale comp\u00e9tent. Le certificat A1 prouve que le travailleur continue \u00e0 payer les cotisations sociales dans son pays d&#8217;origine. Ce document doit \u00eatre disponible pendant et apr\u00e8s le d\u00e9tachement et sur demande des autorit\u00e9s.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"sanzioni\">Sanctions en cas de non-conformit\u00e9 au d\u00e9tachement des travailleurs en Su\u00e8de<\/h2>\n\n<p class=\"has-text-align-left\">Le non-signalement du d\u00e9tachement ou de la personne de contact entra\u00eene une amende de 20 000 SEK pour chaque travailleur d\u00e9tach\u00e9. Il en va de m\u00eame pour les entreprises d\u00e9tachantes qui ne fournissent pas \u00e0 temps la documentation relative \u00e0 la notification de d\u00e9tachement au destinataire des services. Dans ces cas, l&#8217;employeur \u00e9tranger recevra une injonction de paiement de l&#8217;Autorit\u00e9 su\u00e9doise. <\/p>\n\n<p class=\"has-text-align-left\">L&#8217;entreprise \u00e9trang\u00e8re peut contester l&#8217;amende et fournir \u00e0 l&#8217;autorit\u00e9 comp\u00e9tente des preuves et des justifications \u00e0 l&#8217;appui de l&#8217;opposition. <\/p>\n\n<p class=\"has-text-align-left\">De plus, si la d\u00e9claration de d\u00e9tachement est incorrecte ou incompl\u00e8te, l&#8217;autorit\u00e9 su\u00e9doise du travail peut d\u00e9cider d&#8217;\u00e9mettre une injonction, demandant de corriger les lacunes. Il en va de m\u00eame si l&#8217;entreprise \u00e9trang\u00e8re ne met pas \u00e0 jour les informations ou si la personne de contact ne remplit pas ses fonctions conform\u00e9ment aux r\u00e8gles.
