{"id":180511,"date":"2022-09-08T11:56:50","date_gmt":"2022-09-08T09:56:50","guid":{"rendered":"https:\/\/arlettipartners.com\/detachement-des-travailleurs-en-grece\/"},"modified":"2025-09-16T12:38:27","modified_gmt":"2025-09-16T10:38:27","slug":"detachement-des-travailleurs-en-grece","status":"publish","type":"post","link":"https:\/\/arlettipartners.com\/fr\/detachement-des-travailleurs-en-grece\/","title":{"rendered":"D\u00e9tachement des travailleurs en Gr\u00e8ce"},"content":{"rendered":"\n<p class=\"has-text-align-left\">La transposition nationale de la <a href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\">Directive 2014\/67\/UE<\/a> du Parlement europ\u00e9en et du Conseil, du 15 mai 2014, concernant l&#8217;application de la Directive 96\/71\/CE relative au d\u00e9tachement des travailleurs, a \u00e9t\u00e9 mise en \u0153uvre en Gr\u00e8ce par le d\u00e9cret pr\u00e9sidentiel national 219\/2000. Celui-ci porte sur les \u00ab <em>Mesures de protection des travailleurs d\u00e9tach\u00e9s en Gr\u00e8ce pour effectuer un travail temporaire sur le territoire grec dans le cadre de la prestation transnationale de services<\/em> \u00bb.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour une vue d&#8217;ensemble de toutes les Directives en la mati\u00e8re, consultez notre <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">guide sur les Directives de l&#8217;UE relatives au d\u00e9tachement des travailleurs<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"obligations\">Obligations pr\u00e9liminaires au d\u00e9tachement des travailleurs en Gr\u00e8ce<\/h2>\n\n<p>Une entreprise \u00e9trang\u00e8re d\u00e9tachante doit envoyer une <a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">d\u00e9claration \u00e9crite de d\u00e9tachement pr\u00e9liminaire<\/a>, en grec ou en anglais, avant le d\u00e9but de la prestation de services. Ce document doit \u00eatre transmis au d\u00e9partement comp\u00e9tent de l&#8217;Inspection du travail sur le territoire grec.<\/p>\n\n<p>Chaque employ\u00e9 d\u00e9tach\u00e9 doit \u00eatre notifi\u00e9. Toutefois, certaines exceptions existent. Par exemple, les compagnies de navigation qui d\u00e9tachent du personnel maritime sont exempt\u00e9es de cette obligation. <\/p>\n\n<p>Lors de la r\u00e9daction des documents essentiels pour le d\u00e9tachement en Gr\u00e8ce, il est important de prendre en compte certains \u00e9l\u00e9ments obligatoires tels que : <\/p>\n\n<ul class=\"wp-block-list\">\n<li>informations sur l&#8217;entreprise d\u00e9tachante, adresse et si\u00e8ge social ; <\/li>\n\n\n\n<li>donn\u00e9es sur le repr\u00e9sentant l\u00e9gal de l&#8217;entreprise d\u00e9tachante ; <\/li>\n\n\n\n<li>donn\u00e9es sur le repr\u00e9sentant l\u00e9gal de l&#8217;entreprise d&#8217;accueil en Gr\u00e8ce ; <\/li>\n\n\n\n<li>adresse du lieu de travail o\u00f9 les travailleurs d\u00e9tach\u00e9s exerceront leur activit\u00e9 ; <\/li>\n\n\n\n<li>donn\u00e9es des travailleurs d\u00e9tach\u00e9s ; <\/li>\n\n\n\n<li>dates de d\u00e9but et de fin de la mission. <\/li>\n<\/ul>\n\n<p>En cas de modification des donn\u00e9es dans la d\u00e9claration de d\u00e9tachement, l&#8217;employeur d\u00e9tachant devra envoyer une nouvelle notification. Celle-ci doit contenir la modification au plus tard dans les 15 jours suivant la date du changement. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"conditions\">Conditions de travail et de r\u00e9mun\u00e9ration en Gr\u00e8ce<\/h2>\n\n<p>La Directive 957\/2018\/UE concernant l&#8217;alignement salarial et les conditions de travail n&#8217;a pas \u00e9t\u00e9 transpos\u00e9e en Gr\u00e8ce. Par cons\u00e9quent, la l\u00e9gislation de r\u00e9f\u00e9rence reste la Directive 96\/71\/CE, transpos\u00e9e dans le d\u00e9cret pr\u00e9sidentiel grec du 31 ao\u00fbt 2000. <\/p>\n\n<p>La semaine de travail standard en Gr\u00e8ce est de 40 heures. Cependant, avec les heures suppl\u00e9mentaires, il est permis de travailler jusqu&#8217;\u00e0 un maximum de 48 heures par semaine. <\/p>\n\n<p>Le d\u00e9cret pr\u00e9sidentiel 190\/2000 stipule que les salaires et r\u00e9mun\u00e9rations sont fix\u00e9s par le Code du travail grec (lois, d\u00e9crets et d\u00e9cisions minist\u00e9rielles) ainsi que par les conventions collectives. Toutefois, selon la Directive 96\/71\/CE, mise en \u0153uvre par la Directive 2018\/957\/UE, un travailleur d\u00e9tach\u00e9 dans un \u00c9tat membre de l&#8217;Union europ\u00e9enne doit b\u00e9n\u00e9ficier des conditions les plus favorables entre celles du pays d&#8217;accueil et celles de l&#8217;\u00c9tat o\u00f9 il est habituellement employ\u00e9. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"documents\">Archivage des documents li\u00e9s au d\u00e9tachement en Gr\u00e8ce<\/h2>\n\n<p>En Gr\u00e8ce, le lieu de travail est consid\u00e9r\u00e9 comme l&#8217;endroit o\u00f9 toute la documentation relative \u00e0 la mission doit \u00eatre conserv\u00e9e. Les documents les plus importants incluent g\u00e9n\u00e9ralement : <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Contrat de travail (ou document \u00e9quivalent) ; <\/li>\n\n\n\n<li>Derni\u00e8re fiche de paie du travailleur d\u00e9tach\u00e9 en Gr\u00e8ce ; <\/li>\n\n\n\n<li>Feuille de temps ; <\/li>\n\n\n\n<li>Preuve de paiement du salaire. <\/li>\n<\/ul>\n\n<p>En cas d&#8217;inspection, l&#8217;employeur devra fournir \u00e0 l&#8217;autorit\u00e9 comp\u00e9tente tous les documents en grec ou en anglais. Les documents doivent \u00eatre pr\u00e9sent\u00e9s dans un d\u00e9lai de 15 jours apr\u00e8s la demande des autorit\u00e9s. En tout \u00e9tat de cause, les autorit\u00e9s grecques peuvent effectuer une inspection dans un d\u00e9lai de deux ans apr\u00e8s la fin de la mission. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"noneu\">Travailleurs extra-communautaires en Gr\u00e8ce<\/h2>\n\n<p>En r\u00e8gle g\u00e9n\u00e9rale, un citoyen d&#8217;un pays tiers titulaire d&#8217;un permis de s\u00e9jour pour un autre \u00c9tat membre peut entrer en Gr\u00e8ce, mais ne peut pas y exercer d&#8217;activit\u00e9 sans un visa\/permis de travail grec sp\u00e9cifique. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"socialsecurity\">S\u00e9curit\u00e9 sociale en Gr\u00e8ce<\/h2>\n\n<p>Conform\u00e9ment au R\u00e8glement europ\u00e9en 883\/2004, les travailleurs d\u00e9tach\u00e9s en Gr\u00e8ce restent soumis \u00e0 la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 leur employeur est \u00e9tabli. <\/p>\n\n<p>L&#8217;entreprise d\u00e9tachante devra demander le <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a>. L&#8217;autorit\u00e9 comp\u00e9tente d\u00e9livrera ce document apr\u00e8s avoir re\u00e7u toutes les informations n\u00e9cessaires.<\/p>\n\n<p>Le Formulaire A1 peut avoir une dur\u00e9e maximale de 24 mois. Le travailleur doit toujours \u00eatre en possession de ce document pendant toute la dur\u00e9e de sa mission. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"penalties\">Sanctions en cas de non-respect des obligations en Gr\u00e8ce lors du d\u00e9tachement des travailleurs <\/h2>\n\n<p class=\"has-text-align-left\">Un employeur qui ne respecte pas les obligations pr\u00e9vues par le Code du travail grec peut \u00eatre sanctionn\u00e9 tant par des mesures administratives que p\u00e9nales. <\/p>\n\n<h3 class=\"wp-block-heading\">Sanctions administratives<\/h3>\n\n<p class=\"has-text-align-left\">Selon les articles 16 et 17 de la loi 2639\/1998, un employeur qui ne respecte pas les termes et conditions du Code du travail peut \u00eatre sanctionn\u00e9 par une amende comprise entre 1.000 \u20ac et 30.000 \u20ac pour chaque infraction. <\/p>\n\n<h3 class=\"wp-block-heading\">Sanctions p\u00e9nales<\/h3>\n\n<p class=\"has-text-align-left\">D&#8217;autre part, le non-respect des termes et conditions concernant les heures de travail, la r\u00e9mun\u00e9ration, etc., est passible d&#8217;une peine de prison d&#8217;au moins 6 mois, d&#8217;une amende de 900
