{"id":180472,"date":"2022-10-04T15:21:02","date_gmt":"2022-10-04T13:21:02","guid":{"rendered":"https:\/\/arlettipartners.com\/detachement-des-travailleurs-au-luxembourg\/"},"modified":"2025-09-16T12:40:38","modified_gmt":"2025-09-16T10:40:38","slug":"detachement-des-travailleurs-au-luxembourg","status":"publish","type":"post","link":"https:\/\/arlettipartners.com\/fr\/detachement-des-travailleurs-au-luxembourg\/","title":{"rendered":"D\u00e9tachement des travailleurs au Luxembourg"},"content":{"rendered":"\n<p class=\"has-text-align-left\">Les travailleurs d\u00e9tach\u00e9s au Luxembourg rel\u00e8vent du champ d&#8217;application de la Directive 96\/71\/CE relative au d\u00e9tachement de travailleurs dans le cadre de la prestation de services.<\/p>\n\n<p class=\"has-text-align-left\">Ainsi, les entreprises qui d\u00e9tachent leurs employ\u00e9s au Luxembourg doivent se conformer \u00e0 une s\u00e9rie d&#8217;exigences pr\u00e9vues par les transpositions nationales de cette directive, la directive 2014\/67\/UE et la Directive (UE) 2018\/957, \u00e0 savoir la <a href=\"https:\/\/legilux.public.lu\/eli\/etat\/leg\/loi\/2002\/12\/20\/n9\/jo\">loi du 20 d\u00e9cembre 2002<\/a>, la <a href=\"https:\/\/legilux.public.lu\/eli\/etat\/leg\/loi\/2017\/03\/14\/a300\/jo\">loi du 14 mars 2017<\/a> et la <a href=\"https:\/\/legilux.public.lu\/eli\/etat\/leg\/loi\/2020\/12\/15\/a1024\/jo\">loi du 15 d\u00e9cembre 2020<\/a>.<\/p>\n\n<p class=\"has-text-align-left\">Les paragraphes suivants fourniront un aper\u00e7u des obligations pr\u00e9vues par le Luxembourg et par la Directive Europ\u00e9enne sur le d\u00e9tachement transnational des travailleurs au Luxembourg.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour une vue d&#8217;ensemble compl\u00e8te de toutes les Directives UE en la mati\u00e8re, consultez notre <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">guide sur les Directives UE concernant le d\u00e9tachement des travailleurs<\/a>.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"preliminary\">Obligations pr\u00e9liminaires pour le d\u00e9tachement des travailleurs au Luxembourg<\/h2>\n\n<p class=\"has-text-align-left\">Les entreprises de l&#8217;UE\/EEE et de la Conf\u00e9d\u00e9ration suisse peuvent d\u00e9tacher leurs travailleurs au Luxembourg dans le cadre de la Directive 96\/71\/CE. Selon la Directive 2014\/67\/UE, le d\u00e9tachement des travailleurs au sein de l&#8217;Union Europ\u00e9enne implique des exigences d&#8217;enregistrement. Dans le cas du Luxembourg, l&#8217;entreprise qui d\u00e9tache le travailleur doit notifier (via la <a href=\"https:\/\/arlettipartners.com\/fr\/le-certificat-de-declaration-prealable\/?lang=fr\">d\u00e9claration pr\u00e9alable<\/a>) le d\u00e9tachement transnational temporaire des services \u00e0 la Direction g\u00e9n\u00e9rale des Classes moyennes du Minist\u00e8re de l&#8217;\u00c9conomie.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"further\">Obligations suppl\u00e9mentaires relatives au d\u00e9tachement des travailleurs au Luxembourg<\/h2>\n\n<p class=\"has-text-align-left\">Apr\u00e8s avoir pr\u00e9sent\u00e9 la d\u00e9claration de d\u00e9tachement, chaque travailleur d\u00e9tach\u00e9 doit obtenir une <strong>carte sociale<\/strong>. Cet outil d&#8217;identification inclut les informations de chaque employ\u00e9. De plus, il y a un code-barres permettant aux autorit\u00e9s comp\u00e9tentes \u2013 en l&#8217;occurrence l\u2019Inspection du Travail et des Mines (ITM) \u2013 de v\u00e9rifier les donn\u00e9es fournies dans la d\u00e9claration de d\u00e9tachement.<\/p>\n\n<p class=\"has-text-align-left\">En outre, lorsque l&#8217;activit\u00e9 rel\u00e8ve d&#8217;un secteur sp\u00e9cifique, tel que la construction, l&#8217;entreprise d\u00e9tachante doit tenir compte d&#8217;obligations suppl\u00e9mentaires. En effet, dans ces cas, l&#8217;entreprise \u00e9trang\u00e8re doit s&#8217;enregistrer \u00e0 la <strong>TVA au Luxembourg<\/strong>.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Nous recommandons d&#8217;analyser les cas sp\u00e9cifiques pour \u00e9valuer si l&#8217;enregistrement \u00e0 la TVA est n\u00e9cessaire ou non.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"conditions\">Conditions de travail et salariales pendant le d\u00e9tachement au Luxembourg<\/h2>\n\n<p class=\"has-text-align-left\">Lorsque les employ\u00e9s sont d\u00e9tach\u00e9s au Luxembourg, l&#8217;entreprise \u00e9trang\u00e8re doit respecter les dispositions \u00e9tablies par le droit du travail luxembourgeois. Les conditions g\u00e9n\u00e9rales de travail concernent notamment l&#8217;horaire de travail, l&#8217;hygi\u00e8ne et la s\u00e9curit\u00e9 au travail et les cong\u00e9s pay\u00e9s.<\/p>\n\n<h3 class=\"wp-block-heading\">Salaire minimum au Luxembourg<\/h3>\n\n<p class=\"has-text-align-left\">En ce qui concerne le salaire minimum, le Luxembourg dispose \u00e0 la fois d&#8217;un salaire minimum garanti et de conventions collectives. Chaque convention \u00e9tablit les exigences n\u00e9cessaires pour le salaire minimum, qui d\u00e9passe dans tous les cas le salaire minimum garanti.\n<\/p>\n\n<p>Suite \u00e0 l&#8217;augmentation du 1er f\u00e9vrier 2023, le salaire minimum au Luxembourg a \u00e9t\u00e9 port\u00e9 \u00e0 2 447,07 \u20ac.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Le dernier ajustement, en date du 1er septembre 2023, fixe le salaire minimum \u00e0 3 085,11 \u20ac.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"socialsecurity\">Pr\u00e9voyance sociale au Luxembourg<\/h2>\n\n<p class=\"has-text-align-left\">Lorsqu&#8217;un travailleur est d\u00e9tach\u00e9 au Luxembourg par un employeur d&#8217;un \u00c9tat membre de l&#8217;UE\/EEE, le salari\u00e9 d\u00e9tach\u00e9 travaille temporairement au Luxembourg, mais reste employ\u00e9 dans un autre pays. Gr\u00e2ce au syst\u00e8me de s\u00e9curit\u00e9 sociale harmonis\u00e9 de l&#8217;UE, les employ\u00e9s d\u00e9tach\u00e9s \u00e0 l&#8217;\u00e9tranger versent leurs cotisations sociales dans le pays o\u00f9 ils sont r\u00e9guli\u00e8rement occup\u00e9s.<\/p>\n\n<p class=\"has-text-align-left\">En effet, conform\u00e9ment au R\u00e8glement (CE) 883\/2004, l&#8217;entreprise d\u00e9tachante doit demander \u00e0 l&#8217;institution sociale comp\u00e9tente la d\u00e9livrance du <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">formulaire A1<\/a> pour chaque travailleur d\u00e9tach\u00e9. Ce document indique dans quel pays l&#8217;employeur paie les cotisations de s\u00e9curit\u00e9 sociale. Par cons\u00e9quent, les travailleurs d\u00e9tach\u00e9s restent soumis \u00e0 la l\u00e9gislation du syst\u00e8me de s\u00e9curit\u00e9 sociale du pays o\u00f9 ils sont employ\u00e9s.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Demandez de l&#8217;aide au bureau A&amp;P pour obtenir le certificat A1 ou le certificat multistate selon l&#8217;Art. 13.<\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"noneu\">Travailleurs extra-europ\u00e9ens d\u00e9tach\u00e9s au Luxembourg<\/h2>\n\n<p class=\"has-text-align-left\">Les entreprises bas\u00e9es dans l&#8217;UE (y compris celles de l&#8217;EEE et de la Conf\u00e9d\u00e9ration suisse) peuvent d\u00e9tacher leurs travailleurs extra-europ\u00e9ens tant qu&#8217;ils ont le droit de travailler et de r\u00e9sider dans le pays d&#8217;origine de l&#8217;entreprise. Selon l&#8217;Art. 49 de la loi modifi\u00e9e du 29 ao\u00fbt 2008, si le d\u00e9tachement dure<strong> plus de 3 mois<\/strong>, les ressortissants de pays tiers doivent demander \u00e0 la Direction de l\u2019Immigration un permis de s\u00e9jour pour travailleurs d\u00e9tach\u00e9s pour une prestation de services avec si\u00e8ge dans l&#8217;UE.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"documents\">Mise \u00e0 disposition des documents pendant le d\u00e9tachement des travailleurs au Luxembourg<\/h2>\n\n<p class=\"has-text-align-left\">Toute la documentation relative au d\u00e9tachement doit \u00eatre disponible pendant toute la dur\u00e9e du d\u00e9tachement au Luxembourg en cas de contr\u00f4le. En particulier, le repr\u00e9sentant d\u00e9sign\u00e9 sert de contact pour les autorit\u00e9s pour la communication des informations. Une fois le d\u00e9tachement termin\u00e9, les documents doivent \u00eatre conserv\u00e9s jusqu\u2019\u00e0 10 ans afin de permettre les contr\u00f4les d&#8217;inspection.<\/p>\n\n<p class=\"has-text-align-left\">De plus, ces documents doivent \u00eatre disponibles en fran\u00e7ais ou en allemand. S&#8217;ils sont r\u00e9dig\u00e9s dans une autre langue, une traduction est n\u00e9cessaire.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"penalties\">Sanctions en cas de non-conformit\u00e9 aux obligations l\u00e9gislatives luxembourgeoises<\/h2>\n\n<p class=\"has-text-align-left\">Toute violation des dispositions applicables au d\u00e9tachement des travailleurs au Luxembourg peut entra\u00eener des sanctions sous forme d&#8217;infractions administratives. La sanction peut aller jusqu&#8217;\u00e0 5 000 \u20ac par travailleur d\u00e9tach\u00e9. Cependant, en cas de r\u00e9cidive, les autorit\u00e9s peuvent augmenter le montant jusqu&#8217;\u00e0 50 000 \u20ac.<\/p>\n\n<p class=\"has-text-align-left\">\u00c9tant donn\u00e9 que l&#8217;entreprise d\u00e9tachante et l&#8217;entreprise d&#8217;accueil partagent des responsabilit\u00e9s, <strong>la sanction sera pay\u00e9e par les deux
