Les lois <a href=\"https:\/\/www.finlex.fi\/en\/laki\/kaannokset\/2016\/en20160447.pdf\">Act on Posting Workers (447\/2016)<\/a> et <a href=\"https:\/\/www.ilo.org\/dyn\/natlex\/natlex4.detail?p_lang=en&amp;p_isn=55478\">Posted Workers Act (1146\/1999)<\/a> sont les transpositions nationales en Finlande de la <a href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\">Directive 2014\/67\/UE<\/a> et r\u00e9gissent le d\u00e9tachement des travailleurs.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour une vue d&#8217;ensemble de toutes les Directives en la mati\u00e8re, consultez notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">Directives de l&#8217;UE concernant le d\u00e9tachement.<\/a><\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"obligations\">Obligations pr\u00e9liminaires au d\u00e9tachement de travailleurs en Finlande <\/h2>\n\n\n\n<p class=\"has-text-align-left\">Tout employeur \u00e9tranger souhaitant d\u00e9tacher ses travailleurs en Finlande doit <a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">notifier le d\u00e9tachement<\/a> imminent en envoyant en ligne, aux autorit\u00e9s comp\u00e9tentes, une d\u00e9claration de d\u00e9tachement pr\u00e9liminaire et en d\u00e9signant une personne de contact sur le territoire finlandais. La d\u00e9claration de d\u00e9tachement doit inclure des informations telles que la raison sociale de l&#8217;entreprise \u00e9trang\u00e8re d\u00e9tachante, la p\u00e9riode de la mission, le nom du client finlandais, l&#8217;adresse du lieu de travail, des informations personnelles sur les travailleurs d\u00e9tach\u00e9s, etc.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Les travailleurs doivent \u00eatre notifi\u00e9s s&#8217;ils sont impliqu\u00e9s dans : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Une prestation de service chez un client final finlandais ; <\/li>\n\n\n\n<li>Un d\u00e9tachement intragroupe pour une entreprise h\u00f4te finlandaise, filiale de l&#8217;entreprise d\u00e9tachante ; <\/li>\n\n\n\n<li>Un d\u00e9tachement g\u00e9r\u00e9 par une agence int\u00e9rimaire ; <\/li>\n\n\n\n<li>Un d\u00e9tachement d\u00e9coulant d&#8217;un contrat de sous-traitance. <\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-left\">Pendant le d\u00e9tachement, les travailleurs restent employ\u00e9s par leur employeur \u00e9tranger. <\/p>\n\n\n\n<p class=\"has-text-align-left\">Tout d\u00e9tachement doit \u00eatre notifi\u00e9 aux autorit\u00e9s comp\u00e9tentes, quelle que soit sa dur\u00e9e, au plus tard avant le d\u00e9but de l&#8217;activit\u00e9 en Finlande. De plus, si la dur\u00e9e de la mission d\u00e9passe 10 jours ouvrables, incluant les jours travaill\u00e9s sur le territoire finlandais au cours des 4 mois pr\u00e9c\u00e9dents, la d\u00e9signation d&#8217;un repr\u00e9sentant de l&#8217;entreprise r\u00e9sidant en Finlande sera \u00e9galement obligatoire. Ce repr\u00e9sentant agira en tant que personne de contact entre l&#8217;entreprise et les autorit\u00e9s finlandaises. <\/p>\n\n\n\n<p class=\"has-text-align-left\">Enfin, il sera n\u00e9cessaire de notifier toute modification apport\u00e9e \u00e0 une d\u00e9claration d\u00e9j\u00e0 soumise. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Travaux de construction et demande du code fiscal finlandais <\/h3>\n\n\n\n<p class=\"has-text-align-left\">Toute personne travaillant sur un chantier de construction, sur un projet d&#8217;installation ou dans un chantier naval doit \u00eatre en possession d&#8217;un code fiscal. Pour l&#8217;obtenir, il sera n\u00e9cessaire de prendre rendez-vous au bureau des imp\u00f4ts le plus proche. Le code fiscal est d\u00e9livr\u00e9 en environ deux \u00e0 trois heures et doit \u00eatre obligatoirement en possession du travailleur avant le d\u00e9but des travaux sur le chantier finlandais. Les conventions collectives ou individuelles r\u00e9gissent le temps de travail, le salaire, les p\u00e9riodes de repos et les autres conditions de travail et salariales. <\/p>\n\n\n\n<p class=\"has-text-align-left\">Les conditions de travail pour les travailleurs d\u00e9tach\u00e9s en Finlande sont fix\u00e9es par l&#8217;Act on Posted Workers, ainsi que par les lois <a href=\"https:\/\/tem.fi\/documents\/1410877\/2918935\/Employment+Contracts+Act\/b0fca473-f224-46b9-974c-acd153587680\">Employment Contracts Act<\/a>, <a href=\"https:\/\/www.ilo.org\/dyn\/natlex\/docs\/ELECTRONIC\/46245\/60791\/F672726630\/FIN46245%20English.pdf\">Working Hours Act<\/a> et <a href=\"https:\/\/tem.fi\/documents\/1410877\/2918981\/The+Annual+Holidays+Act\/9bd1fbbc-2a16-4937-bf2f-beefc55ccca4\">Annual Holiday Act.<\/a><\/p>\n\n\n\n<p class=\"has-text-align-left\">Enfin, la semaine de travail standard en Finlande est de 40 heures. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Y a-t-il un salaire minimum en Finlande ? <\/h3>\n\n\n\n<p class=\"has-text-align-left\">La Finlande n&#8217;a pas de salaire minimum fix\u00e9 par la loi. Chaque employeur doit verser \u00e0 ses employ\u00e9s la r\u00e9mun\u00e9ration minimale fix\u00e9e par la convention collective applicable. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"documents\">Conservation des documents relatifs au d\u00e9tachement <\/h2>\n\n\n\n<p class=\"has-text-align-left\">L&#8217;entreprise d\u00e9tachante envoie la d\u00e9claration de d\u00e9tachement pr\u00e9liminaire en ligne au plus tard avant le d\u00e9but des travaux en Finlande. <\/p>\n\n\n\n<p class=\"has-text-align-left\">Il sera n\u00e9cessaire de conserver, pendant toute la dur\u00e9e de la mission, les informations suivantes : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>D\u00e9tails d&#8217;identification de l&#8217;entreprise d\u00e9tachante, code fiscal, num\u00e9ro de TVA, adresse du si\u00e8ge social, repr\u00e9sentant l\u00e9gal ; <\/li>\n\n\n\n<li>Informations sur chaque travailleur d\u00e9tach\u00e9 : nom, num\u00e9ro d&#8217;identification, \u00e2ge et ann\u00e9es d&#8217;exp\u00e9rience (si requis) ; <\/li>\n\n\n\n<li>Informations concernant les conditions de travail et salariales ainsi que les droits du travailleur : dur\u00e9e de la mission, adresse du lieu de travail, activit\u00e9s r\u00e9alis\u00e9es, r\u00e9mun\u00e9ration et horaires de travail. <\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-left\">Si la dur\u00e9e pr\u00e9vue de la mission d\u00e9passe 10 jours, l&#8217;entreprise d\u00e9tachante devra \u00e9galement conserver une copie de : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Feuilles de temps sp\u00e9cifiques pour les jours travaill\u00e9s en Finlande ; <\/li>\n\n\n\n<li>Fiches de paie et documents attestant du paiement de la r\u00e9mun\u00e9ration due. <\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-left\">En cas de contr\u00f4le, l&#8217;entreprise d\u00e9tachante devra fournir \u00e0 l&#8217;autorit\u00e9 comp\u00e9tente en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 au travail une copie traduite en finnois, su\u00e9dois ou anglais des documents demand\u00e9s. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"noneu\">Citoyens extracommunautaires en Finlande <\/h2>\n\n\n\n<p class=\"has-text-align-left\">La loi <a href=\"https:\/\/www.ilo.org\/dyn\/natlex\/natlex4.detail?p_lang=en&amp;p_isn=67507\">Aliens Act 301\/2004<\/a> \u00e9tablit les dispositions relatives aux permis de s\u00e9jour et s&#8217;applique au domaine de l&#8217;emploi en Finlande.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Les citoyens extracommunautaires peuvent travailler en Finlande sans permis de s\u00e9jour pendant 90 jours sur une p\u00e9riode de 180 jours. Cette exemption s&#8217;applique aux travailleurs, employ\u00e9s dans un \u00c9tat membre de l&#8217;UE\/EEE, qui se rendent en Finlande pour une prestation de services de courte dur\u00e9e, employ\u00e9s depuis au moins 3 mois par l&#8217;entreprise \u00e9trang\u00e8re. En tout \u00e9tat de cause, la p\u00e9riode totale de prestation de services ne doit pas d\u00e9passer 6 mois. <\/p>\n\n\n\n<p class=\"has-text-align-left\">Si le s\u00e9jour ou le travail en Finlande doit se prolonger au-del\u00e0 de 90 jours, il sera n\u00e9cessaire de demander un permis de s\u00e9jour. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"socialsecurity\">S\u00e9curit\u00e9 sociale en Finlande <\/h2>\n\n\n\n<p class=\"has-text-align-left\">Conform\u00e9ment au <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/en\/TXT\/?uri=CELEX:02004R0883-20140101\">R\u00e8glement europ\u00e9en 883\/2004<\/a>, les travailleurs d\u00e9tach\u00e9s dans un \u00c9tat membre de l&#8217;UE peuvent continuer \u00e0 verser leurs cotisations sociales \u00e0 l&#8217;\u00c9tat membre dans lequel ils sont employ\u00e9s.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Sur cette base, les entreprises d\u00e9tachantes qui envoient leurs employ\u00e9s en Finlande peuvent demander, aupr\u00e8s de leur organisme de s\u00e9curit\u00e9 sociale comp\u00e9tent, la d\u00e9livrance du <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a>.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Ce formulaire peut \u00eatre demand\u00e9 pour chaque mission ou avoir une dur\u00e9e maximale de 12 mois. De plus, le travailleur devra avoir avec lui le Formulaire A1 pendant toute la dur\u00e9e de sa mission en Finlande. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-obligations-en-matiere-de-sante-et-de-securite-au-travail\">Obligations en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 au travail<\/h2>\n\n\n\n<p>Une autre obligation de l&#8217;employeur est de fournir des soins de sant\u00e9 au travail \u00e0 ses employ\u00e9s d\u00e9tach\u00e9s en Finlande, ind\u00e9pendamment de la taille de l&#8217;entreprise ou de la dur\u00e9e de la relation de travail. Cela se fait par la conclusion de ce qu&#8217;on appelle l&#8217;<strong>Accord de soins de sant\u00e9 au travail<\/strong> (abr\u00e9g\u00e9 en &#8220;OHC Agreement&#8221;).<\/p>\n\n\n\n<p>Pour plus class=\"wp-block-heading\" id=\"penalties\">Sanctions en cas de non-respect des obligations finlandaises dans le cadre du d\u00e9tachement des travailleurs <\/h2>\n\n\n\n<p class=\"has-text-align-left\">Si une entreprise d\u00e9tachante ne respecte pas toutes les obligations pr\u00e9vues, elle sera sanctionn\u00e9e par une amende pouvant aller de 1 000 \u00e0 10 000 euros. <\/p>\n\n\n\n<p class=\"has-text-align-left\">Les cas dans lesquels une sanction est pr\u00e9vue pour l&#8217;entreprise d\u00e9tachante sont les suivants : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Non-transmission de la d\u00e9claration de d\u00e9tachement pr\u00e9alable ou non-respect des d\u00e9lais obligatoires pour l&#8217;envoi de la d\u00e9claration ; <\/li>\n\n\n\n<li>Non-mise \u00e0 jour de la notification en cas de modifications ; <\/li>\n\n\n\n<li>Non-d\u00e9signation d&#8217;un repr\u00e9sentant en Finlande ou inaptitude du repr\u00e9sentant d\u00e9sign\u00e9 \u00e0 remplir sa mission ; <\/li>\n\n\n\n<li>Non-conservation et archivage des documents n\u00e9cessaires pour permettre aux autorit\u00e9s comp\u00e9tentes en mati\u00e8re de SST
