Le r\u00e8glement vise uniquement \u00e0 fournir des \u00e9claircissements n\u00e9cessaires sur les d\u00e9finitions et les protections suppl\u00e9mentaires par rapport \u00e0 la transposition en Irlande de la <a href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\">Directive 2014\/67\/UE<\/a>, concernant l&#8217;application de la <a href=\"https:\/\/arlettipartners.com\/directive-96-71-ce-conditions-de-travail-equitables-au-dela-des-frontieres-nationales\/?lang=fr\">Directive 96\/71\/CE<\/a> relative au d\u00e9tachement des travailleurs dans le cadre d&#8217;une prestation de services, \u00e0 savoir le S.I. 412\/2016.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour un aper\u00e7u complet de toutes les directives de l&#8217;UE en la mati\u00e8re, consultez notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">Directives de l&#8217;UE concernant le d\u00e9tachement des travailleurs.<\/a><\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"requirement\">Obligations pr\u00e9liminaires pour les prestataires de services \u00e9trangers en cas de d\u00e9tachement de travailleurs en Irlande <\/h2>\n\n<p class=\"has-text-align-left\">La Workplace Relations Commission (WRC) est l&#8217;autorit\u00e9 comp\u00e9tente en Irlande pour les questions relatives au d\u00e9tachement des travailleurs. Les prestataires de services \u00e9trangers doivent notifier la WRC, en utilisant un formulaire pr\u00e9d\u00e9fini, du d\u00e9tachement de leurs travailleurs, quelle que soit sa dur\u00e9e. Le formulaire de d\u00e9claration doit \u00eatre envoy\u00e9 par courrier ou par e-mail \u00e0 la WRC au plus tard \u00e0 la date de d\u00e9but des travaux en Irlande. <\/p>\n\n<p class=\"has-text-align-left\">Par la d\u00e9claration de d\u00e9tachement, les entreprises \u00e9trang\u00e8res fournissent certaines informations, telles que l&#8217;adresse de l&#8217;entreprise de d\u00e9tachement, l&#8217;adresse du chantier o\u00f9 les travaux seront effectu\u00e9s, les donn\u00e9es personnelles du ou des travailleurs d\u00e9tach\u00e9s, etc. <\/p>\n\n<p class=\"has-text-align-left\">En outre, l&#8217;entreprise d\u00e9tachante est tenue d&#8217;indiquer le nom et l&#8217;adresse de la personne d\u00e9sign\u00e9e pour maintenir le contact avec l&#8217;autorit\u00e9 comp\u00e9tente, pour recevoir les demandes d&#8217;informations de la WRC, et pour envoyer\/recevoir des informations et documents en cas d&#8217;inspection. <\/p>\n\n<p class=\"has-text-align-left\"> Enfin, si le d\u00e9tachement doit \u00eatre prolong\u00e9 au-del\u00e0 de la date de fin indiqu\u00e9e dans la d\u00e9claration transmise \u00e0 la WRC, il est n\u00e9cessaire de transmettre une d\u00e9claration suppl\u00e9mentaire, contenant la nouvelle date de fin du d\u00e9tachement. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"conditions\">Conditions de travail et salariales en Irlande <\/h2>\n\n<p class=\"has-text-align-left\">Les directives de l&#8217;UE sur le d\u00e9tachement des travailleurs pr\u00e9voient qu&#8217;un travailleur d\u00e9tach\u00e9 sur le territoire d&#8217;un \u00c9tat membre doit b\u00e9n\u00e9ficier des conditions de travail et d&#8217;emploi garanties par la l\u00e9gislation de cet \u00c9tat membre. <\/p>\n\n<p class=\"has-text-align-left\">En Irlande, un travailleur d\u00e9tach\u00e9 a ainsi droit \u00e0 un salaire minimum, \u00e0 une semaine de travail moyenne ne d\u00e9passant pas 48 heures, \u00e0 une p\u00e9riode de repos quotidien de 11 heures cons\u00e9cutives, \u00e0 une p\u00e9riode de repos hebdomadaire de 24 heures cons\u00e9cutives par p\u00e9riode de sept jours, et \u00e0 une pause de 30 minutes toutes les six heures cons\u00e9cutives de travail.  <\/p>\n\n<p class=\"has-text-align-left\">En ce qui concerne les conditions salariales, l&#8217;Irlande a \u00e9tabli un salaire minimum national juridiquement contraignant (NMW) depuis 2000, qui d\u00e9pend de l&#8217;\u00e2ge du travailleur. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><\/p>\n<cite>\u00c0 partir du 1er janvier 2024, le <a href=\"https:\/\/arlettipartners.com\/irish-minimum-wage-increase-2024\/\">salaire minimum national en Irlande<\/a> pour les employ\u00e9s de plus de 20 ans est fix\u00e9 \u00e0 12,70 \u20ac\/heure. L&#8217;augmentation s&#8217;applique \u00e9galement, selon diff\u00e9rentes tranches, aux travailleurs de 19 ans, 18 ans et moins de 18 ans.<\/cite><\/blockquote>\n\n<p class=\"has-text-align-left\">Les indemnit\u00e9s sp\u00e9cifiques pour le d\u00e9tachement peuvent \u00eatre consid\u00e9r\u00e9es comme faisant partie de la r\u00e9mun\u00e9ration, \u00e0 condition qu&#8217;elles ne soient pas destin\u00e9es \u00e0 rembourser les frais de voyage, de nourriture et de logement.<\/p>\n\n<p class=\"has-text-align-left\">De plus, pour certains secteurs, il existe des accords qui \u00e9tablissent des termes et conditions sp\u00e9cifiques pour les employ\u00e9s couverts par ces accords (par exemple, dans le secteur du nettoyage et de la s\u00e9curit\u00e9). <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"documents\">Conservation des documents de d\u00e9tachement <\/h2>\n\n<p class=\"has-text-align-left\">Selon la l\u00e9gislation irlandaise, une entreprise \u00e9trang\u00e8re est tenue de conserver et de mettre \u00e0 disposition en un lieu identifi\u00e9 certains documents, au format papier ou \u00e9lectronique, pendant la dur\u00e9e du d\u00e9tachement, \u00e0 savoir : <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Le contrat de travail du ou des travailleurs d\u00e9tach\u00e9s ; <\/li>\n\n\n\n<li>Les fiches de paie ou documents \u00e9quivalents ; <\/li>\n\n\n\n<li>Les feuilles de temps ou documents \u00e9quivalents, indiquant le d\u00e9but, la fin et la dur\u00e9e du temps de travail quotidien, et <\/li>\n\n\n\n<li>La preuve du paiement des salaires. <\/li>\n<\/ul>\n\n<p class=\"has-text-align-left\">En cas d&#8217;inspection, l&#8217;employeur doit fournir \u00e0 l&#8217;autorit\u00e9 comp\u00e9tente les documents susmentionn\u00e9s, si n\u00e9cessaire, traduits en anglais. Le d\u00e9lai pour fournir tous les documents demand\u00e9s est d&#8217;un mois \u00e0 compter de la r\u00e9ception de la demande. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"noneu\">Travailleurs ressortissants de pays tiers en Irlande <\/h2>\n\n<p class=\"has-text-align-left\">Un citoyen non communautaire qui r\u00e9side et travaille l\u00e9galement dans un autre \u00c9tat membre de l&#8217;UE peut \u00eatre autoris\u00e9 \u00e0 travailler temporairement en Irlande sans avoir besoin d&#8217;obtenir un permis de travail. Cependant, les dispositions nationales en mati\u00e8re d&#8217;immigration doivent \u00e9galement \u00eatre prises en compte. En R\u00e9publique d&#8217;Irlande, il existe <a href=\"https:\/\/arlettipartners.com\/extra-eu-workers-posted-to-ireland-requirements-posting-third-country-workers-employed-in-italy\/\">cinq types de permis diff\u00e9rents<\/a>, utilis\u00e9s dans des cas sp\u00e9cifiques.<\/p>\n\n<p class=\"has-text-align-left\">Dans le cas de travailleurs extracommunautaires envoy\u00e9s en Irlande \u00e0 court terme (plus de 14 jours sur une p\u00e9riode de 12 mois), le type de permis le plus appropri\u00e9 pourrait \u00eatre le visa dit Van der Elst. Cependant, certaines conditions doivent \u00eatre remplies. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"socialsecurity\">S\u00e9curit\u00e9 sociale en Irlande <\/h2>\n\n<p class=\"has-text-align-left\">En vertu du <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:02004R0883-20140101&amp;from=EN\">r\u00e8glement europ\u00e9en (CE) n\u00b0 883\/2004<\/a>, les travailleurs d\u00e9tach\u00e9s en Irlande peuvent continuer \u00e0 \u00eatre couverts par la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 se trouve le si\u00e8ge de l&#8217;employeur.<\/p>\n\n<p class=\"has-text-align-left\">\u00c0 cet \u00e9gard, l&#8217;entreprise d\u00e9tachante doit demander le <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">certificat A1<\/a> \u00e0 l&#8217;institution de s\u00e9curit\u00e9 sociale comp\u00e9tente pour le travailleur d\u00e9tach\u00e9, qui devra le conserver pendant toute la dur\u00e9e de son d\u00e9tachement en Irlande.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"penalties\">Sanctions applicables en cas de non-conformit\u00e9 selon la l\u00e9gislation nationale <\/h2>\n\n<p class=\"has-text-align-left\">Les travailleurs d\u00e9tach\u00e9s en Irlande depuis d&#8217;autres \u00c9tats membres de l&#8217;UE b\u00e9n\u00e9ficient de la protection de la l\u00e9gislation irlandaise en mati\u00e8re d&#8217;emploi, au m\u00eame titre que les employ\u00e9s ayant un contrat de travail irlandais. En effet, la loi <a href=\"https:\/\/www.irishstatutebook.ie\/eli\/2001\/act\/45\/enacted\/en\/print?printonload=true\">Protection of Employees (Part-Time Work) Act<\/a> de 2001 stipule que la l\u00e9gislation du travail conf\u00e9rant des droits ou des pouvoirs \u00e0 un employ\u00e9 s&#8217;applique \u00e0 un travailleur d\u00e9tach\u00e9 de la m\u00eame mani\u00e8re qu&#8217;\u00e0 tout autre employ\u00e9.<\/p>\n\n<p class=\"has-text-align-left\">Toute violation de cette l\u00e9gislation peut entra\u00eener des sanctions. Parmi celles-ci, l&#8217;absence de d\u00e9claration de d\u00e9tachement constitue une infraction p\u00e9nale. En cas de condamnation sommaire, une amende pouvant aller jusqu&#8217;\u00e0 5 000 euros peut \u00eatre inflig\u00e9e. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Aper\u00e7u des exigences,
