En renfor\u00e7ant la coop\u00e9ration entre Chypre et les autres \u00c9tats membres, cette directive <strong>facilite l&#8217;\u00e9change d&#8217;informations<\/strong> et de bonnes pratiques, favorisant une approche plus harmonis\u00e9e du <a href=\"https:\/\/arlettipartners.com\/detachement-de-travailleurs-dans-lue\/?lang=fr\">d\u00e9tachement des travailleurs au sein de l&#8217;UE.<\/a><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-preliminary-obligations-when-posting-workers-to-cyprus-nbsp\">Obligations pr\u00e9liminaires pour le d\u00e9tachement de travailleurs \u00e0 Chypre   <\/h2>\n\n<p>Aux fins de l&#8217;application effective de la loi, le <strong>prestataire de services \u00e9tranger est tenu de soumettre<\/strong> au D\u00e9partement du travail une s\u00e9rie de documents, en grec ou en anglais.<\/p>\n\n<p>Les documents suivants peuvent \u00eatre soumis par email, fax ou par courrier, <strong>avant le d\u00e9but<\/strong> de la prestation de services :<\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>D\u00e9claration \u00e9crite<\/strong> contenant les informations suivantes :\n<ul class=\"wp-block-list\">\n<li><strong>Nom de l&#8217;entreprise<\/strong>, <strong>adresse<\/strong> de son si\u00e8ge et <strong>statut juridique<\/strong> ;<\/li>\n\n\n\n<li>Nom du <strong>repr\u00e9sentant l\u00e9gal<\/strong> et du <strong>repr\u00e9sentant sur le territoire chypriote<\/strong>, si pr\u00e9sent ;<\/li>\n\n\n\n<li><strong>Adresse<\/strong> o\u00f9 les travailleurs d\u00e9tach\u00e9s fourniront les services et nom, adresse et statut juridique des <strong>entreprises recevant les services<\/strong> ;<\/li>\n\n\n\n<li><strong>Date de d\u00e9but<\/strong> du d\u00e9tachement et <strong>dur\u00e9e<\/strong> possible ;<\/li>\n\n\n\n<li>Nature de <strong>l&#8217;activit\u00e9<\/strong> \u00e9conomique.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Liste des travailleurs d\u00e9tach\u00e9s (<strong>nom et pr\u00e9nom, num\u00e9ro de passeport, profession<\/strong>) ;<\/li>\n\n\n\n<li>Nom de la <strong>personne de liaison<\/strong> avec les autorit\u00e9s comp\u00e9tentes ;<\/li>\n\n\n\n<li>Nom de la personne de contact qui agit comme <strong>repr\u00e9sentant pour la n\u00e9gociation collective<\/strong> pendant le d\u00e9tachement.<\/li>\n<\/ol>\n\n<p>En cas de <strong>modification<\/strong> des informations ci-dessus, les entreprises sont tenues de soumettre une <strong>d\u00e9claration suppl\u00e9mentaire<\/strong> dans un <strong>d\u00e9lai de 15 jours<\/strong> suivant la modification.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-working-and-salary-conditions-in-cyprus-nbsp\">Conditions de travail et salariales \u00e0 Chypre   <\/h2>\n\n<p>Les employeurs doivent s&#8217;assurer que les travailleurs d\u00e9tach\u00e9s b\u00e9n\u00e9ficient des <strong>m\u00eames conditions de travail minimales que les travailleurs employ\u00e9s<\/strong> \u00e0 Chypre. Cette directive se concentre sur l&#8217;am\u00e9lioration des conditions de travail des travailleurs d\u00e9tach\u00e9s, en particulier dans les secteurs caract\u00e9ris\u00e9s par un travail temporaire ou saisonnier. <\/p>\n\n<p>\u00c0 Chypre, la directive 2018\/957\/UE apporte des <strong>changements significatifs<\/strong>, notamment en ce qui concerne la <strong>dur\u00e9e<\/strong> des d\u00e9tachements et les droits des travailleurs d\u00e9tach\u00e9s \u00e0 <strong>long terme<\/strong>. Les employeurs sont d\u00e9sormais tenus de fournir des avantages et des droits suppl\u00e9mentaires aux travailleurs d\u00e9tach\u00e9s pour des p\u00e9riodes prolong\u00e9es, garantissant qu&#8217;ils ne soient pas d\u00e9savantag\u00e9s par rapport aux employ\u00e9s locaux.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-storage-of-the-posting-documents\">Conservation des documents de d\u00e9tachement   <\/h2>\n\n<p>\u00c0 Chypre, le lieu d\u00e9sign\u00e9 pour <strong>l&#8217;archivage de tous les documents pertinents<\/strong> relatifs aux travailleurs d\u00e9tach\u00e9s est le lieu de travail.<\/p>\n\n<p>En g\u00e9n\u00e9ral, les documents \u00e0 conserver comprennent : <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Contrat<\/strong> de travail (ou document \u00e9quivalent) ;<\/li>\n\n\n\n<li>Bulletins de <strong>paie r\u00e9cents<\/strong> du travailleur d\u00e9tach\u00e9 \u00e0 Chypre ;<\/li>\n\n\n\n<li>Feuilles de <strong>pr\u00e9sence<\/strong> ;<\/li>\n\n\n\n<li>Preuve du <strong>paiement du salaire<\/strong> ;<\/li>\n\n\n\n<li><a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaires A1<\/a> ;<\/li>\n\n\n\n<li><strong>Certificats d&#8217;aptitude<\/strong> au travail.<\/li>\n<\/ul>\n\n<p>Lors des <strong>inspections<\/strong>, les employeurs sont tenus de fournir \u00e0 l&#8217;autorit\u00e9 comp\u00e9tente les <strong>documents<\/strong> susmentionn\u00e9s en langue chypriote.<\/p>\n\n<p>Les d\u00e9lais pour la fourniture de ces documents peuvent varier selon la demande formelle de l&#8217;inspecteur. En outre, ces <strong>documents doivent rester accessibles<\/strong> pendant une p\u00e9riode minimale de <strong>deux ans apr\u00e8s la conclusion<\/strong> de la mission.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-non-eu-citizen-workers-posted-to-cyprus\">Travailleurs extracommunautaires d\u00e9tach\u00e9s \u00e0 Chypre   <\/h2>\n\n<p>En g\u00e9n\u00e9ral, l&#8217;entr\u00e9e \u00e0 Chypre est autoris\u00e9e aux citoyens de pays tiers poss\u00e9dant des permis d\u00e9livr\u00e9s par des pays de l&#8217;UE. Toutefois, d&#8217;autres activit\u00e9s, telles que l&#8217;exercice d&#8217;activit\u00e9s professionnelles et la prestation de services, sont interdites. En particulier, <strong>les travailleurs extracommunautaires ne sont pas autoris\u00e9s \u00e0 entreprendre des activit\u00e9s productives \u00e0 Chypre<\/strong> \u00e0 moins de disposer d&#8217;un visa ou d&#8217;un <strong>permis de travail chypriote<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-social-security\">S\u00e9curit\u00e9 sociale \u00e0 Chypre   <\/h2>\n\n<p>En vertu du r\u00e8glement europ\u00e9en 883\/2004, les travailleurs d\u00e9tach\u00e9s \u00e0 Chypre peuvent continuer \u00e0 \u00eatre couverts par la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 l&#8217;employeur est \u00e9tabli. <\/p>\n\n<p>Pour certifier cela, la soci\u00e9t\u00e9 d\u00e9tachante doit demander un certificat A1. L&#8217;institution sociale comp\u00e9tente le d\u00e9livrera une fois toutes les informations n\u00e9cessaires re\u00e7ues. <\/p>\n\n<p>Le formulaire A1 peut avoir une <strong>dur\u00e9e maximale de 24 mois<\/strong>. De plus, le travailleur doit le conserver pendant toute la p\u00e9riode de son d\u00e9tachement \u00e0 Chypre.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-penalties-in-case-of-non-compliance-with-cypriot-obligations-when-posting-workers\">Sanctions en cas de non-respect des obligations chypriotes dans le d\u00e9tachement des travailleurs   <\/h2>\n\n<p>Si l&#8217;autorit\u00e9 comp\u00e9tente d\u00e9tecte une violation des dispositions pr\u00e9vues par la l\u00e9gislation susmentionn\u00e9e, un comit\u00e9 gouvernemental compos\u00e9 de trois membres a l&#8217;autorit\u00e9 d&#8217;imposer des amendes <strong>administratives allant jusqu&#8217;\u00e0 10 000<\/strong> \u20ac. En cas de <strong>violations r\u00e9currentes<\/strong>, le comit\u00e9 a la facult\u00e9 d&#8217;imposer des amendes administratives allant <strong>jusqu&#8217;\u00e0 20 000 \u20ac.<\/strong><\/p>\n\n<p>En outre, toute personne ayant enfreint ou manqu\u00e9 de se conformer aux dispositions de ladite l\u00e9gislation est consid\u00e9r\u00e9e comme coupable d&#8217;un d\u00e9lit. En cas de condamnation, ces personnes peuvent \u00eatre passibles d&#8217;une peine <strong>d&#8217;emprisonnement ne d\u00e9passant pas deux ans<\/strong> ou d&#8217;une amende
