{"id":179751,"date":"2024-04-15T10:28:16","date_gmt":"2024-04-15T08:28:16","guid":{"rendered":"https:\/\/arlettipartners.com\/detachement-de-travailleurs-a-malte\/"},"modified":"2025-12-05T09:44:56","modified_gmt":"2025-12-05T08:44:56","slug":"detachement-de-travailleurs-a-malte","status":"publish","type":"post","link":"https:\/\/arlettipartners.com\/fr\/detachement-de-travailleurs-a-malte\/","title":{"rendered":"D\u00e9tachement de travailleurs \u00e0 Malte"},"content":{"rendered":"\n<p>La l\u00e9gislation sur le d\u00e9tachement des travailleurs \u00e0 Malte est r\u00e9gie par la L\u00e9gislation subsidiaire 452.82, intitul\u00e9e \u00ab Posting of Workers in Malta Regulations \u00bb et modifi\u00e9e par l&#8217;Avis juridique 262 de 2020. <\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><p>La l\u00e9gislation maltaise sur le d\u00e9tachement vise \u00e0 donner effet aux <a data-mce-href=\"https:\/\/arlettipartners.com\/fr\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\" href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">directives de l&#8217;UE sur le d\u00e9tachement<\/a>, notamment les <a data-mce-href=\"https:\/\/arlettipartners.com\/fr\/directive-96-71-ce-conditions-de-travail-equitables-au-dela-des-frontieres-nationales\/?lang=fr\" href=\"https:\/\/arlettipartners.com\/directive-96-71-ce-conditions-de-travail-equitables-au-dela-des-frontieres-nationales\/?lang=fr\">directives 96\/71\/CE<\/a>, <a data-mce-href=\"https:\/\/arlettipartners.com\/fr\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\" href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\">2014\/67\/UE<\/a> et 2018\/597.<\/p><\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"h-preliminary-obligations-when-posting-workers-to-malta\">Obligations pr\u00e9liminaires pour le d\u00e9tachement des travailleurs \u00e0 Malte   <\/h2>\n\n<p>Pour chaque d\u00e9tachement \u00e0 Malte, l&#8217;entreprise d\u00e9tachante est tenue de notifier le D\u00e9partement des relations industrielles et du travail (DIER). <\/p>\n\n<p>Le <strong>formulaire de notification<\/strong> doit \u00eatre re\u00e7u par le D\u00e9partement des relations industrielles et du travail <strong>avant le d\u00e9but du d\u00e9tachement<\/strong>. Le formulaire doit \u00eatre accompagn\u00e9 d&#8217;une copie du <strong>contrat de travail du travailleur d\u00e9tach\u00e9<\/strong> (avec l&#8217;entreprise d\u00e9tachante) et, dans le cas d&#8217;un employ\u00e9 non communautaire d\u00e9tach\u00e9 par un pays de l&#8217;UE\/EEE, d&#8217;une copie de <strong>son titre de s\u00e9jour.<\/strong><\/p>\n\n<p>L&#8217;<strong>entreprise qui utilise les services<\/strong> du travailleur d\u00e9tach\u00e9 est <strong>tenue de conserver une copie<\/strong> de ce formulaire de notification sur le lieu de travail aux fins de contr\u00f4le par les inspecteurs du DIER.<\/p>\n\n<p>L&#8217;entreprise d\u00e9tachante doit <strong>d\u00e9signer une personne de contact qui agira en tant que repr\u00e9sentant \u00e0 Malte<\/strong>. Par l&#8217;interm\u00e9diaire de ce repr\u00e9sentant, les partenaires sociaux peuvent tenter de contraindre le prestataire de services \u00e0 conclure la convention collective pendant la p\u00e9riode o\u00f9 les services sont fournis. Cette personne de contact n&#8217;est pas oblig\u00e9e d&#8217;\u00eatre pr\u00e9sente \u00e0 Malte, mais elle doit \u00eatre disponible sur demande raisonnable et justifi\u00e9e.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-working-and-salary-conditions-in-malta\">Conditions de travail et salariales \u00e0 Malte   <\/h2>\n\n<p>Les travailleurs d\u00e9tach\u00e9s doivent b\u00e9n\u00e9ficier des <strong>m\u00eames conditions de travail et des m\u00eames droits que les travailleurs<\/strong> locaux \u00e0 Malte, y compris en ce qui concerne la <strong>dur\u00e9e maximale du travail<\/strong>, les p\u00e9riodes minimales de <strong>repos<\/strong> et les normes de <strong>sant\u00e9 et de s\u00e9curit\u00e9<\/strong>.<\/p>\n\n<p>Les travailleurs d\u00e9tach\u00e9s \u00e0 Malte ne doivent pas travailler plus que le <strong>nombre maximal d&#8217;heures<\/strong> autoris\u00e9 par semaine, comme stipul\u00e9 dans les lois maltaises sur le travail. En g\u00e9n\u00e9ral, il s&#8217;agit d&#8217;environ <strong>48 heures par semaine<\/strong>, bien que des dispositions pr\u00e9voient des variations, telles que la moyenne sur une p\u00e9riode de r\u00e9f\u00e9rence.<\/p>\n\n<p>Les travailleurs d\u00e9tach\u00e9s ont droit \u00e0 des <strong>p\u00e9riodes de repos minimales<\/strong>, comme pr\u00e9vu par les r\u00e9glementations maltaises, pour garantir un temps ad\u00e9quat pour le repos et la r\u00e9cup\u00e9ration.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les normes minimales en mati\u00e8re de temps de travail et de repos sont \u00e9tablies au niveau europ\u00e9en par la <a href=\"https:\/\/arlettipartners.com\/directive-2003-88-ce-temps-de-travail-sur-le-marche-europeen\/?lang=fr\">Directive 2003\/88\/CE.<\/a><\/p>\n<\/blockquote>\n\n<p>Les employeurs sont \u00e9galement tenus de fournir un <strong>environnement de travail s\u00fbr<\/strong> aux travailleurs d\u00e9tach\u00e9s \u00e0 Malte. Cela inclut le respect des normes en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9, la fourniture des \u00e9quipements de s\u00e9curit\u00e9 n\u00e9cessaires et la garantie que les risques sur le lieu de travail sont identifi\u00e9s et r\u00e9duits.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-storage-of-the-posting-documents-nbsp\">Conservation des documents de d\u00e9tachement   <\/h2>\n\n<p>Tous les documents relatifs au d\u00e9tachement de l&#8217;employ\u00e9 et des entreprises concern\u00e9es doivent \u00eatre conserv\u00e9s et mis \u00e0 la disposition de l&#8217;autorit\u00e9 maltaise pour \u00eatre pr\u00e9sent\u00e9s rapidement en cas de demande formelle. <\/p>\n\n<p>Ces documents concernent g\u00e9n\u00e9ralement (mais pas exclusivement) : <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Le <strong>contrat de travail<\/strong> (ou son \u00e9quivalent) ;<\/li>\n\n\n\n<li>Les bulletins de <strong>paie relatifs<\/strong> au d\u00e9tachement \u00e0 Malte ;<\/li>\n\n\n\n<li>Les <strong>relev\u00e9s d&#8217;heures<\/strong> ;<\/li>\n\n\n\n<li>La preuve du <strong>paiement du salaire<\/strong> ;<\/li>\n\n\n\n<li>Les <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">formulaires A1<\/a> ;<\/li>\n\n\n\n<li>Les <strong>certificats d&#8217;aptitude<\/strong> au travail.<\/li>\n<\/ul>\n\n<p>Le <strong>prestataire de services qui d\u00e9tache un travailleur<\/strong> \u00e0 Malte est tenu de <strong>mettre \u00e0 disposition et de conserver des copies<\/strong>, sous format papier ou \u00e9lectronique, des documents susmentionn\u00e9s pendant la p\u00e9riode de d\u00e9tachement, dans un endroit accessible et clairement identifi\u00e9 de l&#8217;entreprise qui utilise les services du travailleur d\u00e9tach\u00e9.<\/p>\n\n<p>L&#8217;entreprise d\u00e9tachante a <strong>l&#8217;obligation de fournir les documents apr\u00e8s la p\u00e9riode de d\u00e9tachement<\/strong>, sur demande de l&#8217;autorit\u00e9 comp\u00e9tente \u00e0 Malte, dans un d\u00e9lai raisonnable, et de les traduire en anglais.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-social-security-for-workers-posted-to-malta\">S\u00e9curit\u00e9 sociale pour les travailleurs d\u00e9tach\u00e9s \u00e0 Malte   <\/h2>\n\n<p>Conform\u00e9ment au R\u00e8glement europ\u00e9en 883\/2004, les travailleurs d\u00e9tach\u00e9s \u00e0 Malte peuvent <strong>conserver la couverture du syst\u00e8me de s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 leur employeur est \u00e9tabli.<\/strong><\/p>\n\n<p>\u00c0 cette fin, l&#8217;entreprise de d\u00e9tachement est tenue de <strong>demander le formulaire A1<\/strong>, qui sera d\u00e9livr\u00e9 par l&#8217;institution sociale comp\u00e9tente apr\u00e8s avoir re\u00e7u toutes les informations requises. Le certificat A1 est valable pour une dur\u00e9e maximale de 24 mois et il est indispensable que le travailleur en soit muni pendant toute la dur\u00e9e de son d\u00e9tachement \u00e0 Malte.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-non-compliance-with-maltese-obligations-regarding-posted-workers-nbsp-nbsp\">Non-respect des obligations maltaises en mati\u00e8re de d\u00e9tachement de travailleurs   <\/h2>\n\n<p>Les travailleurs d\u00e9tach\u00e9s \u00e0 Malte, s&#8217;ils estiment qu&#8217;il y a eu une violation de leurs droits, ont le droit de pr\u00e9senter une demande <strong>formelle \u00e9crite \u00e0 leur employeur,<\/strong> demandant une d\u00e9claration expliquant les raisons de toute disparit\u00e9 de traitement. Cette d\u00e9claration doit \u00eatre fournie dans un d\u00e9lai de dix jours \u00e0 compter de la demande du travailleur.<\/p>\n\n<p>De plus, le travailleur d\u00e9tach\u00e9 peut <strong>contacter le D\u00e9partement des relations industrielles et de l&#8217;emploi (DIER)<\/strong> pour signaler toute violation de ses droits au travail. Le DIER m\u00e8nera une enqu\u00eate sur la question et, si justifi\u00e9, engagera des poursuites judiciaires, y compris p\u00e9nales.<\/p>\n\n<p>En outre, ind\u00e9pendamment de tout autre droit l\u00e9gal d&#8217;engager une action en justice dans un autre \u00c9tat membre de l&#8217;UE, le travailleur d\u00e9tach\u00e9 a \u00e9galement la possibilit\u00e9 de saisir les tribunaux maltais pour les violations de ses droits en vertu des Posting of Workers in Malta Regulations (S.L.452.82). L&#8217;action en justice peut \u00eatre engag\u00e9e m\u00eame apr\u00e8s la fin de la mission de d\u00e9tachement ou la cessation du contrat de travail.
