La d\u00e9claration pr\u00e9cise la nature du travail que les travailleurs d\u00e9tach\u00e9s effectueront en Estonie. Le repr\u00e9sentant d\u00e9sign\u00e9 ne doit <strong>pas n\u00e9cessairement \u00eatre domicili\u00e9 en Estonie<\/strong>, mais doit \u00eatre disponible pendant toute la dur\u00e9e du d\u00e9tachement.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-storage-of-the-posting-documents\">Conservation des documents de d\u00e9tachement<\/h2>\n\n<p><p>L&#8217;Inspection du Travail estonienne a le droit de demander la pr\u00e9sentation des documents de d\u00e9tachement pendant une p\u00e9riode de <strong>trois ans apr\u00e8s la fin<\/strong> du d\u00e9tachement des travailleurs en Estonie.<\/p><\/p>\n\n<p>\u00c0 la demande de l&#8217;Inspection du Travail, l&#8217;entreprise d\u00e9tachante est tenue de pr\u00e9senter \u00e0 l&#8217;Inspection les documents n\u00e9cessaires \u00e0 l&#8217;ex\u00e9cution de la surveillance administrative.&#13;\n&#13;\n<\/p>\n\n<p><p>La liste des <strong>documents qui peuvent \u00eatre demand\u00e9s<\/strong> comprend :<\/p><\/p>\n\n<ul class=\"wp-block-list\">\n<li><p><strong>Contrat<\/strong> de travail ;<\/p><\/li>\n\n\n\n<li><p><a data-mce-href=\"\/?p=175707&amp;lang=fr\" href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Certificat A1<\/a> ;<\/p><\/li>\n\n\n\n<li><p>Registres de <strong>pr\u00e9sence<\/strong> ;<\/p><\/li>\n\n\n\n<li>Extrait relatif au <strong>paiement des salaires<\/strong> ; ou<\/li>\n\n\n\n<li>Tout autre document pouvant \u00eatre utilis\u00e9 <strong>pour d\u00e9montrer le respect des termes et des conditions<\/strong> de travail applicables au travailleur d\u00e9tach\u00e9.<\/li>\n<\/ul>\n\n<p>Les documents sont accept\u00e9s en estonien, anglais et russe.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-working-and-salary-conditions-in-estonia\">Conditions de travail et salariales en Estonie<\/h2>\n\n<p>Il existe des normes et exigences sp\u00e9cifiques qui r\u00e9gissent les conditions de travail des travailleurs d\u00e9tach\u00e9s en Estonie.&#13;\n&#13;\n<\/p>\n\n<p>Les <strong>conditions de travail<\/strong> \u00e9tablies en Estonie et <strong>applicables \u00e0 un employ\u00e9 d\u00e9tach\u00e9<\/strong> incluent les dispositions relatives \u00e0 :<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Temps de travail<\/strong> ;<\/li>\n\n\n\n<li>P\u00e9riodes de <strong>repos<\/strong> ;<\/li>\n\n\n\n<li>R\u00e9mun\u00e9ration et majoration pour <strong>heures suppl\u00e9mentaires<\/strong> ;<\/li>\n\n\n\n<li>Dur\u00e9e des <strong>cong\u00e9s annuels<\/strong> ;<\/li>\n\n\n\n<li><strong>\u00c9galit\u00e9 de traitement<\/strong> et \u00e9galit\u00e9 des <strong>chances<\/strong> ;<\/li>\n\n\n\n<li><strong>Normes de sant\u00e9, de s\u00e9curit\u00e9 et d&#8217;hygi\u00e8ne<\/strong> : Les employeurs doivent garantir un environnement de travail s\u00fbr et sain aux travailleurs d\u00e9tach\u00e9s en Estonie. Cela inclut le respect des normes de sant\u00e9 et de s\u00e9curit\u00e9, la fourniture des \u00e9quipements de s\u00e9curit\u00e9 n\u00e9cessaires et la mise en \u0153uvre de mesures pour pr\u00e9venir les accidents et les blessures au travail.<\/li>\n<\/ul>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les temps de repos, les heures de travail et les cong\u00e9s annuels sont r\u00e9glement\u00e9s au niveau de l&#8217;UE par la Directive 2003\/88\/CE.<\/p>\n<\/blockquote>\n\n<p>Si les dispositions des lois d&#8217;un \u00c9tat \u00e9tranger applicables \u00e0 un contrat de travail sont plus favorables \u00e0 un travailleur d\u00e9tach\u00e9 que les dispositions estoniennes, la disposition la plus favorable au travailleur sera appliqu\u00e9e.&#13;\n&#13;\n<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-posting-of-non-eu-workers-to-estonia-nbsp\">D\u00e9tachement de travailleurs extra-communautaires en Estonie<\/h2>\n\n<p>L&#8217;entr\u00e9e en <strong>Estonie des \u00e9trangers<\/strong> (\u00e0 l&#8217;exception des citoyens d&#8217;un \u00c9tat membre de l&#8217;UE\/EEE ou de la Conf\u00e9d\u00e9ration Suisse), leur s\u00e9jour et leur travail en Estonie sont r\u00e9gis par la Loi sur les \u00e9trangers.<\/p>\n\n<p>Les travailleurs d\u00e9tach\u00e9s pour travailler pour une autre entreprise en Estonie pour une p\u00e9riode de temps limit\u00e9e doivent \u00eatre <strong>enregistr\u00e9s aupr\u00e8s de la Police and Border Guard Board<\/strong> pour pouvoir travailler.<\/p>\n\n<p>Dans ce cas, la soci\u00e9t\u00e9 enregistr\u00e9e en Estonie doit demander leur enregistrement pour un emploi de <strong>courte dur\u00e9e<\/strong>. Cet enregistrement doit \u00eatre effectu\u00e9 avant le d\u00e9but du travail et <strong>permet de travailler pendant 365 jours sur une p\u00e9riode de 455 jours en Estonie.<\/strong><\/p>\n\n<p>En plus de la demande d&#8217;enregistrement pour un emploi de courte dur\u00e9e, l&#8217;employeur qui envoie les travailleurs d\u00e9tach\u00e9s doit transmettre la <strong>d\u00e9claration de d\u00e9tachement<\/strong> \u00e0 l&#8217;Inspection du Travail estonienne.<\/p>\n\n<p>Dans le cas d&#8217;une entreprise qui d\u00e9tache ses propres travailleurs en Estonie pour effectuer du <strong>travail en sous-traitance<\/strong>, les employ\u00e9s extra-communautaires doivent \u00eatre en possession d&#8217;un <strong>permis de s\u00e9jour\/travail<\/strong> d\u00e9livr\u00e9 par le pays de l&#8217;Union Europ\u00e9enne d&#8217;o\u00f9 provient l&#8217;entreprise.<\/p>\n\n<p>L&#8217;enregistrement du travail aupr\u00e8s de la Police and Border Guard Board doit \u00eatre effectu\u00e9 par l&#8217;entreprise d\u00e9tachante.&#13;\n&#13;\n<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-social-security-for-workers-posted-to-estonia-nbsp\">S\u00e9curit\u00e9 sociale pour les travailleurs d\u00e9tach\u00e9s en Estonie<\/h2>\n\n<p>Conform\u00e9ment au R\u00e8glement Europ\u00e9en 883\/2004, les travailleurs d\u00e9tach\u00e9s en Estonie peuvent continuer \u00e0 \u00eatre <strong>couverts par la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 est situ\u00e9 l&#8217;employeur.<\/strong><\/p>\n\n<p>L&#8217;entreprise d\u00e9tachante doit demander un <strong>certificat A1.<\/strong> L&#8217;institution sociale comp\u00e9tente le d\u00e9livrera une fois toutes les informations n\u00e9cessaires re\u00e7ues.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-penalties-in-the-case-of-non-compliance-nbsp-nbsp\">Sanctions en cas de non-conformit\u00e9<\/h2>\n\n<p>En cas de non-respect de l&#8217;obligation d&#8217;enregistrement des travailleurs d\u00e9tach\u00e9s en Estonie, l&#8217;Inspection du Travail se r\u00e9serve le droit d&#8217;imposer des sanctions.&#13;\n&#13;\n<\/p>\n\n<p>Ces sanctions peuvent <strong>s&#8217;\u00e9lever jusqu&#8217;\u00e0 32 000 \u20ac<\/strong> pour les personnes morales. De plus, l&#8217;Inspection du Travail est autoris\u00e9e \u00e0 divulguer les donn\u00e9es personnelles qui lui sont fournies pour faciliter l&#8217;ex\u00e9cution des t\u00e2ches assign\u00e9es
