{"id":179620,"date":"2024-05-03T16:28:24","date_gmt":"2024-05-03T14:28:24","guid":{"rendered":"https:\/\/arlettipartners.com\/detachement-des-travailleurs-en-lituanie\/"},"modified":"2025-12-05T10:56:18","modified_gmt":"2025-12-05T09:56:18","slug":"detachement-des-travailleurs-en-lituanie","status":"publish","type":"post","link":"https:\/\/arlettipartners.com\/fr\/detachement-des-travailleurs-en-lituanie\/","title":{"rendered":"D\u00e9tachement des Travailleurs en Lituanie"},"content":{"rendered":"\n<p>Conform\u00e9ment \u00e0 l&#8217;article 108 du Code du travail de la R\u00e9publique de Lituanie, un employ\u00e9 soumis \u00e0 la juridiction d&#8217;un pays \u00e9tranger peut \u00eatre d\u00e9tach\u00e9 pour travailler temporairement sur le territoire de la R\u00e9publique de Lituanie : <\/p>\n\n<ol class=\"wp-block-list\">\n<li>Sur la base d&#8217;un contrat de fourniture de services ou de travaux conclu par l&#8217;employeur avec un <strong>client op\u00e9rant en R\u00e9publique de Lituanie ;<\/strong><\/li>\n\n\n\n<li>Pour travailler dans une <strong>succursale<\/strong>, un <strong>bureau de repr\u00e9sentation,<\/strong> une entreprise appartenant au groupe ;<\/li>\n\n\n\n<li>En tant que <strong>travailleur int\u00e9rimaire<\/strong>.<\/li>\n<\/ol>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>D\u00e9couvrez-en plus sur la r\u00e9glementation de l&#8217;UE en mati\u00e8re de d\u00e9tachement dans notre guide sur les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">Directives de l&#8217;UE relatives au d\u00e9tachement.<\/a><\/p>\n<\/blockquote>\n\n<h2 class=\"wp-block-heading\" id=\"h-preliminary-obligations-when-posting-workers-to-lithuania\">Obligations pr\u00e9alables pour le d\u00e9tachement des travailleurs en Lituanie <\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-notification-of-posting\">Notification de d\u00e9tachement en Lituanie <\/h3>\n\n<p>Conform\u00e9ment \u00e0 la proc\u00e9dure \u00e9tablie par le ministre de la S\u00e9curit\u00e9 sociale et du Travail de la Lituanie, un <strong>employeur<\/strong> soumis \u00e0 la juridiction d&#8217;un pays \u00e9tranger <strong>qui d\u00e9tache un travailleur en Lituanie pour une p\u00e9riode sup\u00e9rieure \u00e0 30 jours<\/strong> ou pour effectuer des travaux de construction <a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">doit notifier \u00e0 l&#8217;avance<\/a> le bureau territorial de l&#8217;Inspection du travail de l&#8217;\u00c9tat o\u00f9 se d\u00e9rouleront les activit\u00e9s professionnelles.<\/p>\n\n<p>La <strong>notification<\/strong> de d\u00e9tachement en Lituanie doit \u00eatre transmise \u00e9lectroniquement et doit contenir des informations sur :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;employeur effectuant le d\u00e9tachement ; <\/li>\n\n\n\n<li>Les travailleurs d\u00e9tach\u00e9s ; <\/li>\n\n\n\n<li>La personne physique ou morale qui accueille le travailleur d\u00e9tach\u00e9 ; <\/li>\n\n\n\n<li>Le d\u00e9tachement et les conditions de travail applicables au travailleur d\u00e9tach\u00e9.<\/li>\n<\/ul>\n\n<p>En cas de <strong>modification<\/strong> des informations, l&#8217;employeur doit soumettre une <strong>rectification concernant<\/strong> les travailleurs d\u00e9tach\u00e9s \u00e0 l&#8217;Inspection du travail de l&#8217;\u00c9tat<strong> dans un d\u00e9lai d&#8217;un jou<\/strong>r ouvrable suivant la modification des conditions de d\u00e9tachement.<\/p>\n\n<p>Si un d\u00e9tachement initialement <strong>pr\u00e9vu pour une dur\u00e9e inf\u00e9rieure \u00e0 30 jours<\/strong>, et qui, de ce fait, n&#8217;avait pas \u00e9t\u00e9 notifi\u00e9, est <strong>prolong\u00e9 jusqu&#8217;\u00e0 d\u00e9passer un total de 30 jours<\/strong>, il doit \u00eatre signal\u00e9 par la suite pour toute la p\u00e9riode.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-liaison-person\">Personne de contact pour le d\u00e9tachement en Lituanie <\/h3>\n\n<p>De plus, conform\u00e9ment \u00e0 la <a href=\"https:\/\/arlettipartners.com\/detachements-transnationaux-la-directive-2014-67-ue\/?lang=fr\">Directive 2014\/67\/UE<\/a>, les employeurs qui d\u00e9tachent des travailleurs en Lituanie sont tenus de d\u00e9signer une <strong>personne de contact<\/strong>. Cette personne d\u00e9sign\u00e9e sert de point de contact central tant pour les autorit\u00e9s que pour les travailleurs d\u00e9tach\u00e9s, optimisant les canaux de communication et offrant le soutien n\u00e9cessaire. Cette exigence vise \u00e0 am\u00e9liorer la transparence et la responsabilit\u00e9, prot\u00e9geant en fin de compte les droits des travailleurs d\u00e9tach\u00e9s durant leur s\u00e9jour en Lituanie.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-working-and-salary-conditions-in-lithuania\">Conditions de travail et salariales en Lituanie <\/h2>\n\n<p>Les travailleurs d\u00e9tach\u00e9s en Lituanie ont droit \u00e0 une s\u00e9rie de conditions de travail minimales \u00e9tablies par la loi lituanienne. Ces conditions incluent divers aspects de l&#8217;emploi, tels que le <strong>temps de travail<\/strong>, les p\u00e9riodes de <strong>repos<\/strong>, les <strong>cong\u00e9s<\/strong> annuels et les normes de <strong>s\u00e9curit\u00e9 et de sant\u00e9<\/strong> au travail. Les employeurs qui d\u00e9tachent des travailleurs en Lituanie doivent veiller au respect de ces conditions minimales de travail pendant toute la dur\u00e9e du d\u00e9tachement.<\/p>\n\n<p>Selon la l\u00e9gislation lituanienne, la <strong>dur\u00e9e maximale du temps de travail hebdomadaire est de 40 heures<\/strong>, avec des dispositions pour les heures suppl\u00e9mentaires et les p\u00e9riodes de repos. Les travailleurs d\u00e9tach\u00e9s doivent b\u00e9n\u00e9ficier de pauses de repos ad\u00e9quates et de jours de cong\u00e9, conform\u00e9ment \u00e0 la r\u00e9glementation lituanienne du travail.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les normes sur le temps de travail sont \u00e9galement \u00e9tablies au niveau europ\u00e9en par la <a href=\"https:\/\/arlettipartners.com\/directive-2003-88-ce-temps-de-travail-sur-le-marche-europeen\/?lang=fr\">Directive 2003\/88\/CE.<\/a><\/p>\n<\/blockquote>\n\n<p>En outre, les employeurs doivent se conformer aux normes de s\u00e9curit\u00e9 et de sant\u00e9 au travail pour garantir un environnement de travail s\u00fbr aux travailleurs d\u00e9tach\u00e9s. Cela inclut la fourniture de la formation n\u00e9cessaire, des \u00e9quipements de protection individuelle et la mise en \u0153uvre de mesures pour pr\u00e9venir les accidents du travail et les maladies professionnelles. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-social-security-for-workers-posted-to-lithuania-nbsp-nbsp\">S\u00e9curit\u00e9 sociale pour les travailleurs d\u00e9tach\u00e9s en Lituanie <\/h2>\n\n<p>Conform\u00e9ment au R\u00e8glement europ\u00e9en 883\/2004, les travailleurs d\u00e9tach\u00e9s en Lituanie peuvent continuer \u00e0 \u00eatre <strong>couverts par la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 est situ\u00e9 l&#8217;employeur.<\/strong><\/p>\n\n<p>L&#8217;entreprise de d\u00e9tachement doit demander le <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a>. L&#8217;institution comp\u00e9tente de s\u00e9curit\u00e9 sociale le d\u00e9livrera une fois toutes les informations n\u00e9cessaires re\u00e7ues. Le certificat A1 peut avoir une dur\u00e9e maximale de 24 mois. De plus, le travailleur doit le conserver pendant toute la p\u00e9riode de son d\u00e9tachement en Lituanie.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-penalties-in-case-of-non-compliance-nbsp\">Sanctions en cas de non-conformit\u00e9 pour le d\u00e9tachement des travailleurs en Lituanie <\/h2>\n\n<p>L&#8217;Inspection du travail de l&#8217;\u00c9tat a le pouvoir d&#8217;infliger des amendes aux entreprises \u00e9trang\u00e8res qui ne respectent pas les dispositions nationales en mati\u00e8re de d\u00e9tachement. <\/p>\n\n<p>Le non-respect de la pr\u00e9sentation \u00e0 l&#8217;Inspection du travail de l&#8217;\u00c9tat des informations sur les conditions de travail pr\u00e9vues \u00e0 l&#8217;article 108 (2) du Code du travail, applicables \u00e0 un employ\u00e9 d\u00e9tach\u00e9, impose aux employeurs une amende de 360 \u20ac \u00e0 660 \u20ac.
