La notification doit \u00eatre faite avant le d\u00e9but de la prestation de service. Chaque travailleur doit \u00eatre notifi\u00e9 avant d&#8217;entrer en France. Certaines exceptions incluent les artistes, les apprentis en mobilit\u00e9 internationale, les sportifs, les d\u00e9l\u00e9gu\u00e9s officiels et les participants \u00e0 des conf\u00e9rences et s\u00e9minaires.<\/p>\n\n\n\n<p class=\"has-text-align-left\">La d\u00e9claration doit contenir des informations sur la date de d\u00e9but et de fin du d\u00e9tachement, sur l&#8217;entreprise d&#8217;envoi et celle d&#8217;accueil, le nombre de travailleurs d\u00e9tach\u00e9s, l&#8217;adresse du chantier, le type d&#8217;activit\u00e9 exerc\u00e9e en France, le nom d&#8217;un repr\u00e9sentant, etc. La d\u00e9claration pr\u00e9alable de d\u00e9tachement peut \u00eatre modifi\u00e9e au plus tard 3 jours apr\u00e8s la date de modification effective. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u00c0 la suite du d\u00e9cret du 17 mars 2023, la <a href=\"https:\/\/arlettipartners.com\/sipsi-platform-simplification-of-the-posting-declaration\/\">plateforme SIPSI propose d\u00e9sormais une proc\u00e9dure simplifi\u00e9e<\/a> concernant les informations obligatoires \u00e0 compl\u00e9ter.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"has-text-align-left\">L&#8217;aspect de l&#8217;immigration est \u00e9galement g\u00e9r\u00e9 de mani\u00e8re assez lin\u00e9aire en France. En effet, m\u00eame un citoyen extracommunautaire peut \u00eatre d\u00e9tach\u00e9 en France, \u00e0 condition de poss\u00e9der un permis de s\u00e9jour ou de travail pour un \u00c9tat Membre de l&#8217;Union Europ\u00e9enne, un \u00c9tat de l&#8217;Espace \u00c9conomique Europ\u00e9en ou la Suisse, et d&#8217;\u00eatre r\u00e9guli\u00e8rement employ\u00e9 par une entreprise \u00e9tablie dans l&#8217;un de ces \u00c9tats. Les consultants de A&amp;P seront ravis de vous fournir les informations les plus appropri\u00e9es pour votre cas sp\u00e9cifique. <\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-left\" id=\"h-representant-domicilie-en-france\">Repr\u00e9sentant domicili\u00e9 en France\u00a0<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Il est obligatoire de nommer un repr\u00e9sentant pr\u00e9sent sur le territoire fran\u00e7ais. Cette personne est charg\u00e9e de garantir le lien entre l&#8217;entreprise d&#8217;envoi et les agents de contr\u00f4le de l&#8217;inspection du travail (DIRECCTE). Toute personne peut servir de personne de contact en France, y compris le travailleur d\u00e9tach\u00e9 lui-m\u00eame ou le client fran\u00e7ais.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"working\">Conditions de travail et salariales en France <\/h2>\n\n\n\n<p class=\"has-text-align-left\">L&#8217;entreprise qui d\u00e9tache ses salari\u00e9s en France est soumise aux dispositions l\u00e9gales et contractuelles applicables au personnel employ\u00e9 par les entreprises du m\u00eame secteur d&#8217;activit\u00e9 \u00e9tablies en France. Ces dispositions concernent la dur\u00e9e du travail, le repos compensateur, les jours f\u00e9ri\u00e9s, les horaires de travail et le travail de nuit, la r\u00e9mun\u00e9ration (y compris les majorations pour heures suppl\u00e9mentaires), etc. <\/p>\n\n\n\n<p class=\"has-text-align-left\">En g\u00e9n\u00e9ral, un travailleur peut exercer une activit\u00e9 pour un maximum de 48 heures par semaine. Cependant, le travail dominical est g\u00e9n\u00e9ralement interdit, sauf d\u00e9rogations expresses. Le Code du travail fran\u00e7ais ou les conventions collectives applicables fixent le salaire minimum d&#8217;un travailleur d\u00e9tach\u00e9 en France. En tout cas, en France, il existe le SMIC, c&#8217;est-\u00e0-dire le salaire horaire minimum l\u00e9gal fran\u00e7ais. Aucun travailleur ne peut \u00eatre r\u00e9mun\u00e9r\u00e9 moins que le SMIC. Le SMIC est souvent sujet \u00e0 variations et est actuellement <strong>fix\u00e9 \u00e0 11,65 \u20ac de l&#8217;heure<\/strong>, suite \u00e0 la <a href=\"https:\/\/arlettipartners.com\/french-smic-increases-from-january-1-2024\/\">nouvelle augmentation \u00e0 partir du 1er janvier 2024<\/a><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Auparavant, le SMIC \u00e9tait fix\u00e9 \u00e0 11,52 \u20ac de l&#8217;heure, selon la <a href=\"https:\/\/arlettipartners.com\/french-smic-increases-from-may-2023\/\">revalorisation entr\u00e9e en vigueur en mai 2023.<\/a><\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"storage\">Archivage des documents relatifs au d\u00e9tachement en France<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Tous les documents relatifs au d\u00e9tachement doivent \u00eatre conserv\u00e9s pour une p\u00e9riode pr\u00e9d\u00e9termin\u00e9e <strong>d&#8217;au moins deux ans<\/strong> apr\u00e8s la fin du d\u00e9tachement. Le repr\u00e9sentant domicili\u00e9 sur le territoire fran\u00e7ais est tenu d&#8217;archiver et de mettre \u00e0 disposition des autorit\u00e9s fran\u00e7aises les documents \u00e0 son adresse. En cas de contr\u00f4le, les autorit\u00e9s peuvent exiger une traduction des documents en fran\u00e7ais.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"btp\">Obligations suppl\u00e9mentaires \u2013 La carte BTP pour le d\u00e9tachement des travailleurs en France<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Le cabinet A&amp;P peut vous assister dans la v\u00e9rification des obligations suppl\u00e9mentaires pour l&#8217;entreprise et ses travailleurs. En effet, selon le type d&#8217;activit\u00e9 que le travailleur d\u00e9tach\u00e9 exercera, ces obligations peuvent \u00eatre cruciales. C&#8217;est le cas, par exemple, de la <a href=\"https:\/\/arlettipartners.com\/fr\/la-carte-btp-en-france\/?lang=fr\">carte BTP<\/a>. L&#8217;entreprise \u00e9trang\u00e8re est tenue de la demander si les salari\u00e9s d\u00e9tach\u00e9s exercent une ou plusieurs activit\u00e9s mentionn\u00e9es \u00e0 l&#8217;article R8291-1 concernant le secteur de la construction ou des travaux publics.<\/p>\n\n\n\n<p class=\"has-text-align-left\">L&#8217;entreprise effectuant le d\u00e9tachement demande la carte BTP apr\u00e8s avoir soumis la d\u00e9claration pr\u00e9alable de d\u00e9tachement sur SIPSI et en tout cas avant le d\u00e9but des travaux. La demande est faite <a href=\"https:\/\/gestion.cartebtp.fr\/#\/accueil\">\u00e9lectroniquement<\/a> et la carte est d\u00e9livr\u00e9e par l&#8217;Union des Caisses de France CIBTP ; la validit\u00e9 de la carte correspond \u00e0 toute la dur\u00e9e de la mission pour laquelle elle est demand\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"security\">S\u00e9curit\u00e9 sociale en France<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Conform\u00e9ment au R\u00e8glement 883\/2004, l&#8217;entreprise effectuant le d\u00e9tachement doit demander la d\u00e9livrance du <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a> pour les employ\u00e9s d\u00e9tach\u00e9s. Les m\u00eames sanctions s&#8217;appliquent de mani\u00e8re cumulative en cas de non-nomination du repr\u00e9sentant. <\/p>\n\n\n\n<p class=\"has-text-align-left\">En cas de non-respect des obligations par l&#8217;un des sous-traitants directs ou indirects ou de l&#8217;agence de placement, le donneur d&#8217;ordre principal est passible d&#8217;une amende administrative, si ce dernier
