Le polonais et l&#8217;anglais sont les langues disponibles pour remplir le formulaire.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce que doit inclure la d\u00e9claration de d\u00e9tachement en Pologne et quand l&#8217;envoyer <\/h3>\n\n\n\n<p class=\"has-text-align-left\">La notification du travailleur d\u00e9tach\u00e9 doit contenir toutes les informations pertinentes relatives au d\u00e9tachement et les autres donn\u00e9es associ\u00e9es, telles que : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nom de l&#8217;entreprise \u00e9trang\u00e8re d\u00e9tachante et de l&#8217;entreprise polonaise recevant le travailleur ; <\/li>\n\n\n\n<li>Adresse du lieu de travail \u00e0 l&#8217;\u00e9tranger ; <\/li>\n\n\n\n<li>Nombre et noms des travailleurs d\u00e9tach\u00e9s ; <\/li>\n\n\n\n<li>Nom et adresse du repr\u00e9sentant domicili\u00e9 en Pologne ; <\/li>\n\n\n\n<li>et d&#8217;autres informations encore. <\/li>\n<\/ul>\n\n\n\n<p class=\"has-text-align-left\">La d\u00e9claration pr\u00e9alable de d\u00e9tachement est obligatoire pour chaque prestation de services vers la Pologne. Cependant, des exceptions existent pour les compagnies de la marine marchande et les transports internationaux. <\/p>\n\n\n\n<p>L&#8217;employeur doit envoyer le formulaire papier par courrier au chef de l&#8217;Inspection du travail de Varsovie avant le d\u00e9but de la prestation de service. L&#8217;accus\u00e9 de r\u00e9ception vaut comme re\u00e7u. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">\u00c9tablir la personne de contact en Pologne<\/h3>\n\n\n\n<p class=\"has-text-align-left\">Comme pr\u00e9cis\u00e9 pr\u00e9c\u00e9demment, il sera n\u00e9cessaire de mentionner dans la d\u00e9claration les donn\u00e9es d&#8217;un r\u00e9f\u00e9rent. Le formulaire de modification doit \u00e9galement \u00eatre envoy\u00e9 par courrier \u00e0 l&#8217;Inspection du travail de Varsovie. <\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"conditions\">Conditions salariales et de travail en Pologne<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Le <em>Code du travail polonais<\/em> r\u00e9git les droits et obligations des employeurs et des travailleurs. Chaque travailleur d\u00e9tach\u00e9 en Pologne est soumis aux conditions les plus favorables entre celles de son \u00c9tat d&#8217;origine et celles de la Pologne.<\/p>\n\n\n\n<p class=\"has-text-align-left\">En Pologne, il existe un salaire minimum, actuellement fix\u00e9 \u00e0 3 307,90 PLN (environ 701,90 euros). Cependant, il est important de rappeler qu&#8217;un travailleur d\u00e9tach\u00e9 en Pologne doit b\u00e9n\u00e9ficier des conditions les plus favorables. Donc, si le travailleur per\u00e7oit un salaire plus \u00e9lev\u00e9 dans l&#8217;\u00c9tat o\u00f9 est situ\u00e9 son employeur, il continuera \u00e0 percevoir le m\u00eame montant plus l&#8217;indemnit\u00e9 de d\u00e9placement. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-quelle-est-la-duree-moyenne-des-heures-de-travail-hebdomadaires-en-pologne\">Quelle est la dur\u00e9e moyenne des heures de travail hebdomadaires en Pologne ?<\/h3>\n\n\n\n<p class=\"has-text-align-left\">La semaine de travail standard en Pologne est de 40 heures : en tout cas, elle ne peut d\u00e9passer 48 heures par semaine. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"documents\">Conservation des documents relatifs au d\u00e9tachement en Pologne<\/h2>\n\n\n\n<p class=\"has-text-align-left\">Tous les documents fournissant des informations sur le d\u00e9tachement des travailleurs en Pologne doivent \u00eatre archiv\u00e9s et tenus \u00e0 disposition \u00e0 l&#8217;adresse indiqu\u00e9e dans la notification de d\u00e9tachement des travailleurs. La conservation des documents \u00e0 l&#8217;adresse du lieu de travail n&#8217;est pas valide. <\/p>\n\n\n\n<p class=\"has-text-align-left\">En cas d&#8217;inspection pendant la p\u00e9riode de d\u00e9tachement en Pologne, l&#8217;employeur \u00e9tranger doit fournir une copie traduite des documents pertinents concernant le d\u00e9tachement dans un d\u00e9lai de 5 jours ouvrables \u00e0 compter de la r\u00e9ception de la demande. En revanche, si l&#8217;inspection a lieu apr\u00e8s la fin de la p\u00e9riode de d\u00e9tachement en Pologne, le d\u00e9lai pour fournir lesdits documents est de 15 jours. <\/p>\n\n\n\n<p class=\"has-text-align-left\">En tout \u00e9tat de cause, les autorit\u00e9s polonaises ne peuvent effectuer d&#8217;inspections plus de deux ans apr\u00e8s la fin du d\u00e9tachement des travailleurs en Pologne. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"noneu\">S\u00e9curit\u00e9 sociale en Pologne<\/h2>\n\n\n\n<p class=\"has-text-align-left\">En vertu du R\u00e8glement europ\u00e9en 883\/2004, la s\u00e9curit\u00e9 sociale de l&#8217;\u00c9tat membre o\u00f9 se situe l&#8217;employeur peut continuer \u00e0 couvrir le travailleur d\u00e9tach\u00e9 en Pologne. <\/p>\n\n\n\n<p class=\"has-text-align-left\">L&#8217;entreprise d\u00e9tachante doit demander \u00e0 l&#8217;organisme de s\u00e9curit\u00e9 sociale comp\u00e9tent la d\u00e9livrance du <a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaire A1<\/a>. Ce dernier peut avoir une dur\u00e9e maximale de 24 mois ou \u00eatre valable pour une seule mission. Dans ce cas, il devra \u00eatre demand\u00e9 \u00e0 nouveau pour le d\u00e9tachement suivant.<\/p>\n\n\n\n<p class=\"has-text-align-left\">De plus, le travailleur doit \u00eatre en possession du Certificat A1 pendant son d\u00e9tachement en Pologne. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"penalties\">Sanctions pour non-respect des obligations en cas de d\u00e9tachement de travailleurs en Pologne <\/h2>\n\n\n\n<p class=\"has-text-align-left\">Le non-envoi de la d\u00e9claration pr\u00e9alable de d\u00e9tachement, la conservation des documents et le non-respect g\u00e9n\u00e9ral des obligations de d\u00e9tachement peuvent \u00eatre sanctionn\u00e9s par une amende allant de 1 000 PLN \u00e0 30 000 PLN (environ de 212 \u20ac \u00e0 6 378 \u20ac).
