{"id":176396,"date":"2021-10-19T15:11:03","date_gmt":"2021-10-19T13:11:03","guid":{"rendered":"https:\/\/arlettipartners.com\/detachement-travailleurs-interimaires-lignes-directrices\/"},"modified":"2025-09-16T12:50:51","modified_gmt":"2025-09-16T10:50:51","slug":"detachement-travailleurs-interimaires-lignes-directrices","status":"publish","type":"post","link":"https:\/\/arlettipartners.com\/fr\/detachement-travailleurs-interimaires-lignes-directrices\/","title":{"rendered":"D\u00e9tachement travailleurs int\u00e9rimaires : lignes directrices"},"content":{"rendered":"\n<p class=\"has-text-align-left\">Dans le cas o\u00f9 un travailleur int\u00e9rimaire est envoy\u00e9 pour effectuer une prestation de service aupr\u00e8s d&#8217;une entreprise \u00e9tablie dans un des \u00c9tats membres de l&#8217;UE, l&#8217;agence de travail temporaire est tenue de se conformer aux obligations introduites par les <a href=\"https:\/\/arlettipartners.com\/reglementation-travailleurs-detaches-directives-ue-detachement\/?lang=fr\">directives europ\u00e9ennes en mati\u00e8re de d\u00e9tachement transnational<\/a> et \u00e0 leurs transpositions nationales respectives.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"obligations\">Quelles sont les obligations pour le d\u00e9tachement transnational ? <\/h2>\n\n\n\n<p class=\"has-text-align-left\">En r\u00e8gle g\u00e9n\u00e9rale, les obligations introduites par les directives europ\u00e9ennes pr\u00e9voient : <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La <strong>transmission d&#8217;une <a href=\"https:\/\/arlettipartners.com\/declaration-de-detachement\/?lang=fr\">d\u00e9claration pr\u00e9alable de d\u00e9tachement<\/a><\/strong>, dans le but d&#8217;informer les autorit\u00e9s d&#8217;inspection \u00e9trang\u00e8res de l&#8217;intervention du travailleur sur le territoire \u00e9tranger ;<\/li>\n\n\n\n<li>La <strong>nomination d&#8217;une personne de contact<\/strong>, qui dans certains cas peut \u00eatre le travailleur d\u00e9tach\u00e9 ou une personne professionnelle domicili\u00e9e dans le pays de destination ;<\/li>\n\n\n\n<li>La <strong>conservation de la documentation<\/strong> relative \u00e0 la mission et au travailleur d\u00e9tach\u00e9, pendant toute la dur\u00e9e de la mission et pendant au moins 2 ans apr\u00e8s sa cessation ;<\/li>\n\n\n\n<li>L&#8217;<strong>ajustement salarial<\/strong> aux niveaux \u00e9quivalents pr\u00e9vus par la convention collective applicable dans le pays h\u00f4te ;<\/li>\n\n\n\n<li>L&#8217;obtention du <strong><a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">formulaire A1<\/a><\/strong>, qui certifie que le travailleur d\u00e9tach\u00e9 reste assur\u00e9 au titre de la s\u00e9curit\u00e9 sociale dans le pays de l&#8217;UE o\u00f9 l&#8217;entreprise d&#8217;origine est \u00e9tablie ;<\/li>\n\n\n\n<li>La pr\u00e9paration de la <strong>documentation \u00e9ventuelle d&#8217;immigration<\/strong> pour les citoyens de pays tiers (visas, permis, etc.).<\/li>\n<\/ul>\n\n\n\n<p>En ce qui concerne les conditions de r\u00e9mun\u00e9ration, la Cour de Justice Europ\u00e9enne a \u00e9tabli que l&#8217;accord collectif pr\u00e9voyant une <a href=\"https:\/\/arlettipartners.com\/european-court-of-justice-remuneration-of-temporary-workers-must-include-compensatory-benefits\/\">r\u00e9mun\u00e9ration inf\u00e9rieure pour les travailleurs int\u00e9rimaires par rapport aux travailleurs embauch\u00e9s directement doit inclure des avantages compensatoires<\/a>.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Il est important de pr\u00e9ciser que de toute mani\u00e8re, les dispositions varient selon le pays de destination. En outre, dans certains cas, le travail temporaire est fortement limit\u00e9 (ex. en Belgique).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"court\">La d\u00e9cision de la Cour de Justice concernant la validit\u00e9 du d\u00e9tachement <\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Pour consid\u00e9rer un d\u00e9tachement valide, il faut se r\u00e9f\u00e9rer au \u00ab lieu o\u00f9 l&#8217;entreprise exerce son activit\u00e9 \u00e9conomique principale \u00bb et au \u00ab montant du chiffre d&#8217;affaires r\u00e9alis\u00e9 par l&#8217;entreprise dans l&#8217;\u00c9tat membre d&#8217;\u00e9tablissement \u00bb. <\/p>\n<\/blockquote>\n\n\n\n<p class=\"has-text-align-left\">Le d\u00e9tachement transnational des travailleurs int\u00e9rimaires est valide si l&#8217;agence de travail temporaire \u00e9trang\u00e8re facture de mani\u00e8re cons\u00e9quente dans le pays d&#8217;origine. La d\u00e9cision de la Cour de Justice, d\u00e9pos\u00e9e le 3 juin 2021 et reprise par l&#8217;Inspection du Travail dans la note 936 du 15 juin 2021, clarifie que le chiffre d&#8217;affaires ne peut pas provenir principalement de pays autres que celui de l&#8217;\u00e9tablissement.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Le litige qui a soulev\u00e9 un probl\u00e8me d&#8217;interpr\u00e9tation de la r\u00e9glementation communautaire concerne une agence int\u00e9rimaire bas\u00e9e en Bulgarie, dont l&#8217;activit\u00e9 de travail temporaire se d\u00e9roule principalement en Allemagne et dans d&#8217;autres \u00c9tats membres de l&#8217;UE. La d\u00e9livrance des formulaires A1 pour les travailleurs embauch\u00e9s en Bulgarie et imm\u00e9diatement d\u00e9tach\u00e9s aupr\u00e8s d&#8217;entreprises utilisatrices dans d&#8217;autres pays communautaires a \u00e9t\u00e9 refus\u00e9e par l&#8217;autorit\u00e9 bulgare comp\u00e9tente, au motif que l&#8217;agence n&#8217;exer\u00e7ait aucune \u00ab activit\u00e9 habituelle \u00bb dans le pays d&#8217;origine. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"genuine\">Conditions requises pour consid\u00e9rer un d\u00e9tachement \u2018valide\u2019 <\/h2>\n\n\n\n<p class=\"has-text-align-left\">La Cour a donc clarifi\u00e9 que la soci\u00e9t\u00e9 doit exercer \u00ab de mani\u00e8re significative \u00bb l&#8217;activit\u00e9 de mise \u00e0 disposition des travailleurs dans l&#8217;\u00c9tat membre o\u00f9 elle est \u00e9tablie. Pour consid\u00e9rer un d\u00e9tachement valide, il faut donc se r\u00e9f\u00e9rer au \u00ab lieu o\u00f9 l&#8217;entreprise exerce son activit\u00e9 \u00e9conomique principale \u00bb et au \u00ab montant du chiffre d&#8217;affaires r\u00e9alis\u00e9 par l&#8217;entreprise dans l&#8217;\u00c9tat membre d&#8217;\u00e9tablissement \u00bb, afin d&#8217;exclure une \u00e9ventuelle activit\u00e9 de
