Comme d\u00e9j\u00e0 \u00e9tabli par le D\u00e9cret no. 136\/2016, les conditions de travail et d\u2019emploi de l\u2019\u00c9tat membre d\u2019accueil s\u2019appliquent \u00e9galement \u2013 <em>si elles sont plus favorables au travailleur d\u00e9tach\u00e9<\/em> \u2013 \u00e0 la relation de travail entre les travailleurs d\u00e9tach\u00e9s et l\u2019entreprise de d\u00e9tachement.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les entreprises qui d\u00e9tachent leurs travailleurs en Italie doivent d\u00e9sormais aligner le salaire de leurs employ\u00e9s sur celui d\u2019un travailleur italien.&#13;\n&#13;\n<\/p>\n<\/blockquote>\n\n<p class=\"has-text-align-left\">Toutefois, si jusqu\u2019en septembre 2020 il suffisait d\u2019ajuster le salaire minimum du travailleur au salaire national \u2013 le cas \u00e9ch\u00e9ant \u2013 avec la transposition nationale de la directive 2018\/957 en Italie, il sera n\u00e9cessaire <strong>d\u2019ajuster int\u00e9gralement la r\u00e9mun\u00e9ration du travailleur d\u00e9tach\u00e9 \u00e0 celle d\u2019un travailleur italien<\/strong> de la m\u00eame cat\u00e9gorie en appliquant la convention collective la plus repr\u00e9sentative.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-left\">Les experts d\u2019A&amp;P sont \u00e0 votre disposition pour <a href=\"https:\/\/arlettipartners.com\/detachement-travailleurs-italie\/?lang=fr#contactform\">accompagner votre entreprise et vos salari\u00e9s<\/a> dans la gestion de vos r\u00e9alisations de d\u00e9tachement en Italie.<\/p>\n<\/blockquote>\n\n<p class=\"has-text-align-left\">Vous trouverez ci-dessous un r\u00e9sum\u00e9 des obligations pr\u00e9vues par le droit italien et europ\u00e9en en mati\u00e8re de d\u00e9tachement transnational en Italie.&#13;\n&#13;\n<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-preliminary-obligations-for-posted-workers-in-italy\">Obligations pr\u00e9alables au d\u00e9tachement de travailleurs en Italie<\/h2>\n\n<p class=\"has-text-align-left\">L\u2019entreprise qui envoie ses salari\u00e9s sur le territoire italien doit envoyer une d\u00e9claration pr\u00e9alable de d\u00e9tachement \u00e0 l\u2019inspection du travail. La d\u00e9claration doit \u00eatre envoy\u00e9e par voie \u00e9lectronique via le <a href=\"https:\/\/www.cliclavoro.gov.it\/\">site Cliclavoro<\/a>, au plus tard la veille du d\u00e9but de la prestation de services. Chaque salari\u00e9 doit \u00eatre notifi\u00e9 avant son entr\u00e9e en Italie.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Les entreprises doivent notifier chaque salari\u00e9 qu\u2019elles ont l\u2019intention de d\u00e9tacher en Italie.<\/p>\n<\/blockquote>\n\n<p class=\"has-text-align-left\">La d\u00e9claration de d\u00e9tachement en Italie doit contenir des informations sur les points suivants:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>les dates de d\u00e9but et de fin du d\u00e9tachement;<\/li>\n\n\n\n<li>l\u2019entreprise de d\u00e9tachement et l\u2019entreprise d\u2019accueil;<\/li>\n\n\n\n<li>le nombre de travailleurs d\u00e9tach\u00e9s;<\/li>\n\n\n\n<li>l\u2019adresse du lieu de travail en Italie;<\/li>\n\n\n\n<li>le type d\u2019activit\u00e9 qui aura lieu en Italie;<\/li>\n\n\n\n<li>le nom d\u2019un repr\u00e9sentant domicili\u00e9;<\/li>\n\n\n\n<li>et bien d\u2019autres choses encore.<\/li>\n<\/ul>\n\n<p class=\"has-text-align-left\">En fait, il est \u00e9galement obligatoire de <strong>d\u00e9signer un repr\u00e9sentant domicili\u00e9 sur le territoire italien<\/strong>. Cette personne sera charg\u00e9e d\u2019assurer la liaison entre l\u2019entreprise de d\u00e9tachement et les agents de contr\u00f4le de l\u2019inspection du travail (Ispettorato Nazionale del Lavoro).<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-immigration-requirements-and-work-permit-for-contracting\">Exigences en mati\u00e8re d\u2019immigration et permis de travail pour la passation de march\u00e9s<\/h2>\n\n<p class=\"has-text-align-left\">Les travailleurs non ressortissants de l&#8217;UE titulaires d&#8217;un permis de travail valide dans un \u00c9tat membre de l&#8217;UE peuvent \u00eatre d\u00e9tach\u00e9s en Italie pour une dur\u00e9e maximale de 90 jours sur une p\u00e9riode de 180 jours pour des activit\u00e9s li\u00e9es \u00e0 leur entreprise. Ces activit\u00e9s comprennent : <\/p>\n\n<p class=\"has-text-align-center\">&#8220;<em>economic-commercial reasons, contacts or negotiations, learning and testing the use of capital goods bought or sold in the context of a commercial contract<\/em>&#8220;.<\/p>\n\n<p class=\"has-text-align-left\">Si les activit\u00e9s \u00e0 exercer en Italie sont diff\u00e9rentes de celles \u00e9num\u00e9r\u00e9es ci-dessus, un <a href=\"https:\/\/arlettipartners.com\/fr\/le-permis-de-sejour-italien\/\">permis de travail<\/a> doit \u00eatre demand\u00e9, par exemple un permis d\u2019entr\u00e9e pour la sous-traitance, s\u2019il existe un contrat de sous-traitance entre l\u2019entreprise de d\u00e9tachement o\u00f9 il est employ\u00e9 et le client italien.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-working-and-salary-conditions-in-italy\">Conditions de travail et de salaire en Italie<\/h2>\n\n<p class=\"has-text-align-left\">Une entreprise qui envoie ses employ\u00e9s en Italie est <strong>soumise aux dispositions l\u00e9gales et contractuelles<\/strong> applicables aux employ\u00e9s des entreprises du m\u00eame secteur \u00e9tablies en Italie. Ces dispositions concernent le temps de travail, le repos compensateur, les jours f\u00e9ri\u00e9s, les horaires de travail et le travail de nuit, la r\u00e9mun\u00e9ration (y compris les majorations pour heures suppl\u00e9mentaires), etc.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-is-there-a-minimum-national-wage-in-italy\">Existe-t-il un salaire national minimum en Italie?<\/h3>\n\n<p class=\"has-text-align-left\"><strong>L\u2019Italie n\u2019a pas de salaire national minimum l\u00e9gal<\/strong>. C\u2019est pourquoi il est essentiel que les employeurs \u00e9trangers analysent et identifient soigneusement la convention collective italienne appropri\u00e9e et le <strong>niveau ad\u00e9quat dans lequel chaque travailleur d\u00e9tach\u00e9 sera class\u00e9.<\/strong><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-mandatory-storage-of-documents-regarding-posted-workers-in-italy\">Conservation obligatoire des documents relatifs au d\u00e9tachement en Italie<\/h2>\n\n<p class=\"has-text-align-left\">Pendant la dur\u00e9e du d\u00e9tachement, il est obligatoire de conserver et de mettre \u00e0 disposition, \u00e0 la demande des autorit\u00e9s du travail, une copie des documents suivants:&#13;\n&#13;\n<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Contrats de travail ou documents \u00e9quivalents prouvant l\u2019\u00e9tablissement de la relation de travail;&#13;\n<\/li>\n\n\n\n<li>Fiches de paie;<\/li>\n\n\n\n<li>Feuilles de temps indiquant le d\u00e9but, la fin et la dur\u00e9e des heures de travail quotidiennes;<\/li>\n\n\n\n<li>Documents prouvant le paiement des salaires;<\/li>\n\n\n\n<li><a href=\"https:\/\/arlettipartners.com\/formulaire-a1-travailleurs-detaches\/?lang=fr\">Formulaires A1<\/a><\/li>\n<\/ul>\n\n<p class=\"has-text-align-left\">Apr\u00e8s la fin du d\u00e9tachement en Italie, il est n\u00e9cessaire de conserver tous les documents relatifs \u00e0 la mission <strong>pendant une p\u00e9riode fixe d\u2019au moins deux ans.<\/strong><\/p>\n\n<p class=\"has-text-align-left\">Le repr\u00e9sentant domicili\u00e9 sur le territoire italien doit conserver correctement les documents et les tenir \u00e0 la disposition des autorit\u00e9s du travail \u00e9trang\u00e8res. En cas de demande formelle de la part des autorit\u00e9s comp\u00e9tentes, des traductions en langue italienne peuvent \u00eatre n\u00e9cessaires.&#13;\n&#13;\n<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-social-security-in-italy\">S\u00e9curit\u00e9 sociale en Italie<\/h2>\n\n<p class=\"has-text-align-left\">Conform\u00e9ment au r\u00e8glement 883\/2004, l\u2019entreprise de d\u00e9tachement doit demander \u00e0 l\u2019institution sociale comp\u00e9tente la d\u00e9livrance d\u2019un formulaire A1 pour les travailleurs d\u00e9tach\u00e9s.&#13;\n&#13;\n<\/p>\n\n<p class=\"has-text-align-left\">L\u2019Italie a conclu des conventions bilat\u00e9rales de s\u00e9curit\u00e9 sociale avec plusieurs pays extracommunautaires. L\u2019institut italien de s\u00e9curit\u00e9 sociale (INPS) fournit des informations sur les conventions individuelles, leur champ d\u2019application et les exigences relatives aux proc\u00e9dures d\u2019agr\u00e9gation et d\u2019application.&#13;\n&#13;\n&#13;\n<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-italian-construction-workers-social-security-fund-cassa-edile\">La caisse de s\u00e9curit\u00e9 sociale des travailleurs du b\u00e2timent en Italie Cassa Edile<\/h2>\n\n<p class=\"has-text-align-left\">Les travailleurs d\u00e9tach\u00e9s du secteur du b\u00e2timent doivent \u00eatre enregistr\u00e9s et cotiser \u00e0 la Cassa Edile comp\u00e9tente, leur caisse de s\u00e9curit\u00e9 sociale, car leurs conditions de travail doivent \u00eatre adapt\u00e9es \u00e0 la convention collective nationale pertinente en raison des r\u00e8gles nationales (D.Lgs. 17\/07\/2016 n.136) et de l\u2019UE (directive 2014\/67).<\/p>\n\n<p class=\"has-text-align-left\">Cette disposition <strong>ne s\u2019applique pas<\/strong> aux travailleurs des pays qui ont conclu une convention avec l\u2019Italie sur la question (Allemagne, France, Autriche, Saint-Marin).<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-temporary-workers\">Travailleurs temporaires<\/h2>\n\n<p class=\"has-text-align-left\">Les travailleurs embauch\u00e9s par des agences de placement peuvent \u00eatre d\u00e9tach\u00e9s en Italie sous certaines conditions. Leur employeur principal reste responsable du traitement \u00e9conomique et r\u00e9glementaire et des obligations formelles qui d\u00e9coulent du d\u00e9tachement des travailleurs.&#13;\n&#13;\n<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-penalties-in-case-of-non-fulfilment-of-italian-obligations-when-posting-employees\">Sanctions en cas de non-respect des obligations italiennes en mati\u00e8re de d\u00e9tachement de travailleurs&#13;\n<\/h2>\n\n<p class=\"has-text-align-left\">Selon l\u2019art. 12 du d\u00e9cret l\u00e9gislatif 136\/2016, le <strong>d\u00e9faut d\u2019envoi de la d\u00e9claration pr\u00e9alable<\/strong> de d\u00e9tachement est passible d\u2019une amende de 180 \u00e0 600 \u20ac par travailleur d\u00e9tach\u00e9.<\/p>\n\n<p class=\"has-text-align-left\">En cas de <strong>manquement \u00e0 l\u2019obligation de conserver<\/strong> tout document relatif au d\u00e9tachement, l\u2019entreprise d\u00e9tachante est passible d\u2019une amende administrative de 600 \u20ac \u00e0 3 600 \u20ac par travailleur d\u00e9tach\u00e9.<\/p>\n\n<p class=\"has-text-align-left\">Le d\u00e9faut de d\u00e9signation d&#8217;un repr\u00e9sentant domicili\u00e9 en Italie est passible d&#8217;une sanction administrative p\u00e9cuniaire comprise entre 2 400 \u20ac et 7 200
