Par le biais des <em>Equal Pay Transparency and Reporting Regulations <\/em>(R\u00e8glement relatif \u00e0 la transparence et \u00e0 la communication d&#8217;informations en mati\u00e8re d&#8217;\u00e9galit\u00e9 salariale), le <a href=\"https:\/\/www.gov.mt\/en\/pages\/home.aspx\" target=\"_blank\" rel=\"noopener\">gouvernement<\/a> entend renforcer le droit \u00e0 l&#8217;\u00e9galit\u00e9 de r\u00e9mun\u00e9ration entre les femmes et les hommes. En outre, ces dispositions visent \u00e0 garantir l&#8217;\u00e9galit\u00e9 salariale entre les travailleurs effectuant un travail de valeur \u00e9gale. Le pr\u00e9sent article illustre les principaux aspects de la transposition maltaise de cette r\u00e9glementation europ\u00e9enne.<\/p>\n<h2>Le droit \u00e0 l&#8217;information pendant et apr\u00e8s le recrutement<\/h2>\n<p class=\"isSelectedEnd\">L&#8217;une des principales nouveaut\u00e9s introduites par le r\u00e8glement concerne le droit des candidats \u00e0 recevoir certaines informations avant la fin de la proc\u00e9dure de recrutement. Plus pr\u00e9cis\u00e9ment, les personnes postulant \u00e0 un emploi doivent \u00eatre inform\u00e9es du <strong>salaire d&#8217;embauche ou de la fourchette de r\u00e9mun\u00e9ration pr\u00e9vue<\/strong> pour le poste concern\u00e9. Outre le salaire de base, ces informations doivent \u00e9galement porter sur les \u00e9l\u00e9ments variables de r\u00e9mun\u00e9ration, qu&#8217;ils soient vers\u00e9s en esp\u00e8ces ou en nature. Lorsqu&#8217;une convention collective est applicable, l&#8217;employeur est \u00e9galement tenu de communiquer les dispositions pertinentes de celle-ci. Par ailleurs, les offres d&#8217;emploi ainsi que les intitul\u00e9s de poste doivent \u00eatre r\u00e9dig\u00e9s de mani\u00e8re neutre du point de vue du genre. Ces mesures visent \u00e0 garantir l&#8217;\u00e9galit\u00e9 et la transparence salariale d\u00e8s les premi\u00e8res \u00e9tapes du processus de recrutement.<\/p>\n<p class=\"isSelectedEnd\">D&#8217;autres droits s&#8217;appliquent une fois la relation de travail \u00e9tablie. Les salari\u00e9s peuvent notamment demander \u00e0 leur employeur des informations concernant leur propre niveau de r\u00e9mun\u00e9ration. Ces informations doivent \u00eatre fournies par \u00e9crit <strong>dans un d\u00e9lai de huit jours<\/strong> \u00e0 compter de la demande. Elles doivent \u00eatre ventil\u00e9es par sexe et indiquer la r\u00e9mun\u00e9ration moyenne des travailleurs effectuant un travail de valeur \u00e9gale. En outre, chaque ann\u00e9e, les employeurs devront informer leurs salari\u00e9s de leur droit d&#8217;obtenir ces informations ainsi que de la proc\u00e9dure \u00e0 suivre pour les demander.<\/p>\n<p class=\"isSelectedEnd\">Il convient de souligner que les employeurs peuvent toujours appliquer des niveaux de r\u00e9mun\u00e9ration diff\u00e9rents entre travailleurs et travailleuses. Toutefois, ces diff\u00e9rences doivent \u00eatre fond\u00e9es sur des crit\u00e8res objectifs et neutres du point de vue du genre, tels qu&#8217;une meilleure performance ou un niveau de comp\u00e9tence plus \u00e9lev\u00e9.<\/p>\n<h2>Les obligations de d\u00e9claration<\/h2>\n<p class=\"isSelectedEnd\">L&#8217;Avis juridique n\u00b0 173 de 2026 introduit \u00e9galement de nouvelles obligations de d\u00e9claration \u00e0 la charge des employeurs. Les rapports devront notamment contenir les informations suivantes :<\/p>\n<ul data-spread=\"false\">\n<li>l&#8217;\u00e9cart de r\u00e9mun\u00e9ration entre les femmes et les hommes, dans ses diff\u00e9rentes composantes ;<\/li>\n<li>l&#8217;\u00e9cart m\u00e9dian de r\u00e9mun\u00e9ration entre les femmes et les hommes, dans ses diff\u00e9rentes composantes ;<\/li>\n<li>la proportion de travailleurs et de travailleuses dans chaque quartile de r\u00e9mun\u00e9ration ;<\/li>\n<li>l&#8217;\u00e9cart de r\u00e9mun\u00e9ration entre les femmes et les hommes par cat\u00e9gorie de travailleurs, sur la base du salaire de base ou des diff\u00e9rentes composantes de la r\u00e9mun\u00e9ration.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Au plus tard le 7 juin 2027, les entreprises employant au moins 250 travailleurs devront r\u00e9diger leur premier rapport, portant sur l&#8217;ann\u00e9e 2026. Elles devront ensuite transmettre un rapport chaque ann\u00e9e, couvrant l&#8217;ann\u00e9e civile pr\u00e9c\u00e9dente. Les entreprises de plus petite taille seront soumises \u00e0 une fr\u00e9quence de d\u00e9claration moins \u00e9lev\u00e9e, selon les modalit\u00e9s suivantes :<\/p>\n<ul data-spread=\"false\">\n<li>les entreprises employant entre 150 et 249 travailleurs devront pr\u00e9senter un rapport tous les trois ans, \u00e0 compter du 7 juin 2027 au plus tard ;<\/li>\n<li>les entreprises employant entre 100 et 149 travailleurs devront pr\u00e9senter un rapport tous les trois ans, \u00e0 compter du 7 juin 2031 au plus tard.<\/li>\n<li>Pour les entreprises employant moins de 100 travailleurs, la d\u00e9claration demeure facultative.<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Dans tous les cas, les entreprises devront publier leur rapport <strong>dans un d\u00e9lai de quatorze jours ouvrables<\/strong> suivant la fin de la p\u00e9riode de d\u00e9claration. Si les rapports r\u00e9v\u00e8lent un \u00e9cart de r\u00e9mun\u00e9ration entre les femmes et les hommes sup\u00e9rieur \u00e0 5 %, l&#8217;employeur devra prendre rapidement des mesures correctives. Plus pr\u00e9cis\u00e9ment, dans un d\u00e9lai de six mois, il devra soit justifier cet \u00e9cart au moyen de crit\u00e8res objectifs, soit y rem\u00e9dier int\u00e9gralement.<\/p>\n<p class=\"isSelectedEnd\">Parmi les autorit\u00e9s charg\u00e9es de contr\u00f4ler le respect de ces obligations figure le D\u00e9partement des Relations Industrielles et de l&#8217;Emploi (<a href=\"https:\/\/dier.gov.mt\/\" target=\"_blank\" rel=\"noopener\">DIER<\/a>). Celui-ci sera notamment charg\u00e9 de recueillir et de publier les rapports de mani\u00e8re \u00e0 permettre des comparaisons entre les entreprises, les secteurs d&#8217;activit\u00e9 et les diff\u00e9rentes r\u00e9gions de Malte.<\/p>\n<h2>Conclusion<\/h2>\n<p>La transposition maltaise de la directive (UE) 2023\/970 constitue une \u00e9tape importante vers une plus grande transparence des r\u00e9mun\u00e9rations et une meilleure \u00e9galit\u00e9 salariale entre les femmes et les hommes. Les salari\u00e9s estimant \u00eatre victimes d&#8217;une discrimination salariale pourront saisir le Tribunal Industriel afin d&#8217;obtenir une indemnisation ou le versement des r\u00e9mun\u00e9rations, primes ou avantages auxquels ils ont droit. En outre, les violations des dispositions du r\u00e8glement constituent des infractions p\u00e9nales et peuvent entra\u00eener des amendes pouvant atteindre <strong>7 000 euros<\/strong> \u00e0 l&#8217;encontre des employeurs. Il est donc essentiel que les entreprises \u00e9tablies \u00e0 Malte \u00e9valuent leurs proc\u00e9dures internes afin de limiter les risques de non-conformit\u00e9 et de promouvoir un environnement
