Ces changements l\u00e9gislatifs visent \u00e0 mettre en \u0153uvre les dispositions de la <a href=\"https:\/\/arlettipartners.com\/fr\/directive-ue-2023-970-renforcer-egalite-salariale-et-transparence-salariale\/\">directive (UE) 2023\/970<\/a> relative \u00e0 la transparence salariale. Plus pr\u00e9cis\u00e9ment, le gouvernement bulgare a adopt\u00e9 divers amendements au cadre \u00e9tabli par la <a href=\"https:\/\/kzd-nondiscrimination.com\/?page_id=9571&amp;lang=en\" target=\"_blank\" rel=\"noopener\">Commission pour la Protection contre la Discrimination<\/a>. Ces dispositions visent \u00e0 promouvoir le principe de l&#8217;\u00e9galit\u00e9 salariale entre les sexes, ainsi que la transparence salariale sur les lieux de travail. Le pr\u00e9sent article examine le contenu de la transposition bulgare.<\/p>\n<h2>Divulgation d\u2019informations sur les salaires<\/h2>\n<p>Tout d\u2019abord, les salari\u00e9s auront le droit de demander des informations d\u00e9taill\u00e9es concernant les niveaux de r\u00e9mun\u00e9ration moyens applicables \u00e0 leur poste et \u00e0 leur sexe. Ces demandes devront \u00eatre adress\u00e9es par \u00e9crit \u00e0 l\u2019employeur. D\u00e8s r\u00e9ception de la demande, les employeurs seront tenus de fournir une r\u00e9ponse \u00e9crite <strong>dans un d\u00e9lai de deux mois<\/strong>. Le rapport \u00e9crit devra inclure des d\u00e9tails concernant le salaire de l\u2019employ\u00e9 et la r\u00e9mun\u00e9ration moyenne des travailleurs occupant le m\u00eame poste.<\/p>\n<h2>Renforcement de la protection des donn\u00e9es personnelles<\/h2>\n<p>Deuxi\u00e8mement, la transposition bulgare vise \u00e0 renforcer la protection des donn\u00e9es personnelles des salari\u00e9s. Cela signifie que, dans le cas o\u00f9 la divulgation d\u2019informations salariales r\u00e9v\u00e9lerait la r\u00e9mun\u00e9ration exacte d\u2019un autre salari\u00e9, des mesures suppl\u00e9mentaires s\u2019appliqueront. Dans de tels cas, l\u2019employeur pourra communiquer ces donn\u00e9es \u00e0 des organismes sp\u00e9cifiques, tels que <strong>les syndicats ou les autorit\u00e9s charg\u00e9es de la lutte contre la discrimination<\/strong>. Ces organismes fourniront ensuite au salari\u00e9 les informations requises, ainsi que les voies de recours juridiques possibles en cas de traitement discriminatoire.<\/p>\n<h2>Obligations suppl\u00e9mentaires de d\u00e9claration pour les employeurs<\/h2>\n<p>Les nouvelles r\u00e8gles instaurent des obligations suppl\u00e9mentaires de d\u00e9claration pour les entreprises. Plus pr\u00e9cis\u00e9ment, les employeurs devront pr\u00e9senter chaque ann\u00e9e des <strong>rapports sur les \u00e9carts de r\u00e9mun\u00e9ration entre les hommes et les femmes<\/strong>. Les entreprises comptant plus de 250 salari\u00e9s devront commencer \u00e0 pr\u00e9senter leurs rapports en juin 2027. \u00c0 l\u2019inverse, celles employant entre 100 et 249 salari\u00e9s seront tenues de rendre compte tous les trois ans, \u00e0 compter de juin 2031. Dans tous les cas, si des \u00e9carts salariaux injustifi\u00e9s devaient appara\u00eetre, les employeurs seront tenus de proc\u00e9der \u00e0 des \u00e9valuations salariales conjointes avec leurs salari\u00e9s.<\/p>\n<h2>Conclusions<\/h2>\n<p>En 2024, l\u2019\u00e9cart de r\u00e9mun\u00e9ration entre les hommes et les femmes en Bulgarie s\u2019\u00e9levait \u00e0 environ 12 %, soit un niveau sup\u00e9rieur \u00e0 la moyenne de l\u2019UE, qui est de 11,1 %. Les modifications ponctuelles apport\u00e9es \u00e0 la r\u00e9glementation pourraient constituer une <strong>r\u00e9ponse rapide \u00e0 l\u2019appel lanc\u00e9 par l\u2019UE en faveur d\u2019une plus grande transparence salariale<\/strong>. Parall\u00e8lement, elles d\u00e9montrent l\u2019engagement de la Bulgarie \u00e0 promouvoir des conditions de travail plus \u00e9quitables. En cons\u00e9quence, les entreprises concern\u00e9es devraient revoir leurs politiques de r\u00e9mun\u00e9ration et leurs processus de reporting existants afin de s\u2019assurer qu\u2019elles sont
