En mars 2026, le gouvernement lituanien a approuv\u00e9 des projets d\u2019amendements au Code du travail visant \u00e0 aligner la l\u00e9gislation nationale sur la Directive avant la date limite fix\u00e9e par l\u2019UE au 7 juin 2026. La proposition est d\u00e9sormais en attente de l\u2019approbation finale du Parlement lituanien (Seimas).<\/p>\n<p class=\"isSelectedEnd\"><strong>Transparence du recrutement et divulgation des salaires<\/strong><\/p>\n<p class=\"isSelectedEnd\">L\u2019un des \u00e9l\u00e9ments cl\u00e9s de la r\u00e9forme lituanienne concerne les pratiques de recrutement. En vertu du Code du travail modifi\u00e9, les employeurs ne pourront pas demander aux candidats des informations sur la r\u00e9mun\u00e9ration per\u00e7ue dans leurs relations de travail actuelles ou pr\u00e9c\u00e9dentes. Les employeurs devront \u00e9galement fournir des informations sur les conventions collectives applicables au poste avant le d\u00e9but des n\u00e9gociations d\u2019embauche.<\/p>\n<p class=\"isSelectedEnd\">La l\u00e9gislation renforce \u00e9galement les droits des salari\u00e9s \u00e0 discuter et divulguer leur r\u00e9mun\u00e9ration. Les clauses de confidentialit\u00e9 ou les politiques internes ne pourront pas emp\u00eacher les travailleurs de partager des informations salariales lorsqu\u2019ils exercent leurs droits \u00e0 l\u2019\u00e9galit\u00e9 de r\u00e9mun\u00e9ration. Cela refl\u00e8te l\u2019objectif plus large de la Directive visant \u00e0 accro\u00eetre la transparence des structures de r\u00e9mun\u00e9ration.<\/p>\n<p class=\"isSelectedEnd\"><strong>Structures salariales neutres du point de vue du genre<\/strong><\/p>\n<p class=\"isSelectedEnd\">Une innovation majeure de la proposition lituanienne est l\u2019obligation pour les employeurs de mettre en place des syst\u00e8mes de r\u00e9mun\u00e9ration formels et neutres du point de vue du genre. Les postes devront \u00eatre \u00e9valu\u00e9s selon des crit\u00e8res objectifs tels que les comp\u00e9tences, les qualifications, les responsabilit\u00e9s, les efforts et les conditions de travail.<\/p>\n<p class=\"isSelectedEnd\">Les amendements introduisent \u00e9galement des d\u00e9finitions formelles du \u00ab m\u00eame travail \u00bb et du \u00ab travail de valeur \u00e9gale \u00bb, deux concepts centraux de la Directive. Le droit lituanien permettrait aussi des comparaisons entre filiales lorsque les r\u00e9mun\u00e9rations sont fix\u00e9es de mani\u00e8re centralis\u00e9e. Dans certains cas, des preuves statistiques ou des comparateurs hypoth\u00e9tiques pourraient \u00e9galement \u00eatre utilis\u00e9s pour soutenir des plaintes pour discrimination.<\/p>\n<p class=\"isSelectedEnd\"><strong>Rapports sur les \u00e9carts de r\u00e9mun\u00e9ration et r\u00f4le de SoDRA<\/strong><\/p>\n<p class=\"isSelectedEnd\">L\u2019un des aspects les plus distinctifs de l\u2019approche lituanienne est le r\u00f4le attribu\u00e9 \u00e0 SoDRA, l\u2019autorit\u00e9 nationale de s\u00e9curit\u00e9 sociale. Les employeurs transmettront les donn\u00e9es relatives \u00e0 la paie et au temps de travail, tandis que SoDRA calculera les indicateurs d\u2019\u00e9cart salarial entre les sexes requis par la Directive et les publiera publiquement. Ce syst\u00e8me centralis\u00e9 pourrait r\u00e9duire de mani\u00e8re significative la charge administrative des employeurs.<\/p>\n<p class=\"isSelectedEnd\">Les obligations de reporting suivront un calendrier progressif. Les employeurs comptant au moins 150 salari\u00e9s devront commencer \u00e0 d\u00e9clarer les donn\u00e9es d\u2019ici mai 2027, tandis que les entreprises de 100 \u00e0 149 salari\u00e9s suivront \u00e0 partir de 2031.<\/p>\n<p class=\"isSelectedEnd\">Si un \u00e9cart de r\u00e9mun\u00e9ration injustifi\u00e9 de 5 % ou plus n\u2019est pas corrig\u00e9 dans un d\u00e9lai de six mois, les employeurs devront r\u00e9aliser une \u00e9valuation conjointe des r\u00e9mun\u00e9rations avec les repr\u00e9sentants des salari\u00e9s.<\/p>\n<p class=\"isSelectedEnd\"><strong>Application et sanctions<\/strong><\/p>\n<p class=\"isSelectedEnd\">En d\u2019autres termes, la Lituanie a adopt\u00e9 une approche ambitieuse et tourn\u00e9e vers l\u2019avenir en mati\u00e8re de transparence salariale, en introduisant un syst\u00e8me de reporting centralis\u00e9 et en fixant des attentes claires pour garantir que les structures salariales soient transparentes, \u00e9quitables et neutres du point de vue du genre.<\/p>\n<p class=\"isSelectedEnd\">Le projet de l\u00e9gislation introduit \u00e9galement des sanctions administratives en cas de non-conformit\u00e9. Selon le projet actuel, les employeurs qui ne respectent pas les obligations de transparence salariale ou de reporting pourront \u00eatre sanctionn\u00e9s par des amendes \u00e0 partir de 400 \u20ac, pouvant atteindre jusqu\u2019\u00e0 6 000 \u20ac en cas de violations r\u00e9p\u00e9t\u00e9es ou graves.<\/p>\n<p>Les salari\u00e9s victimes de discrimination salariale auront \u00e9galement le droit de demander une indemnisation, y compris pour les salaires impay\u00e9s, les opportunit\u00e9s de carri\u00e8re perdues et les dommages moraux.
