{"id":235247,"date":"2026-05-14T09:29:36","date_gmt":"2026-05-14T07:29:36","guid":{"rendered":"https:\/\/arlettipartners.com\/?post_type=news&#038;p=235247"},"modified":"2026-05-14T09:29:38","modified_gmt":"2026-05-14T07:29:38","slug":"transposition-directive-transparence-remunerations-pologne","status":"publish","type":"news","link":"https:\/\/arlettipartners.com\/fr\/transposition-directive-transparence-remunerations-pologne\/","title":{"rendered":"Transposition de la directive sur la transparence des r\u00e9mun\u00e9rations en Pologne"},"content":{"rendered":"<p data-start=\"83\" data-end=\"413\">Les \u00c9tats membres de l\u2019Union europ\u00e9enne sont tenus de se conformer \u00e0 la <a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2023\/970\/oj\/eng\">directive europ\u00e9enne sur la transparence des r\u00e9mun\u00e9rations (Directive 2023\/970), relative \u00e0 l\u2019application du principe de l\u2019\u00e9galit\u00e9 de r\u00e9mun\u00e9ration entre les femmes et les hommes pour un m\u00eame travail ou un travail de valeur \u00e9gale<\/a>, au plus tard le 7 juin 2026.<\/p>\n<p data-start=\"415\" data-end=\"693\">Dans ce contexte, la Pologne a publi\u00e9 un projet de loi visant \u00e0 transposer la directive sur la transparence salariale. Le texte pr\u00e9voit des dispositions ambitieuses tant en ce qui concerne les obligations impos\u00e9es aux employeurs que les m\u00e9canismes de participation des salari\u00e9s.<\/p>\n<h2 data-section-id=\"o6hhwr\" data-start=\"695\" data-end=\"732\">Contenu du projet de loi polonais<\/h2>\n<h3 data-start=\"734\" data-end=\"805\">\u00c9valuation des emplois et d\u00e9termination des cat\u00e9gories de salari\u00e9s<\/h3>\n<p data-start=\"807\" data-end=\"1115\">L\u2019un des \u00e9l\u00e9ments essentiels du <a href=\"https:\/\/legislacja.rcl.gov.pl\/projekt\/12405300\/katalog\/13175852#13175852\">projet de loi<\/a> r\u00e9side dans l\u2019obligation, pour les employeurs, d\u2019\u00e9valuer objectivement la valeur du travail effectu\u00e9 par les salari\u00e9s. Cette \u00e9valuation devra reposer sur des crit\u00e8res objectifs pr\u00e9alablement convenus avec les organisations syndicales pr\u00e9sentes dans l\u2019entreprise.<\/p>\n<p data-start=\"1117\" data-end=\"1355\">En pr\u00e9sence de plusieurs organisations syndicales, l\u2019employeur devra d\u00e9terminer ces crit\u00e8res d\u2019un commun accord avec l\u2019ensemble des organisations concern\u00e9es ou, \u00e0 tout le moins, avec celles repr\u00e9sentant au minimum 5 % de l\u2019effectif total.<\/p>\n<p data-start=\"1357\" data-end=\"1650\">Un m\u00e9canisme similaire est \u00e9galement pr\u00e9vu pour la d\u00e9termination des cat\u00e9gories de salari\u00e9s. \u00c0 cet \u00e9gard, l\u2019employeur devra consulter l\u2019ensemble des organisations syndicales pr\u00e9sentes dans l\u2019entreprise dans un d\u00e9lai d\u00e9termin\u00e9, afin de garantir une planification et une mise en \u0153uvre efficaces.<\/p>\n<p data-start=\"1652\" data-end=\"1864\">Bien que cette consultation ne lie pas juridiquement l\u2019employeur quant \u00e0 la prise en compte des avis exprim\u00e9s par les repr\u00e9sentants syndicaux, le non-respect de cette proc\u00e9dure pourrait engager sa responsabilit\u00e9.<\/p>\n<h3>Rapport sur les \u00e9carts de r\u00e9mun\u00e9ration et \u00e9valuation conjointe des r\u00e9mun\u00e9rations<\/h3>\n<p data-start=\"1952\" data-end=\"2113\">Par ailleurs, toutes les entreprises comptant plus de 100 salari\u00e9s seront tenues d\u2019\u00e9tablir un rapport sur l\u2019\u00e9cart de r\u00e9mun\u00e9ration entre les femmes et les hommes.<\/p>\n<p data-start=\"2115\" data-end=\"2307\">Une nouvelle fois, les organisations syndicales joueront un r\u00f4le actif en supervisant et en v\u00e9rifiant l\u2019exactitude des informations figurant dans le rapport relatif aux \u00e9carts de r\u00e9mun\u00e9ration.<\/p>\n<p data-start=\"2309\" data-end=\"2540\">Le projet de loi introduit \u00e9galement un important m\u00e9canisme de participation : l\u2019\u00e9valuation conjointe des r\u00e9mun\u00e9rations (\u00ab joint pay assessment \u00bb), fond\u00e9e sur les r\u00e9sultats du rapport sur les \u00e9carts de r\u00e9mun\u00e9ration entre les sexes.<\/p>\n<p data-start=\"2542\" data-end=\"2646\">Cette \u00e9valuation conjointe deviendra obligatoire lorsque les trois conditions suivantes seront r\u00e9unies :<\/p>\n<ul data-start=\"2648\" data-end=\"2996\">\n<li data-section-id=\"19srlgr\" data-start=\"2648\" data-end=\"2749\">le rapport met en \u00e9vidence un \u00e9cart de r\u00e9mun\u00e9ration d\u2019au moins 5 % dans une cat\u00e9gorie de salari\u00e9s ;<\/li>\n<li data-section-id=\"r4ac7r\" data-start=\"2750\" data-end=\"2875\">l\u2019employeur n\u2019est pas en mesure de justifier cet \u00e9cart au moyen de crit\u00e8res objectifs et neutres du point de vue du genre ;<\/li>\n<li data-section-id=\"1q764wr\" data-start=\"2876\" data-end=\"2996\">l\u2019employeur n\u2019a pas mis en \u0153uvre de mesures correctives efficaces dans les six mois suivant la publication du rapport.<\/li>\n<\/ul>\n<p data-start=\"2998\" data-end=\"3178\">Dans une telle hypoth\u00e8se, l\u2019employeur devra parvenir \u00e0 un accord avec la partie salariale afin de rem\u00e9dier \u00e0 la situation et de mettre en \u0153uvre des mesures correctives appropri\u00e9es.<\/p>\n<h2 data-section-id=\"1079bb9\" data-start=\"3180\" data-end=\"3194\">Conclusion<\/h2>\n<p data-start=\"3196\" data-end=\"3307\">En conclusion, ce projet de loi devrait entra\u00eener des modifications fondamentales du droit du travail polonais.<\/p>\n<p data-start=\"3309\" data-end=\"3657\">D\u2019une part, le texte renforcerait consid\u00e9rablement le syst\u00e8me de participation des salari\u00e9s gr\u00e2ce \u00e0 l\u2019introduction d\u2019instruments juridiques sp\u00e9cifiques, tels que l\u2019accord collectif et la consultation. Par cons\u00e9quent, il deviendrait de plus en plus difficile pour les employeurs d\u2019imposer unilat\u00e9ralement leurs d\u00e9cisions dans les domaines concern\u00e9s.<\/p>\n<p data-start=\"3659\" data-end=\"3946\" data-is-last-node=\"\" data-is-only-node=\"\">Enfin, le projet de loi pr\u00e9voit l\u2019introduction d\u2019amendes administratives comprises entre 3 000 et 50 000 zlotys polonais (environ 700 \u00e0 11 800 euros) \u00e0 l\u2019encontre des employeurs ne respectant pas les dispositions pr\u00e9vues, ainsi qu\u2019une responsabilit\u00e9 civile envers les
