Ce D\u00e9cret-loi illustre les \u00ab Mesures urgentes de sant\u00e9 et de s\u00e9curit\u00e9 sur le lieu de travail et dans le domaine de la protection civile \u00bb. Cet article pr\u00e9sente les principaux points du d\u00e9cret-loi abord\u00e9s dans la circulaire, en mettant particuli\u00e8rement l&#8217;accent sur les directives en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-contract-or-subcontract-works\">Travaux en contrat ou sous-traitance<\/h2>\n\n<p><p>Afin de se concentrer davantage sur les secteurs pr\u00e9sentant un risque sup\u00e9rieur d&#8217;irr\u00e9gularit\u00e9s, le d\u00e9cret-loi 159\/2025 r\u00e9affirme l&#8217;importance des inspections aupr\u00e8s des employeurs effectuant des travaux de sous-traitance publics ou priv\u00e9s. En outre, les entreprises exer\u00e7ant des activit\u00e9s jug\u00e9es \u00e0 haut risque ou op\u00e9rant sur des chantiers de construction, dans le cadre de contrats et de sous-traitance, doivent fournir \u00e0 leurs employ\u00e9s un <a data-mce-href=\"https:\/\/arlettipartners.com\/fr\/inl-clarifications-concernant-le-badge-d-identification-pour-les-chantiers-de-construction\/\" href=\"https:\/\/arlettipartners.com\/fr\/inl-clarifications-concernant-le-badge-d-identification-pour-les-chantiers-de-construction\/\">badge d&#8217;identification<\/a> sp\u00e9cifique. Ce badge doit \u00eatre envoy\u00e9 au travailleur sous forme num\u00e9rique et contenir un code unique anti-contrefa\u00e7on. De plus, le badge de chantier est obligatoire pour les travailleurs ind\u00e9pendants et les entreprises qui ne sont pas n\u00e9cessairement actives dans le secteur de la construction, mais qui op\u00e8rent sur des chantiers de construction dans le cadre de contrats ou de sous-traitance.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-activities-requiring-a-credit-licence\">Activit\u00e9s n\u00e9cessitant un Permis \u00e0 points<\/h2>\n\n<p><p>Le d\u00e9cret-loi 159\/2025 introduit des changements importants concernant les activit\u00e9s soumises au <a data-mce-href=\"https:\/\/arlettipartners.com\/fr\/?news=permis-a-points-changements-a-partir-de-janvier-2026\" href=\"https:\/\/arlettipartners.com\/fr\/?news=permis-a-points-changements-a-partir-de-janvier-2026\">Permis \u00e0 points<\/a>. Plus pr\u00e9cis\u00e9ment, il confirme la d\u00e9duction de 5 points pour chaque travailleur non d\u00e9clar\u00e9 signal\u00e9 lors des inspections. Cette d\u00e9duction s&#8217;appliquera quel que soit le nombre de jours de travail non d\u00e9clar\u00e9 effectu\u00e9s par le travailleur signal\u00e9. En outre, les d\u00e9ductions d\u00e9crites ci-dessus ne s&#8217;appliqueront qu&#8217;aux infractions commises \u00e0 partir du 1er janvier 2026.<\/p><\/p>\n\n<p>En l&#8217;absence de Permis \u00e0 points ou en cas de points insuffisants, les entreprises ou les travailleurs ind\u00e9pendants seront passibles d&#8217;une sanction administrative correspondant \u00e0 10 % de la valeur des travaux et d&#8217;une exclusion de la participation aux travaux publics pendant une p\u00e9riode de six mois. Contrairement aux d\u00e9ductions mentionn\u00e9es ci-dessus, les sanctions pr\u00e9vues dans le pr\u00e9sent paragraphe s&#8217;appliquent aux infractions commises apr\u00e8s le 31 octobre 2025.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-mandatory-reporting-requirements-for-employers\">Communications obligatoires incombant \u00e0 l&#8217;employeur<\/h2>\n\n<p><p>Modifiant le <a data-mce-href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2021-11-02;179\" href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2021-11-02;179\" target=\"_blank\">d\u00e9cret-loi 179\/2021<\/a>, le d\u00e9cret-loi 159\/2025 introduit l&#8217;obligation pour les entreprises d&#8217;indiquer leur adresse num\u00e9rique pour la r\u00e9ception des communications officielles ayant valeur juridique. Cette obligation incombe sp\u00e9cifiquement aux administrateurs uniques, aux directeurs g\u00e9n\u00e9raux ou aux pr\u00e9sidents du conseil d&#8217;administration.<\/p><\/p>\n\n<p><p>Une autre modification concerne l&#8217;annexe XII du <a data-mce-href=\"https:\/\/tussl.it\/\" href=\"https:\/\/tussl.it\/\" target=\"_blank\">d\u00e9cret l\u00e9gislatif n\u00b0 81\/2008<\/a>. En particulier, la notification pr\u00e9alable envoy\u00e9e par le contractant ou le chef de projet \u00e0 l&#8217;autorit\u00e9 sanitaire locale et \u00e0 l&#8217;office provincial du travail doit clairement indiquer les entreprises op\u00e9rant en tant que sous-traitants, ainsi que leur code fiscal ou leur num\u00e9ro de TVA.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-personal-protection-measures\">Mesures de protection individuelle<\/h2>\n\n<p>Le d\u00e9cret-loi 159\/2025 fournit des pr\u00e9cisions suppl\u00e9mentaires concernant les \u00e9quipements de protection individuelle. En particulier, les employeurs doivent maintenir ces \u00e9quipements en bon \u00e9tat. Ils doivent \u00e9galement veiller \u00e0 ce qu&#8217;ils soient correctement identifi\u00e9s et d\u00e9crits dans le document d&#8217;\u00e9valuation des risques (DVR). La l\u00e9gislation apporte aussi des \u00e9claircissements sur l&#8217;utilisation correcte des \u00e9chelles verticales permanentes et des syst\u00e8mes de protection contre les chutes. De plus, le d\u00e9cret \u00e9tend l&#8217;obligation de former p\u00e9riodiquement le repr\u00e9sentant des travailleurs pour la s\u00e9curit\u00e9 (RLS). Dor\u00e9navant, cette formation concerne \u00e9galement les personnes occupant ce poste dans les entreprises de moins de 15 salari\u00e9s.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-conclusions\">Conclusions<\/h2>\n\n<p>La circulaire de l&#8217;Inspection Nationale du Travail italienne du 23\/02\/2026 et le d\u00e9cret-loi 159\/2025 visent \u00e0 \u00e9tablir des r\u00e8gles plus pr\u00e9cises en mati\u00e8re de sant\u00e9 et de s\u00e9curit\u00e9 sur les chantiers de construction, en accordant une attention particuli\u00e8re aux secteurs pr\u00e9sentant un risque \u00e9lev\u00e9 d&#8217;irr\u00e9gularit\u00e9s. Dans une optique de renforcement de la surveillance sanitaire et de la protection civile, la l\u00e9gislation susmentionn\u00e9e pourrait constituer un tournant en mati\u00e8re de s\u00e9curit\u00e9 des travailleurs et conduire \u00e0 une coop\u00e9ration plus \u00e9troite entre les entreprises et les autorit\u00e9s
