Parlement et Conseil (salaires minimums ad\u00e9quats)<\/a>, la Cour de justice de l&#8217;Union europ\u00e9enne (CJUE) a confirm\u00e9 la validit\u00e9 mat\u00e9rielle de la directive (UE) 2022\/2041 relative aux salaires minimums ad\u00e9quats dans l&#8217;Union europ\u00e9enne, tout en annulant deux dispositions jug\u00e9es comme constituant une ing\u00e9rence directe dans les comp\u00e9tences exclusives des \u00c9tats membres en mati\u00e8re de fixation des salaires.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-regulatory-background\">Contexte r\u00e9glementaire<\/h2>\n\n<p>Adopt\u00e9e le 19 octobre 2022, la directive vise \u00e0 am\u00e9liorer les conditions de vie et de travail dans l&#8217;ensemble de l&#8217;Union europ\u00e9enne en \u00e9tablissant un cadre juridique garantissant l&#8217;ad\u00e9quation des salaires minimums l\u00e9gaux dans les \u00c9tats membres et en renfor\u00e7ant la n\u00e9gociation collective dans la d\u00e9termination des niveaux de r\u00e9mun\u00e9ration.<br\/>Le Danemark a contest\u00e9 la directive et demand\u00e9 son annulation totale, soulignant que les syndicats et les employeurs danois d\u00e9terminent les salaires minimums exclusivement par le biais de n\u00e9gociations collectives plut\u00f4t que par la loi. Selon le gouvernement danois, la directive enfreignait la r\u00e9partition des comp\u00e9tences entre l&#8217;Union europ\u00e9enne et les \u00c9tats membres, constituant une ing\u00e9rence directe dans la fixation des salaires et le droit d&#8217;association syndicale, domaines express\u00e9ment r\u00e9serv\u00e9s aux \u00c9tats membres par les trait\u00e9s.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-findings-of-the-court\">Conclusions de la Cour<\/h2>\n\n<p>La Cour a tout d&#8217;abord pr\u00e9cis\u00e9 que l&#8217;exclusion de comp\u00e9tence de l&#8217;Union pr\u00e9vue par les trait\u00e9s ne couvre pas toutes les mesures qui sont simplement li\u00e9es \u00e0 la r\u00e9mun\u00e9ration ou qui produisent des effets indirects sur les niveaux de salaire. Sinon, le r\u00f4le de soutien de l&#8217;Union dans l&#8217;am\u00e9lioration des conditions de travail serait vid\u00e9 de sa substance.<br\/>L&#8217;exclusion ne s&#8217;applique donc qu&#8217;aux mesures qui constituent une ing\u00e9rence directe de l&#8217;Union dans la fixation des salaires.<\/p>\n\n<p>Sur cette base, la Cour a identifi\u00e9 deux dispositions de la directive qui d\u00e9passent la comp\u00e9tence de l&#8217;UE: <\/p>\n\n<ol class=\"wp-block-list\">\n<li>la disposition exigeant des \u00c9tats membres ayant instaur\u00e9 un salaire minimum l\u00e9gal qu&#8217;ils appliquent certains crit\u00e8res obligatoires lors de la fixation et de la mise \u00e0 jour de ce salaire,<\/li>\n\n\n\n<li>la r\u00e8gle interdisant la r\u00e9duction du salaire minimum dans les syst\u00e8mes nationaux pr\u00e9voyant des m\u00e9canismes d&#8217;indexation automatique.<\/li>\n<\/ol>\n\n<p>La Cour a annul\u00e9 ces dispositions car elle les consid\u00e9rait comme une forme d&#8217;harmonisation substantielle des politiques salariales nationales. Cette harmonisation porte atteinte \u00e0 la comp\u00e9tence exclusive des \u00c9tats membres dans ce domaine. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-scope-and-implications-of-the-judgment\">Port\u00e9e et implications du jugement <\/h2>\n\n<p>\u00c0 tous autres \u00e9gards, la Cour a rejet\u00e9 le recours du Danemark, confirmant la validit\u00e9 globale de la directive. Elle a notamment estim\u00e9 que les dispositions favorisant la n\u00e9gociation collective ne constituaient pas une ing\u00e9rence directe dans le droit d&#8217;association. Elles n&#8217;obligent pas les \u00c9tats membres \u00e0 modifier leurs syst\u00e8mes de repr\u00e9sentation syndicale ni \u00e0 augmenter le taux d&#8217;adh\u00e9sion aux syndicats.<\/p>\n\n<p>La d\u00e9cision clarifie ainsi les limites de l&#8217;action de l&#8217;UE dans le domaine des salaires. L&#8217;Union europ\u00e9enne peut fixer des objectifs en mati\u00e8re d&#8217;ad\u00e9quation et de transparence des salaires minimums. Elle ne peut toutefois pas \u00e9tablir de param\u00e8tres techniques ni intervenir directement dans leur d\u00e9termination. <\/p>\n\n<p>Par cette d\u00e9cision, la CJUE r\u00e9affirme les objectifs politiques de la directive. Elle garantit des salaires minimums \u00e9quitables et encourage les n\u00e9gociations collectives. Dans le m\u00eame temps, elle souligne la primaut\u00e9 des comp\u00e9tences nationales dans la gestion concr\u00e8te des m\u00e9canismes de fixation des salaires.
