La d\u00e9cision \u00e9tablit des crit\u00e8res permettant d&#8217;identifier la loi applicable en cas de changement du lieu de travail habituel.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-case-c-485-24-nbsp\">L&#8217;Affaire C-485\/24<\/h2>\n\n<p>L&#8217;affaire a commenc\u00e9 en 2002, lorsque la soci\u00e9t\u00e9 de transport luxembourgeoise Locatrans a embauch\u00e9 un citoyen fran\u00e7ais dans le cadre d&#8217;un contrat r\u00e9gi par la loi luxembourgeoise.<\/p>\n\n<p>Il avait \u00e9t\u00e9 initialement convenu que l&#8217;employ\u00e9 travaillerait comme chauffeur dans plusieurs pays europ\u00e9ens. Au fil du temps, cependant, l&#8217;activit\u00e9 de l&#8217;employ\u00e9 s&#8217;est progressivement d\u00e9plac\u00e9e vers la France. Ce changement a d\u00e9clench\u00e9 l&#8217;obligation de s&#8217;inscrire au syst\u00e8me de s\u00e9curit\u00e9 sociale fran\u00e7ais.<\/p>\n\n<p>Apr\u00e8s la cessation du contrat de travail, le chauffeur a intent\u00e9 une action devant le tribunal du travail de Dijon. Le tribunal du travail de Dijon a rejet\u00e9 ses demandes. La raison invoqu\u00e9e \u00e9tait qu&#8217;apr\u00e8s avoir appliqu\u00e9 le droit luxembourgeois, il n&#8217;avait trouv\u00e9 aucune base juridique. La cour d&#8217;appel de Dijon est ensuite intervenue. Elle a rejet\u00e9 la premi\u00e8re d\u00e9cision, estimant que le droit fran\u00e7ais r\u00e9gissait le contrat de travail compte tenu de l&#8217;application de la convention de Rome.<\/p>\n\n<p>\u00c0 travers une demande de d\u00e9cision pr\u00e9judicielle, la juridiction fran\u00e7aise a sollicit\u00e9 l&#8217;avis de la Cour de justice. Elle a demand\u00e9 une interpr\u00e9tation de la <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/FR\/TXT\/?uri=CELEX%3A41980A0934\" target=\"_blank\" rel=\"noopener\">Convention de Rome<\/a> sur la loi applicable aux obligations contractuelles.<\/p>\n\n<p>Plus pr\u00e9cis\u00e9ment, la Cour fran\u00e7aise a demand\u00e9 quelle loi s&#8217;applique lorsqu&#8217;un travailleur, apr\u00e8s avoir exerc\u00e9 son activit\u00e9 pendant un certain temps dans un \u00c9tat, transf\u00e8re son lieu de travail habituel dans un autre \u00c9tat.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-european-court-s-response\">La r\u00e9ponse de la Cour europ\u00e9enne<\/h2>\n\n<p>La Cour europ\u00e9enne note tout d&#8217;abord que la Convention de Rome envisage trois sc\u00e9narios :<\/p>\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>La loi applicable peut \u00eatre choisie par les parties ;<\/li>\n<\/ol>\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>En l&#8217;absence d&#8217;un tel choix, la loi du pays o\u00f9 l&#8217;employ\u00e9 travaille habituellement r\u00e9git le contrat ;<\/li>\n<\/ol>\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>Si ce crit\u00e8re ne peut pas \u00eatre appliqu\u00e9, le contrat est r\u00e9gi par la loi du pays o\u00f9 est situ\u00e9e l&#8217;entreprise qui a embauch\u00e9 le travailleur.<\/li>\n<\/ol>\n\n<p>Dans le cas pr\u00e9sent, la Cour estime que le crit\u00e8re du lieu de travail habituel ne peut pas s&#8217;appliquer, puisque le lieu de travail a chang\u00e9 d&#8217;un pays \u00e0 l&#8217;autre.<\/p>\n\n<p>Donc, le crit\u00e8re applicable dans le cas de Locatrans serait la loi du pays o\u00f9 la soci\u00e9t\u00e9 est situ\u00e9e, c&#8217;est-\u00e0-dire le Luxembourg.<\/p>\n\n<p>Toutefois, la Cour rappelle que les deux crit\u00e8res susmentionn\u00e9s sont soumis \u00e0 une limitation. Ils ne s&#8217;appliquent pas lorsque les circonstances montrent que le contrat de travail pr\u00e9sente des liens plus \u00e9troits avec un autre pays. Dans ce cas, c&#8217;est la l\u00e9gislation de ce dernier pays qui s&#8217;applique.<\/p>\n\n<p>En conclusion, dans l&#8217;affaire Locatrans, la Cour invite le tribunal fran\u00e7ais \u00e0 d\u00e9terminer si les circonstances montrent un lien plus \u00e9troit avec la France. Tous les \u00e9l\u00e9ments caract\u00e9risant la relation de travail doivent \u00eatre pris en consid\u00e9ration. Cela signifie que le dernier lieu de travail habituel du salari\u00e9 et l&#8217;obligation de s&#8217;inscrire \u00e0 la s\u00e9curit\u00e9 sociale fran\u00e7aise sont pris en
