Les entreprises \u00e9trang\u00e8res sont tenues de notifier le d\u00e9tachement \u00e0 l\u2019avance via une plateforme en ligne, en fournissant les informations n\u00e9cessaires. Les travailleurs d\u00e9tach\u00e9s ont droit aux m\u00eames conditions de travail et de salaire que leurs coll\u00e8gues finlandais, telles que r\u00e9gies par les conventions collectives. Il est \u00e9galement obligatoire de conserver la documentation relative au d\u00e9tachement (contrats, feuilles de temps, bulletins de salaire) pendant toute la dur\u00e9e de la mission, afin de la pr\u00e9senter en cas de contr\u00f4le.<\/p>&#13;\n&#13;\n<\/div><br\/><\/div><br\/><\/div><br\/><\/div><br\/><\/div><br\/><\/div><br\/><\/article><\/div><\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-andamento-delle-ispezioni-nel-2024\">Tendances des inspections en 2024<\/h2>\n\n<p>En 2024, 200 inspections ont \u00e9t\u00e9 r\u00e9alis\u00e9es, principalement dans le sud et le sud-ouest de la Finlande. Parmi celles-ci, 114 ont port\u00e9 sur des contr\u00f4les complets des notifications, de la documentation obligatoire, de la d\u00e9signation du repr\u00e9sentant l\u00e9gal et du respect des conditions de travail minimales. L\u2019approche d\u2019inspection vise \u00e0 identifier les situations les plus suspectes.<\/p>\n\n<p>Un nouvel \u00e9l\u00e9ment en 2024 a \u00e9t\u00e9 l\u2019\u00e9valuation de l\u2019authenticit\u00e9 du d\u00e9tachement : dans 13 cas, il a \u00e9t\u00e9 n\u00e9cessaire de v\u00e9rifier s\u2019il s\u2019agissait r\u00e9ellement d\u2019un d\u00e9tachement transnational ou, en fait, d\u2019un contrat de travail local. Dans 7 cas, il a \u00e9t\u00e9 d\u00e9termin\u00e9 qu\u2019il ne s\u2019agissait pas d\u2019un d\u00e9tachement transnational, entra\u00eenant l\u2019application compl\u00e8te de la l\u00e9gislation finlandaise en mati\u00e8re de travail, de s\u00e9curit\u00e9 sociale et de fiscalit\u00e9.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-violazioni-ricorrenti\">Infractions r\u00e9currentes<\/h2>\n\n<p>Les irr\u00e9gularit\u00e9s les plus fr\u00e9quentes constat\u00e9es par les inspecteurs de l\u2019OSH sont les suivantes :<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Absence de notification du d\u00e9tachement, obligatoire avant le d\u00e9but des activit\u00e9s en Finlande.<\/li>\n\n\n\n<li>Non-d\u00e9signation d\u2019un repr\u00e9sentant sur le territoire pour les missions de plus de 10 jours.<\/li>\n\n\n\n<li>Documentation obligatoire manquante ou incompl\u00e8te (feuilles de temps, contrats, bulletins de salaire).<\/li>\n\n\n\n<li>Non-respect des salaires minimums tels que pr\u00e9vus par les conventions collectives.<\/li>\n\n\n\n<li>Violations de l\u2019interdiction de discrimination.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-settori-maggiormente-coinvolti\">Secteurs les plus touch\u00e9s<\/h2>\n\n<p>Les violations se concentrent dans les secteurs de la construction, de la fabrication et des services administratifs, y compris les agences de travail temporaire. Ces trois secteurs repr\u00e9sentent presque toutes les inspections et sont les domaines o\u00f9 il est le plus difficile de garantir des conditions de travail conformes aux normes finlandaises.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-controlli-sui-contractor-finlandesi\">Inspections des entrepreneurs finlandais<\/h2>\n\n<p>En 2024, 44 inspections ont \u00e9galement \u00e9t\u00e9 r\u00e9alis\u00e9es sur des entreprises finlandaises faisant appel \u00e0 des fournisseurs \u00e9trangers, afin de v\u00e9rifier le respect des obligations d\u2019information envers l\u2019entreprise d\u00e9tachante et le droit au travail des travailleurs \u00e9trangers. Bien que le nombre de ces inspections soit en baisse par rapport \u00e0 2023, l\u2019attention reste \u00e9lev\u00e9e pour pr\u00e9venir les cas de responsabilit\u00e9 indirecte et de sous-traitance ill\u00e9gale.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-sanzioni-amministrative\">Sanctions administratives<\/h2>\n\n<p>Le r\u00e9gime de sanctions pr\u00e9voit une amende pour n\u00e9gligence allant de 1 000 \u00e0 10 000 \u20ac pour des manquements tels que l\u2019absence de notification, le d\u00e9faut de d\u00e9signation d\u2019un repr\u00e9sentant, la documentation indisponible ou le manque de coop\u00e9ration. En 2024, 69 mesures de sanction ont \u00e9t\u00e9 impos\u00e9es, pour un total de 322 350 \u20ac.<\/p>\n\n<p>\u00c0 partir de 2024, les sanctions ne sont appliqu\u00e9es qu\u2019aux entreprises d\u00e9tachantes et non plus aux entrepreneurs finlandais.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-conclusioni-e-prospettive\">Conclusions et perspectives<\/h2>\n\n<p>L\u2019ann\u00e9e 2024 confirme que, malgr\u00e9 la l\u00e9gislation en place, de nombreuses entreprises \u00e9trang\u00e8res ne respectent toujours pas les obligations minimales relatives au d\u00e9tachement transnational des travailleurs. La coop\u00e9ration transnationale, encourag\u00e9e par l\u2019Autorit\u00e9 europ\u00e9enne du travail (ELA) et le syst\u00e8me IMI, est de plus en plus centrale pour rendre les contr\u00f4les
