{"id":180644,"date":"2024-06-19T15:21:05","date_gmt":"2024-06-19T13:21:05","guid":{"rendered":"https:\/\/arlettipartners.com\/note-de-linl-sur-le-regime-de-sanctions-en-cas-de-fourniture-de-main-doeuvre-de-sous-traitance-et-de-detachement-illicites\/"},"modified":"2024-09-18T16:47:57","modified_gmt":"2024-09-18T14:47:57","slug":"note-de-linl-sur-le-regime-de-sanctions-en-cas-de-fourniture-de-main-doeuvre-de-sous-traitance-et-de-detachement-illicites","status":"publish","type":"news","link":"https:\/\/arlettipartners.com\/fr\/?news=note-de-linl-sur-le-regime-de-sanctions-en-cas-de-fourniture-de-main-doeuvre-de-sous-traitance-et-de-detachement-illicites","title":{"rendered":"Note de l&#8217;INL sur le r\u00e9gime de sanctions en cas de fourniture de main-d&#8217;\u0153uvre, de sous-traitance et de d\u00e9tachement illicites"},"content":{"rendered":"\n<p>L&#8217;objet de la note concerne l&#8217;<strong>article 29, paragraphe 4, du d\u00e9cret-loi n\u00b0 19\/2024<\/strong> (converti par la loi n\u00b0 56\/2024), qui a introduit des modifications importantes \u00e0 l&#8217;article 18 du d\u00e9cret l\u00e9gislatif n\u00b0 276\/2003, r\u00e9gissant le r\u00e9gime de sanctions en mati\u00e8re de <strong>travail temporaire, de sous-traitance et de d\u00e9tachement illicite<\/strong>. L&#8217;INL (Inspection Nationale du Travail) a fourni des premi\u00e8res indications sur l&#8217;application correcte des nouvelles dispositions.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-regime-sanzionatorio-in-materia-di-somministrazione-appalto-e-distacco-illeciti\">R\u00e9gime de sanctions en mati\u00e8re de travail temporaire, de sous-traitance et de d\u00e9tachement illicite<\/h2>\n\n<p>L&#8217;article 29, paragraphe 4, du d\u00e9cret-loi n\u00b0 19\/2024 a r\u00e9tabli la <strong>port\u00e9e p\u00e9nale<\/strong> des infractions sanctionn\u00e9es par l&#8217;article 18 du d\u00e9cret l\u00e9gislatif n\u00b0 276\/2003, visant \u00e0 sanctionner les<strong> pratiques de sous-traitance ou de d\u00e9tachement de personnel qui ne r\u00e9pondent pas aux exigences l\u00e9gales<\/strong> et qui, dans la plupart des cas, rel\u00e8vent simplement de la fourniture de main-d&#8217;\u0153uvre, introduisant une peine &#8211; alternative ou conjointe &#8211; d&#8217;emprisonnement ou d&#8217;amende.<\/p>\n\n<p>Concernant la d\u00e9termination correcte du montant des amendes \u00e0 appliquer lors de la contestation des infractions, il convient de tenir compte de ce qui est pr\u00e9vu par l&#8217;article 1, paragraphe 445, lettre d), loi n\u00b0 145\/2018, selon lequel &#8220;les montants des sanctions suivantes en mati\u00e8re de travail et de l\u00e9gislation sociale sont augment\u00e9s comme suit :<\/p>\n\n<ol class=\"wp-block-list\">\n<li>de 30 % pour les montants dus pour la violation de l&#8217;article 3 du d\u00e9cret-loi du 22 f\u00e9vrier 2002, n\u00b0 12, converti, avec modifications, par la loi du 23 avril 2002, n\u00b0 73 (dispositions en mati\u00e8re de <strong>travail irr\u00e9gulier<\/strong>) ;<\/li>\n\n\n\n<li>de 20 % pour les montants dus pour la violation des dispositions des articles 18 du d\u00e9cret l\u00e9gislatif du 10 septembre 2003, n\u00b0 276 (<strong>exercice non autoris\u00e9 des activit\u00e9s des agences de travail temporaire<\/strong>), 12 du d\u00e9cret l\u00e9gislatif du 17 juillet 2016, n\u00b0 136 (<strong>non-communication du d\u00e9tachement transnational<\/strong>), et 18-bis, paragraphes 3 et 4, du d\u00e9cret l\u00e9gislatif du 8 avril 2003, n\u00b0 66 (<strong>violation des dispositions relatives \u00e0 la dur\u00e9e moyenne du temps de travail et au repos hebdomadaire et quotidien<\/strong>)&#8221;.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\" id=\"h-art-1-comma-445-legge-n-145-2018\">Article 1, paragraphe 445, loi n\u00b0 145\/2018<\/h4>\n\n<p>Cette disposition a \u00e9t\u00e9 partiellement modifi\u00e9e par le d\u00e9cret-loi n\u00b0 19\/2024 avec une augmentation de 20 % \u00e0 30 % du montant de la maxi-amende pour travail au noir.<\/p>\n\n<p>La quantification finale de l&#8217;amende devra \u00e9galement tenir compte de ce qui est \u00e9tabli par le nouveau paragraphe 5-quinquies de l&#8217;article 18, tel que r\u00e9\u00e9crit lors de la conversion par la loi n\u00b0 56\/2024.<\/p>\n\n<p>Selon cette disposition, le montant des amendes proportionnelles pr\u00e9vues par cet article, m\u00eame sans la d\u00e9termination des limites minimales ou maximales, <strong>ne peut en aucun cas \u00eatre inf\u00e9rieur \u00e0 5.000 \u20ac ni sup\u00e9rieur \u00e0 50.000 \u20ac<\/strong>. Ces limites minimales et maximales seront appliqu\u00e9es aux infractions de fourniture de main-d&#8217;\u0153uvre non autoris\u00e9e (article 18, paragraphe 1er alin\u00e9a et paragraphe 2) et frauduleuse (article 18, paragraphe 5-ter), ainsi qu&#8217;\u00e0 la sous-traitance et au d\u00e9tachement illicites (article 18, paragraphe 5-bis), pour lesquels des amendes proportionnelles sont pr\u00e9vues pour chaque travailleur occup\u00e9 et pour chaque journ\u00e9e de travail.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-regime-della-recidiva\">R\u00e9gime de r\u00e9cidive<\/h2>\n\n<p>L&#8217;introduction du nouveau paragraphe 5-quater dans l&#8217;article 18 du d\u00e9cret l\u00e9gislatif n\u00b0 276\/2003, tel que modifi\u00e9 par le d\u00e9cret-loi n\u00b0 19\/2024, impose l&#8217;adoption de nouveaux principes d&#8217;interpr\u00e9tation, selon lesquels &#8220;les montants des sanctions pr\u00e9vues sont <strong>augment\u00e9s de vingt pour cent lorsque, au cours des trois ann\u00e9es pr\u00e9c\u00e9dentes, l&#8217;employeur a \u00e9t\u00e9 l&#8217;objet de sanctions p\u00e9nales pour les m\u00eames infractions<\/strong>&#8220;.<\/p>\n\n<p>\u00c0 titre d&#8217;exemple, il est donc consid\u00e9r\u00e9 qu&#8217;en pr\u00e9sence d&#8217;une amende prononc\u00e9e au cours des trois ann\u00e9es pr\u00e9c\u00e9dentes, m\u00eame pour des violations diff\u00e9rentes de celles pr\u00e9vues par l&#8217;article 18 mais comprises dans la lettre d) susmentionn\u00e9e &#8211; par exemple, ordonnance de contravention non contest\u00e9e en mati\u00e8re de travail au noir ou de temps de travail &#8211; les montants des amendes pour sous-traitance, d\u00e9tachement et fourniture de main-d&#8217;\u0153uvre illicite doivent \u00eatre augment\u00e9s de 40 %.<\/p>\n\n<p>Cette majoration s&#8217;appliquera \u00e9galement en cas de r\u00e9cidive &#8220;sp\u00e9cifique&#8221;, c&#8217;est-\u00e0-dire si elle concerne une des infractions d\u00e9j\u00e0 sanctionn\u00e9es en vertu du m\u00eame article 18.<\/p>\n\n<p>Ce m\u00e9canisme s&#8217;applique \u00e0 toutes les hypoth\u00e8ses de sanction pr\u00e9vues par l&#8217;article 18, y compris la nouvelle circonstance aggravante lorsqu&#8217;une fourniture de main-d&#8217;\u0153uvre est effectu\u00e9e dans le but sp\u00e9cifique de contourner les normes imp\u00e9ratives l\u00e9gales ou conventionnelles applicables au travailleur.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Direction Centrale de
