La Directiva 2019\/1152 actualiza lo ya previsto por la normativa 91\/533\/CEE. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>Para m\u00e1s informaci\u00f3n sobre todas las Directivas de la UE pertinentes, lee nuestra gu\u00eda sobre las <a href=\"https:\/\/arlettipartners.com\/eu-posted-workers-directives\/\">Directivas de la UE sobre el desplazamiento<\/a>.<\/p>\n<\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"posted\">Directiva 2019\/1152 sobre el desplazamiento: las novedades <\/h2>\n\n\n\n<p class=\"has-text-align-left\">El punto central de la Directiva 2019\/1152 se refiere a la informaci\u00f3n que se debe proporcionar a los trabajadores enviados al extranjero. El art\u00edculo 7 implementa las disposiciones previstas en el art\u00edculo 4.1 de la Directiva 91\/533\/CEE sobre la obligaci\u00f3n del empleador de informar a los trabajadores sobre las condiciones aplicables al contrato o relaci\u00f3n laboral. Entre la informaci\u00f3n adicional que el empleador debe proporcionar al trabajador antes de su partida se incluyen: <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El Pa\u00eds o Pa\u00edses en los que se realizar\u00e1 el trabajo en el extranjero y la duraci\u00f3n prevista;<\/li>\n\n\n\n<li>La moneda en la que se pagar\u00e1 la remuneraci\u00f3n; <\/li>\n\n\n\n<li>Las prestaciones en dinero o en especie relacionadas con las tareas; <\/li>\n\n\n\n<li>Si se prev\u00e9 el retorno y, en caso afirmativo, las condiciones que regulan el retorno del trabajador;<\/li>\n\n\n\n<li><strong>La remuneraci\u00f3n a la que tiene derecho el trabajador conforme a la legislaci\u00f3n aplicable del Estado miembro de acogida, si corresponde<\/strong>;<\/li>\n\n\n\n<li>Las indemnizaciones espec\u00edficas por el desplazamiento y los m\u00e9todos de reembolso de los gastos de viaje, alojamiento y manutenci\u00f3n; <\/li>\n\n\n\n<li>El enlace al sitio web nacional oficial \u00fanico desarrollado por el Estado miembro de acogida de acuerdo con el art\u00edculo 5, p\u00e1rrafo 2, de la Directiva 2014\/67\/UE del Parlamento Europeo y del Consejo.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-comunicacion-del-nivel-salarial-segun-la-directiva-2019-1152\">Comunicaci\u00f3n del nivel salarial seg\u00fan la Directiva 2019\/1152<\/h3>\n\n\n\n<p class=\"has-text-align-left\">Subrayamos, por lo tanto, la obligatoriedad de <strong>comunicar a los propios empleados<\/strong> enviados al extranjero por per\u00edodos superiores a un mes, entre otra informaci\u00f3n, el nivel salarial previsto por el contrato aplicable en el Estado de destino que corresponde a su tarea en el extranjero.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Esta informaci\u00f3n se suma a la informaci\u00f3n esencial que el empleador debe proporcionar al inicio de la relaci\u00f3n laboral (naturaleza y duraci\u00f3n del empleo, organizaci\u00f3n del horario laboral, remuneraci\u00f3n, convenio colectivo aplicable, etc.). <\/p>\n\n\n\n<p class=\"has-text-align-left\">El documento que contiene la informaci\u00f3n mencionada en el art\u00edculo 7 de la Directiva 2019\/1152 (que sustituye a la Directiva 91\/533\/CEE) <strong>ser\u00e1, por tanto, considerado obligatorio<\/strong>. Adem\u00e1s, podr\u00e1 ser solicitado por las autoridades del Pa\u00eds de acogida, ya que contiene informaci\u00f3n que, de acuerdo con la Directiva 2014\/67\/UE, debe estar disponible bajo petici\u00f3n.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"exemptions\">Las exenciones previstas por la directiva de la UE <\/h2>\n\n\n\n<p class=\"has-text-align-left\">El p\u00e1rrafo 4 del art\u00edculo 7 especifica que la obligaci\u00f3n de proporcionar la informaci\u00f3n adicional a los trabajadores enviados al extranjero no se aplica &#8220;<em>si la duraci\u00f3n de cada per\u00edodo de trabajo fuera del Estado miembro en el que el trabajador trabaja habitualmente es igual o inferior a cuatro semanas consecutivas<\/em>&#8220;.<\/p>\n\n\n\n<p class=\"has-text-align-left\">Sin embargo, es necesario especificar que los Estados miembros tienen la posibilidad de disponer lo contrario respecto a este punto.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"entry\">Entrada en vigor <\/h2>\n\n\n\n<p class=\"has-text-align-left\">Los Estados miembros tienen hasta el 1 de agosto de 2022 para transponer la Directiva 2019\/1152
